[0:04] Okay, welcome. Everyone today is police oversight panel meeting, December 9, th 2024. So we have quorum to start our meeting. And I'm going to start with reading our land acknowledgement. We acknowledge the Arapaho Youth and Cheyen tribes, the traditional custodians of the Lantern which the police oversight panel and boulder police department operates and pay our respects to their elders, past and present. I'm also going to remind the panel about our community agreements that we set forth to our work in the way that we treat each other, and the way that we handle our business. So I want to welcome the public gonna also welcome any members of the press if they have joined

[1:03] And I'm gonna welcome our panel members. Thank you. Everyone for being here. just a a couple of things before we start. We ask member of the public to use the Q&A. Option that is at the bottom of the menu. I'm also going to remind panels that not to use the chat open to everyone. If any communication is necessary. We can do it one on one but we shall not use the or the chat open to everyone also for member members of the public. We will answer small kind of questions during our meeting while we're having you're using the Q&A option. But we will say bigger questions that require bigger, more time to respond to to the end, to a public comment.

[6:03] you know, things to develop with some of the connections that we've made. So there's no there's no meeting this month for the community engagement at the engagement committee. Sorry. Thank you. Milan. Okay, so we I'm happy to announce that we have a very slim agenda with December after months of having very thick agendas. This feels like a relief. Okay, we're ready to go to the Independent Police Monitor report. Then.

[7:03] Okay, do people see this in a format that makes sense? Okay, thanks for the nod, Steve, nodding. I've lost many of you on my little screen. Okay, so going for the independent lease monitors report for December of 2,024. I would like to share that. We have case data so full file, full case file reviews completed in November of 2024 were 4. Thank you. All of you who participated in those, some of them at somewhat inconvenient times around the holidays. and 2 full case file reviews were completed and still pending police department disposition, and there are 10 cases currently awaiting panel review. Starting the cases that were completed, we have, mi. 2,024, 0 2, 8

[8:02] officer one was dispatched to a parking structure in response to a 911 call of a man cursing at people who was described as smoking a pipe, and thought to be high upon Contact Officer. One kicked away a large knife from the man who was initially compliant. When Officer one erroneously told the man he was under arrest. The man became uncooperative officer. One repeatedly gave instructions to the man who continued walking away and not cooperating officer. One performed a takedown on the man who was handcuffed by other assisting officers. This complaint was generated internally by Bpd. Leadership upon review of the use of force report. officer. One 1st allegation was Rule 5 police authority and public trust arrested the man. The panel recommended that this allegation be exonerated, and the department was in agreement. The second allegation rule, one compliance with values, rules, and general orders. General order 201. Report writing did not include the elements of each criminal charge issued against the man.

[9:01] The panel recommended that this allegation be sustained, and that the officer received verbal counseling and training, and the department's final decision was that this allegation was also sustained with verbal counseling officer. One additional allegation rule 6. Use of force performed a takedown on the man. Both the panel and the department exonerated that allegation. another allegation rule, one compliance with values, rules, and general orders engaged in physical tactics prior to the arrival of an assist unit. The panel recommended exonerated, and the Department agreed. and the final allegation rule for respect for others initiated the interaction with the man aggressively. The panel recommended that this allegation be sustained with a 1 year written reprimand and de-escalation training. The Department's final determination was not sustained, but

[10:02] they determined that verbal coaching and training, including de-escalation and officer. Safety was appropriate. The panel further opined that the officer one did not appear to display empathy towards the man, but instead initiated the confrontation aggressively. Officer one's aggressive approach needlessly escalated the interaction and officer. One's conduct does not accord with the de-escalation training provided by Bpd. This appears to be yet another example of a Bpd officer abandoning de-escalation techniques while interacting with a person he perceived to be unhoused. The panel members are concerned that Bpd training and de-escalation is not regularly supported and enforced among patrol officers and supervisors. The panel members also noted the contrast between officer, one's conduct and officer 3 who treated the man as a person instead of a problem. They noted that Officer 3 modeled the contact, conduct and respect that panel members had seen demonstrated in Bpd. Trainings.

