[8:12] and with that we'll kick off this evening's meeting with our land acknowledgment we acknowledged the Arapaho Yute and Cheyenne tribes, the traditional custodians of the land on which the police oversight Panel and Boulder police department operate and pay our respects to their elders, past and present. I wanna welcome everyone to this evening's meeting including members of the public. Thank you for being here members of the panel by our group city staff. Farrah, thank you all for being here as well. I know this has been a particularly busy week for many of us as we interview Ipm Ipm monitors the new Independent Monitor for the city. And I I really appreciate panelists and city staff consultants all all the work that's gone into that. And then, being present at today's

I'm going to read through our agenda for this evening. So at the top of Agenda, we're gonna welcome Lizzie, friend and A. B. Barlow. Our new panelists will also approve our June fourteenth, 2,023 min.

[10:00] We'll get a status report on the hiring of a new Independent Monitor. We'll get a our consultants, update on the police oversight panel ordinance work particularly the post oversight ordinance work group. Then we'll get Updates from any subcommittees that might have them. in particular, the community engagement, some subcommittee on our recent community outreach event. Then we'll get the end up the Interim Independent Police Monitor Update. which will include the IP and Monthly report and their site visit this week, and then we'll open up this meeting for public comment so to kick us off. Welcome, Lizzie and A. B. It's a pleasure to have you all on the panel and maybe to kick us off. We I I'd love to give you both just a minute to introduce yourselves to the panel and to the public to to tell us a bit about yourselves. And what brings you to police oversight work? And so I'm gonna go, Lizzy, you're you're right to my left. So I'm going to kick it to you first.

[11:03] Great! Thank you, Daniel. Hi, everyone! I am so honored and excited to be here joining you all a little bit about me. I currently work at my day job. I work for the city of county of Denver again into section of the Denver Department of Public health and environment. I work with our data, analytics, teams, our epidemiology and chemical disease teams. but I also have experience working for the Denver Sheriff department and with the broader department of safety. So That experience is what brought me here, and I'm I'm really excited to continue that work with you all and I'll just say to, I know you know it's been a very tough time for the panel, and I've been you know, watching from the sidelines is alternate. I've been so impressed by how you all have navigated this and I'm really just looking forward to joining you all and doing some great work together. So thank you for having me. Thanks, Lizzie. A. B. [12:04] Hi! On the spot. Right? But I echo everything that Lizzie says has was saying. I'm happy to be here, and have been watching everything that's been going on, and eager to be a part of what we're creating here. which oversight is important in my regular world. I am. I'm a coach, you know, a life coach. I'm also a ceramicist, and I live here in North Boulder. Nice and short and sweet. Thanks. I'd also like to acknowledge since. since it happened this week since we prepared this agenda that Sam has resigned from the panel, and I wanna acknowledge that also publicly to thank him for his service. He He had to resign for personal reasons. and had a really good conversation with him. And and I'm hopeful there will be opportunities for same to still participate and work with us, particularly through the legacy committee. when it comes to filling Sam's seat there.

[13:10] I don't know how many times we've said this in the last 3 years. there's a bit of a We lack guidance from the ordinance on how to do this, because Sam was one of our student seats on the panel. and so and and none of our alternates are currently designated as students. And so we're looking to legal guidance on how to how to proceed with filling Sam. See? while also. Thank you, Farrah. Thank you. Solidar. Thank you, Hadasa. We're addressing this issue with the ordinance updates. And so more news to come. We're we're right in the the fresh thick of it. But I wanted to make sure you all knew that. as we as we work forward. Of course, that doesn't impact our our quorum. we, we need to maintain a quorum to continue conducting our business, and to eventually resume full business as a panel. but we do want to get it addressed as soon as we can, and and be able to make that information available to the public as well.

[14:06] With that, though I did want to just check if anyone had any questions. for the new panelists, any questions. for for me, or Hadassa, or or city staff about Sam's departure. Any any questions in this area before we move on. Hello, who's that? Yeah. I just want to say that you'll be receiving emails from me. because Sam is on 3 separate panels. Who the the case reviews have already been scheduled, and he was the third panelist, and he was also assigned to 2 other cases. for that that the case reviews have not yet been scheduled for. So I'm going to be looking for volunteers to fill in. these 3 case reviews are scheduled in early August.