[11:05] At the next case, MI. 2, 0, 2, 4, 0 3, 3. The complainant made complaints about multiple incidents when Bpd responded, officers one and 2 responded 1st to his home in response to his complaint about a scratch on his truck windshield. Officers one and 2 did not create a report documenting the scratch. The complainant later came to the Bpd station to report the scratch officers. 3 and 4 spoke with him initially before complainant spoke with Sergeant. One complainant made complaints about how officers responded, and Sergeant one did not register this complaint. For the allegations against Officer. One rule, one compliance with values, rules, and general order. Report writing failed to complete a report for the complainant's damaged windshield. The panel recommended, and the Department agreed that this allegation be administratively closed for a second allegation rule. One customer service values was dismissive towards complainant. The panel recommended that the allegation be not sustained, and the department agreed

[12:06] for another rule. One allegation, compliance with values, rules and general orders. General order 240 in car cameras, body worn cameras and personal recording devices did not activate his body. Worn camera in a timely manner. The panel recommended that this allegation be sustained with verbal counseling, and the department agreed and sustained the allegation with instructions that the officer receive verbal counseling for the rule. 4. Allegation, respect for others spoke unprofessionally to the complainant. The panel recommended that this allegation be not sustained, and the Department agreed for Officer Two's rule one allegation report writing failed to complete a report for complainants, damaged windshield. the panel and department agreed that this allegation should be administratively closed. Officer three's allegation of rule, one customer service values was dismissive towards complaint.

[13:02] Both the panel and the department identified this as a not sustained allegation. and Sergeant One had an allegation of violating general order. 120 professional standards, unit and supervisor investigations did not document complaint in accordance with general order 124. The panel recommended this allegation be sustained with verbal counseling, and that was the department's final determination. Also. The panel further commented that This incident provides another example. When the training Bpd officers receive does not seem in alignment with the officer's behavior. The panel members noted that officers are trained to demonstrate patience and de-escalation. But there that there were many avenues for improvement during these interactions. for case mi. 2,024, 0 3 5 officers responded to a mental health crisis that resulted in an m. 1 hold of the complainant while waiting for an ambulance officer. One replied to the complainant.

[14:06] you don't need an attorney. Bro. When the complainant objected to be calling Bro. Officer, one responded, Okay, Bro. Bro. Dude, sir, I use euphemisms for everyone. Okay. The allegation for officer one. A rule. 4. Respect for others referred to complainant as Bro. After he objected that Bro was unprofessional. The monitor recommended this allegation be sustained with verbal counseling, and the Department agreed with that recommendation. MI. 2, 0 2, 4, dash 0 6, 1 in July, officer. One responded to a call that a dog was left alone in an unshaded car in a shopping plaza. For at least 20 min, Officer, one tried to obtain contact information based on the vehicle registration. When the complainant approached her. about 30 min later. Officer one issued the complainant a summons for improper care of a dog. The complainant alleged that officer, one was a liar, and harassed and intimidated her. The complainant did not respond to attempts to learn what alleged lies were made by Officer one.

[15:10] The allegation against officer, one rule 4. Respect for other harassing and or intimidating towards complainant. The Monitor recommended this allegation be unfounded in accordance with general order 121. Section 8. But did recommend verbal coaching, and the Department agreed with that recommendation. Mi. 2, 0, 2, 4, 0 7 0. An anonymous complainant left a voicemail to report that a Bpd vehicle ran a stoplight. The complainant did not provide information about the reported date, time, or location of the incident, and did not respond to further attempts to contact him. For this information against the unknown officer rule 2. Conformance with laws. Boulder Revised Code 7, 4, 3. Obedience to red signal required failed to stop at a red light. I recommended that this case be closed, employee unidentified, and the Department agreed with that recommendation.

[16:08] Mi. 2, 0, 2, 4, 0 7, 2, officer one responded to a trespassing call and interacted with complainant outside of the business complainant alleged that officer. One threw him to the ground, body worn camera established, the complainant voluntarily, sat on the ground independent of instruction, and was not thrown to the ground. the allegation against officer one or rule 6. Use of force through complainant to the ground. The Monitor recommended that this allegation be unfounded in accordance with general order 121, section 8, and the department agreed. Mi. 2, 0, 2, 4, 0 7, 4 officers responded to a call for trespassing from Security Guards at a shopping plaza. Upon arriving at the scene, Security officers identified the complainant as the man who disobeyed establishment rules would not cooperate, and then refused to leave the property officer. One issued the complainant a trespassing summons, and called a sergeant, as requested by the complainant. The complainant alleged that he was racially profiled.

[17:09] The allegations against Officer one rule, one compliance with values, rules, and general orders. General order 1 0, 1. Unbiased policing profiled complainant on the basis of race. The Monitor recommended that this allegation be unfounded in accordance with general Order 121, section 8, and the Department agreed regarding the second allegation, a rule, 5. Police authority and public trust cited complainant for trespassing the Monitor recommended that this allegation be exonerated in accordance with general Order 121, section 8, and the Department also agreed. MI. 2, 0 2, 4, 0 7, 5 officers responded to the complainants call that he was being harassed by security. Upon arrival officers spoke with multiple parties, including the complainants, security officer and witnesses. While officers were present. The complainant told the Security Officer. I'm going to fuck you up. The complainant received and pled guilty to the summons for threatening bodily harm.

[18:10] Psu alerted the Cert team who reported they were already aware of the complainant for the allegation rule one. Allegation against officer, one general order, 203. Investigative responsibility and case assignments failed to conduct a sufficient investigation. Monitor recommended that this be unfounded in accordance with General Order 121, section 8, and the Department agreed for the rule. 5. Allegation issued a summons to the complainant. The Monitor recommended this also be exonerated, and the Department agreed with that recommendation. Officer 2 had the same allegations that were recommended, unfounded and exonerated by the Monitor and the Department agreed.

[19:01] looking at some of our case statistics for November 2024 3 cases were classified by the monitor, one, a misconduct investigation, one a serious misconduct investigation. one community inquiry. There were 0 community feedback or conflict facilitation process recommendations. The Monitor observed. 2 interviews had 0 responses to a critical incident scene and deemed one investigation thorough and complete. The Boulder police department closed 9 cases in November. Regarding the open docket that we have as of December 4, th there were 49 cases that were open. Of those 27 are classic are classified. 10 are pending monitor classification, and 12 of them were in Psu preliminary investigation status

[20:05] regarding our our open cases for 2024, all cases that were classified in q. 1 and Q. 2 are either closed now, or they're being prepared for panel review and all quarter. 3 cases are either finalizing interviews, or have been deemed thorough and complete, and are in chain of command. Review regarding the December 17, th 2,023 face fatal officer involved shooting. My understanding is this, file is still in the process of being prepared for panel review. The sergeant who is in charge of that file was on vacation for 2 months or 2 weeks in November, so I was not able to get an update

[21:00] and some community engagement that has been worked on by the Monitor is, I shared some training opportunities that I took training opportunities along with some of the boulder community connection connectors to get to know some of them on a more personal level, which I think will be helpful for the panel's outreach to different communities. I also attended a right relationships, training with native peoples, and had extensive conversations with different elements of Cu regarding posting and sharing out of the recruitment for student panel openings. Does anyone have any questions? Oh, let's see, I think I see that Chico has his hand. Yes, I yes, I do. And

[22:00] I can't remember exactly whether it was at last meetings During last meeting last month's meeting, or one of the panel review cases where we talked about we needed to get more color or more clarification from the police chief regarding how verbo cancelling gets. or whether Weber counseling is considered or impacts the performance review process or is considered during the performance review process of the various offices. The reason is that we keep seeing several recommendations around this space of verbo cancelling, this verbal canceling, that. So the question now is, how is this impacting the performance review, so that maybe in a way, it acts as a deterrent. Because if that's not impacting, if that's not being considered.

[23:07] then we could have a problem. So this is one of the questions that I, hopefully the police chief. should be able to answer during when we have our meeting with him on this on the 16.th So the second aspect to this is, are we getting, are we tracking these verbal canceling? Because I we case by case we keep seeing verbal canceling, this verbal canceling, that. Sure, and those are. Those are good questions. And I definitely put your the 1st question about how some of these verbal coachings and other discipline recommendations impact officers during their their promotion and raises. I put that on the list of potential topics to have

[24:00] the chief address next in next week's meeting. So if you look at that document, you can see a few things that have come up from case reviews that I thought would be possible topics to discuss and regarding tracking. That is something that definitely we are doing a better job of it now, and the they are. The department is in process of finalizing some changes to general Order 120, and making sure that the Axon case standards, which is the case management system that we use will be tracking those recommendations so that we'll have a better understanding of which officers have received verbal coaching when it is something that is recommended. either verbal counseling or verbal coaching. That is something that we can see on the officers history when it's recommended by through the disciplinary process. So that's something we currently can see.