[15:01] and I would appreciate your cooperation. I'll try to give you a heads up on how much work each would take. Thanks. Flow. Yeah, and that's and that's just to as a reminder for folks. We related to our work stoppage. We did vote as a panel to pause, taking on new cases as a panel until we've sorted out the issues with the ordinance and and and got those fix and and just kind of re-secured our position, but we did with that vote confirmed that we were gonna follow through on reviewing any cases that the panel had already voted to approve. So we weren't gonna back out of that commitment and it I wanna just acknowledge how important it is with our case reviews that we complete them in a timely manner. And so yes, when flows, emails go out. If if you can participate in those cart for those case reviews. please respond as soon as you can to flow so that we can keep those that process going. for everyone involved in those cases. they deserve closure, and we want to make sure.

[16:04] we want to make sure we follow through on that commitment any other thoughts, comments, concerns. In that case we'll move on to approval of the June minutes. But my computer is being wonky. So yes, the Independent Monitor. We narrowed it down to 3 candidates. Most some of you were present last night for the in person community reception and Forum and Daniel and Hadassa. Thank you so much for your participation today. with the interview process. We had 4 different panels. interviewing all 3 candidates had some great feedback, and now it's in the hands of our city manager to analyze all the feedback from all the stakeholders, and then we'll see where she wants to move forward, and that we do hope to hire the position quickly. I think that's We're really fortunate that the candidates were very qualified. And So we're just waiting to hear

[18:19] last night for those of you who were able to attend last night's session online, you were given QR. Codes on the website, feel free to hop on there and provide your feedback. for that. I'm not a technical who is or genius. And so she was very patient, very tolerant their understanding, and always kind, and I really, really, really appreciate it. Then I'm going to hand it over to Farrah for an update on our police oversight panel ordinance work. Hi, everyone good to see you. It feels like I haven't seen some of you in a while. far, I must get in consultant for the city of Boulder. So I just want to give you a brief update. I'm first. I want to. just congratulate everybody. I felt like the community engagement event went really, really? Well. I'm submitting that memo to the city manager on Friday. I didn't want to submit the memo before the end of the be heard. Older timeframe. I wanted to wait till that was up, and then include. and that feedback in the memo and just to give you high level I'll share. I'll share the the the memoir. Probably. Actually, we'll give you a condensed summary of the memo. But essentially it was. The feedback was just about trust. They're just a lack of trust in every direction, community to panel panel. You know what I mean with the police department of police part, and so finding a way to kind of reset and rebuild that trust.

[22:25] Obviously lots of comments about the selection process and the the perceived bias language is currently in there. it. It was pretty clear to me, as a you know, practitioner, that there's a lot of confusion about the panel, and it's scope and what it does and what it cannot do. And so there's a misalignment of expectations. And I think that causes some tension. because what the panel can do is different than what the perception is. And so from a basic understanding level.

[23:06] there just needs to be just more more around that of really being clear about what the panel does, and communicating that not just once, but like consistently like all the time. because some of the issues that came up in the session. we're we're helpful. But it was clear. It came from a point of not really understanding what the panel does and what it scope is. And so there were others other. I think you guys have heard this is feedback has been pretty consistent about having a independent counsel for the for the panel. looking at disciplinary decisions. and really just figuring out how to bring confidence in the selection process. I think if if I were to pick like one consistent thing that was talked about, both on be heard Boulder and at the in-person session. It was probably around the selection process, and People not feeling comfortable about about it, and it's

[24:15] it's impacting the confidence in the panel as a whole. And so I think we have an opportunity to write that ship. This is my not so eloquent segue into the police oversight work group, and I love it. But I'm kind of a nerd in that way, because the way I'm facilitating it is that we have topics. We cover every meeting, and we have conversations. And I can tell you, and I hope that had us, and so that will jump in They've they've been spirited right? And so I've disagreed with some people. So you people disagree with each other, but in the end everything gets written down, and I summarize it for the work. And you know, draft some things, and I'll be very frank with you guys. Sometimes I get the draft right and sometimes I get the draft wrong, but we go back and we review it and we talk it through. And so

[25:05] so we've had 4 meetings so far. we do have representation from the Naacp. We do have representation. I was happy that since your Amazon, you know, had a change of heart, and they've joined, and I can tell you they, their first meeting with the Naacp representative in the Central homicide representative was last Thursday and they were not shy. They jumped in in the conversation and in the input that they gave was great like it was awesome, their perspective that they bought the tape, particularly about the student issue that came up at our meeting last Thursday, and so Some ideas were brought up, and I have to kind of tweak tweaks, some ideas with the language. But we are 100% going to address that that issue. in in in the proposed in the proposed draft. so we are getting there. pretty well. I mean, that's obviously that's my perspective. But I hope so. The dad and Hadassa will jump into I'm my task right now is essentially what's the good analogy? How I can put this so it's like a puzzle. And so

[26:16] each meeting we take a piece, and then I'm putting the pieces of the puzzle together, and we read it as it go along. So the pieces that we've discussed so far, I'm putting them together in kind of like a working draft. And the work group is gonna go over that and then we're gonna keep plugging away and continue adding to it until we get kind of the whole puzzle and so but we will have a working draft by next week. However, it doesn't have, like the most, you know, prominent topic. We haven't touched the selection process yet. we're we'll be talking about the selection process for the first time on the eighteenth. so I think that's gonna be important. And that's gonna take more than one meeting. We meet once a week for 2 h. And we've been pretty consistent about that and One thing I should let the panel know is that I'll be doing a briefing to counsel

[27:10] of kind of the progress so far. On July 20, seventh. Just kind of where we kind of. I think I'm gonna bring it back from March, February March to where we are now and where we're going, and the work group is scheduled to kind of assess where we are. at the end of this month. So be first week of August. I believe it's our August first or second meeting. but I feel confident I think it depends on how our selection process and other topics that we have to talk about how that go, but I do think that we can have something ready. to go to council in October. and I think if I'm looking at the timing our community engagement for a potential job will probably be more so. End of August, the beginning of September. but I'll I'll know more after next week. ended up, we primarily, you know, to just get feedback.

[28:02] So that's that's kind of where we are in a quick, quick nutshell. But I do want to express that we are making very good progress. The conversations have been very thoughtful, very open, very candid. and I really appreciate the perspectives that have been brought to the table. I do want to express my sincere appreciation for Madeleine, because she worked with me really hard, almost weekly, daily, for the Naacp rep. I don't know when she sleeps, because I have text messages at 1 30 in the morning. So just making sure that we had. you know the right person, or a person from the Naacp. So that voice is at the table, too, and we have a great person who has, you know, jumped in, and so that wouldn't have happened without Madeleine's persistence, because obviously I don't have the connection. That was Madeleine's connection and her persistence to get it. She got one person approved in like 3 h. So so I really appreciate Madeline for that, because we were missing that voice at the table.

[29:10] but I'm happy to answer any questions, and I hate to put Hadass, and so that on the spot. But, like I just gave you the consultant perspective. And so I think it would be good for you to have the participant perspective. You know as well, so sorry that I'm doing that. But I I really think your voice is probably more important than mine on on this issue. It was like. Okay, yeah, I mean, I I I think I I agree in terms of like the conversations we've had. Haven't always been the easiest right like, and and ease by easy, I mean, like, we're not all necessarily coming. We're not all on the same page. Initially, when we start the conversation. you know, we have different perspectives of how we think oversight should be done specifically in the city of Boulder and so sometimes that can get a little spicy. And I I do feel like we've had very productive conversations in terms of like

[30:19] we can, we can find a way from all of these different perspective, something that hopefully I'm I'm very hopeful that we will find something that will work for all parties involved in the so you know, I think that's that's what we want in the end. So yeah, I I feel that's great about it. so in my perspective, the thing that I want to share with you all basically is that the meeting amazingly productive. The sia has done an amazing job at keeping us on track on time. So it really feels like a very valuable use of our time. It's a lot of time. It's very valuable use of it. We receive email from power preparing for the meeting, and then we receive meet emails with information afterwards. So it's it has been

[31:18] very intense in, in, in, in terms of the amount of work. but I think we we're we're. It's just very productive. And The other thing is that we are. since, as far as taking notes, we we see the progress. and we can see where we where we start at at any given point, and where we are finishing that point of the conversation. and I think that that has been really helpful, because there's not a lot of kind of tangling in in in conversations that you know, we can get, you know, very inspired. on, and then keeping it real, keeping it grounded. And this is what we're here to do. So I think I really really appreciate that I would appreciate the work you're putting on it. far, and how you're facilitating the conversation.

[32:13] and you know, and it's and it's what you say. I think that will also in a process of aligning expectation. So Even for the panel, you know, it's like Whoa, we should do this. I don't know. Maybe that's what we do, you know. So I think really keeping it real, keeping it grounded and keeping it very productive, and and it seems like a very good use of the time that we are putting into. I well, sorry, Daniel, it's the only thing I was going to add is that I wanted to wait because I did promise you guys updates. And so it's not that I forgot about that. It's just that I wanted to wait until we had some more substance. So I think, after our meeting on the eighteenth as we go through kind of the the the working draft that we're creating. I'll be able to bring in, you know, the panel members and send a more substantive update, because, like for me to send you an update. And being like we discussed the purpose. You know what I mean like that just doesn't make sense. So we will have a little bit more meet after our next meeting. on July eighteenth, and then I'll be able to kind of share with the panel a little bit more. So

[33:23] so so that's why I haven't shared yet, because we haven't really gotten there yet. So that's it. There, now for me. Thanks, Sparrow panelists. So Sam was chair of the legacy committee and and and had to express hopeful. At some point in the future he might continue to work with the legacy committee. this is a reminder, you know. We've talked as a panel many times before of how community involvement might like work through our committees. but what that means is that the legacy committee does not have a chair at this time.