[25:02] Just a quick note. Selena, Ab is in the in the attendee group. Thank you. Okay, I have a quick question. is it standard that it will take a year for the panel to review a critical incident case. I that's new with the ordinance. So I don't think I mean currently that there's only one case, and that is the situation. Yeah, I don't. I'm guessing if if on your experience somewhere else. is this common that it will take a whole year to review a case like that. On. I would actually just say that some of those cases can be so complicated and have very involved criminal and civil lawsuits that it can actually be very or quite variable. I

[26:09] would hope that this is not the standard, though that will that we move forward forward with in boulder. Maybe that's also something we can add for are December meeting with the chief. Next week. Next week. Yeah. Okay, so. I'm sorry. I thought I saw another hand up somewhere. With me, but I think you answered the I just wanted to tell Chico that we've asked for that like about a year ago. And then Lester was said that He was. Gonna look into it, how to keep track of the counseling and all of that that and so I think that's very pertinent. And since you said that, that's 1 of the questions, Sherry. That's why I lowered my hand, because I think it's a very pertinent question, for it's about time that we know what the progress is.

So the 1st one here is meeting with the chief on December 16th that I understand we are having it virtual. Thank you so much. It's helpful. Any question comments around that. Please raise your hand. Boards and commissions training, which initially, I've been told, was going to open up on December 9.th isn't, except instead going to open up next week. Everything seems in place for the application. We've already received.

[28:16] I think it's 10, or maybe 11 people who've expressed preliminary interest, which last year we had 6 people, 6 students in total. So I'm pretty pleased so far with that. And if you know, people who would meet the requirements of attending an institution of higher learning and living in Boulder, or attending that institution in Boulder, who, you think would be a good candidate for the panel. Please please share that out. I will definitely be sending the live link to panel members once once that actually activates on the 16th but I'm really, I'm really excited about that. I have not finalized what the

[29:03] actual like vetting and interviewing process will look for. But if anyone is interested in helping out with that, we will probably be looking for one or 2 panel members to join in with interviews which would be taking place in mid February. And along with that I don't. I don't know if any of you saw this. I sent it out shortly before the meeting started. Just a placeholder for a full day of training on March first, st which is going to really be geared towards the new panel members. But when I've looked when I since learned more about training that had been done in the past, it looked like panel members did some training which makes sense because. You do the work, so we also will probably be looking for some assistance in not only developing what training would be appropriate, but seeing if any of you want to to step up and actually do the training and also

[30:01] I learned that on January 14th there is going to be a meet and greet for all of the boards and commissions and the panel at Penfield Tate in the afternoon, and I sent a calendar. Invite to all of you. I would really love to have, you know. at least one ideally 2 or 3 panel members, possibly a current student panel member. But those are. There's there's a lot between now and then. But I did want people to be aware of some of those dates so they could keep them open on their calendar. Okay, thank you, Milan. You have your hand up. Yeah, I just wanted to say that. I just this last Saturday with search, we had a a film, our last film of the year with conversations, and we I. I did make a call there for students, because there were quite a few young younger people on some a couple of them weren't interested, and another one said that she has broadcasted it to an organization in boulder of young people who are doing climate actions. And so

[31:11] hopefully, we'll have more students. Thank you so much. That's great. Yeah, it was easy, but it was interesting. Is that actually, they looked really interested. So that was, that was the good part. I realized, as I was thinking about this, how fortunate we were with our student panel members and given how they both really stepped up this past year, and, you know, took on. I don't think they did the bare minimum in any way, shape or form. So, Abigail, you and Luna. We we we really hit the jackpot, and I hope we can do it again. I'm I'm not joking. I'm very serious about that. So I really appreciate the work that you've done. And

[32:03] yeah, just very, very grateful and admiring. This is the time when we need like love emojis all over. Thanks. Y'all, law students are chronic procrastinators. So once the link goes, live in January, I'm gonna be pushing it out to lots of the offending organizations at the Law School. Once the link goes, live next week until the end of January. Well, yes, once the link goes live, and then after finals, then it'll be a time. And then a reminder at the beginning of the next semester. Yeah, they're a tricky bunch. You gotta get them primed. Know nothing about that. Okay, next in our agenda planning for 2025. That's so open. It was me, what? Yeah, of course.

[33:00] Yeah, no, we don't have. I don't have a plan for 2025, so I do have the intention of planting the seed in all of us, so we can come back in January with kind of having thought about. What do we want to do? What do we want our priorities to be in in 2025. I'm sure. There, there are things that we need to kind of figure out. We will have to choose another tier that can go to with me. So if you're interested also I wanna open it up. I mean, we don't have a way of choosing a a specific way of choosing our co-chair. So if anyone's getting creative, I welcome those ideas. and also really thinking about when we think about those priorities, we, we do have the opportunity to create those ad hoc committees. So if there's anything that we want to kind of focus our attention on, maybe in the beginning of the year and the 1st quarter, and we can

[34:12] together. We can kind of dry a road, draw a roadmap for 2025. That would be great. I do think that we have some data interest and questions that we might want to kind of fine tune. So if we can. I guess the invitation is to come. Prepare in January to talk about that and and get creative and and put things into writing. So we transform ideas into plans. Okay, thoughts, comments. Jason. Okay, so this whole de-escalation thing I have been. I worked on a little while ago for a case, and I I at 1 point sent out to the emails. A variety of things that could be read if but I know it's a huge thing.

[35:09] And while I can't commit. I plan on combing through all of that, and trying to make a presentation to this group that, along with source materials that would explain where de-escalation came from. How it's used in certain areas and its results, and what its basic ideas are. My, I think that that this is a maybe too thin of a of of of the description. But I have a recollection of us in a use of force class, basically saying where the officer said something like the best way to de-escalate a situation is to put somebody in custody.

[36:06] And I I think that misses the point of de-escalation. So I but this is a big topic, and and and it takes some some effort, and I've already put some in and and so I'll try to get that. That's my goal for at at least the 1st quarter of next year. and and then maybe from that we can talk to the chief a little bit more. But we need to have the knowledge in order to ask the questions appropriately. So that's that is my goal. I don't know if anybody else has a goal, but that's that's 1 i've been thinking of. Thank you. Yeah, thank you, Jason, so much. And and I also think, kind of aligning expectations right? Like, what? What is the escalation for me? Is totally not what de-escalation means for police. So

[37:00] And I think we need to bridge that gap. The the understanding of what the escalation is in this world or in my work of victim services is very different than the escalating for for Pd. So that is very much appreciated. Thank you. Alan. I presume there's a plan that was written up for 2024, and or is that available for us to for I guess myself. I haven't seen it to look at. And maybe there's some tweaking or some updating that can be done on that, and as opposed to starting from scratch. To be honest, I don't think we had a plan like the biggest plan was really to finish the bylaws so we could operate in accordance to the new ordinance. So I think that this is

[38:00] kind of the 1st time that we're in a position that we can plan for the next year, and we're not in in in a situation that we need to be solving a lot. So so this is new for all of us. Well, in which case, in which case I would just guess. It may be I'm not sure how things work in the city and City administration. But maybe there's someone on staff who can maybe not just on our stuff, but on some some office in the city manager's office could provide us some assistance, or provide us some guidance. As far as you know. What a you know, we're not a huge organization, but you know what are some things we could do to plug into a planning process. What are some things we can look for, you know, basic definitions of goals, and then objectives under those, and and not to get too organized, but at least have some framework to

[39:00] plug, some things in like, where would, where do we plug in escalation? And where do we plug in whatever topics we might have. Yeah, thank you. Take a note. Thank you so much. Milan. Yeah, I was lucky enough to be at a conference where Anna Sylvia was presenting recently and with to I forget their last name. But I was very impressed by what they were talking about. They were talking about equity and data. And since we've been talking a lot about data. I was? I asked. I told Anna Sylvia that the panel needs to hear it, and so she offered to maybe do a training for data and equity and for the specifically for the panel. So I'd like to. Invite her To do so, and I'm happy to take the lead on that if it's needed, or whatever but I think it would be great for us to have a better understanding.

[40:11] of what? What they were talking about, because it's citywide. And and so it it also is important for what we do. Milan, do you care sharing who Anna Sylvia is? Oh, I know Sylvia is a oh, I don't know what her role exactly is, but she works very closely with Amy Kane in the in the what is it? The equity office of the for the city of Boulder? And she's an amazing trainer and a really bright person that every time I listen to her she's really expands my my mind and my knowledge. And so I would really recommend that she come and talk to us.

[41:02] She had presented in conferences like national conferences, right. Yeah, yeah, there was a national Conference. I was like 4 or 5,000 people there, people of color mostly, but also she trains the. I believe she trains the police department and the different departments of the city around equity.