[35:16] thank you, Chico. There it is, and we still have a chance. Chicago. They're not going to be just. Hand it over to you. Do you have any updates with the legacy committee? No, great, oh, fantastic! That's actually a huge really like, I said. We are. We are right in the midst of of getting through this. So thank you. Chico. he also do. We have any updates on government governance? No, we didn't have a meeting this last month. because right now, mostly, we're just focused on coordinates stuff. So thanks. And and as a reminder, Hadas and I are currently the only official members of the Governance Committee, and for that reason we have not elected a a chair of the committee because we we do not feel it's appropriate for the co-chairs to also chair a committee. but given the current work stoppage, we're just holding work in the governance committee until we get to back back to work on general general panel business

[36:17] with that communicate community engagement subcommittee. I'll hand it all over to you all from an update. One quick thing. because we have new panelists. Do we want to give people the opportunity to kind of just give a quick what our committees do for the new panel so they can consider. Yeah, so do you want to pitch legacy first back by and large, the legacy committee looks at historical events that have happened, and we try to see whether we can have common scenes that will help.

[37:01] Oh. he, the work of police oversight. So bad luck in a nutshell. It's looking at historical trends cost events you want. You want to pitch governance. sure, yeah. governance is, mostly mostly focused on specifically the bylaws, because that is what we as the panel, have control over And so any updates that we would like to see to the bylaws. We kind of put them together and then bring them to the panel for a vote to officially vote in the any updates? we hope to in the future. also sort of help facilitate some of the process, for, like any future potential ordinance amendments that we would like to propose that. Have that be sort of the part of the panel that can help sort of contribute to that work in the future.

[38:03] Awesome, thanks to Dasa community Engagement and Communications Committee. You want to go next, give us an update and a pitch for your community. Sure. So we create opportunities for the people of boulder police officers. anyone who wants to know about what the panel is, what we do. currently we're supporting the work of the ordinance. So, Ferry, I mentioned the draft. So when that draft comes we will have another event. And that's currently what we're doing. right now. since this panel has been created, we've only had one event, and now we've had our second events. which was highly successful. We we doubled our attendance. So we had 11 people at the first one. We had 22. So that is fantastic. I want to take this opportunity to really thank Milan for all her work. on the flyer and doing meetings with me. So You know, I just thank you so much for your assistance.

[39:04] as we've seen before. When we rely on the city to do things, it's not necessarily the best thing right, but also it was very helpful for them to just say, choose a date, choose a time, get that all set up. But when they showed us the flyer we were like, no way. Are we going to send this out. It was something with like lights and sirens, and it was just very, almost triggering. So again, thanks to me long for you know, really reproducing that Getting the media involved was also a success. We hadn't had that before, so I think all 3 of us got on camera at at 1 point or another, and I didn't expect the the cameras to show up at our physical meeting. So when the camera walked in and about 30 min into the thing. It was just like. Okay, this is good. we did miss our target audience, which was the Spanish speaking audience. you know, outside of some family members who really didn't have that community represented in that audience of all. So we definitely missed that mark. And that's something that we have to continue to strive.

[40:06] how do we incorporate this other audience and get that message out? It was also interesting how people didn't stay on topic. And so some of that descent about trust was really just some rabble rousing that was not productive. and I noticed 4 members of a particular group walked in at all at the same time, and they all got up and left at the same time. So they were part of this other coalition that brought in some noise. That was just what we want. And when we come to the draft meeting we're really going to be focused on draft. So that's something we have to really tweak about our messaging. We're gonna have this next meeting to really get a community input on the things that we want to change in the ordinance and their opinions on that. I also want to thank, so that as well and anyone who is on stage and being uncomfortable in that moment.

[41:01] Daniel has a theater presence, but for most of us it was just like so Milan, or solidar. or anything you'd like to add. I actually, I'm wondering, do we have a timeframe for the next meeting? And how could we prepare for it? I'm going to be gone for the next couple of weeks. So I just wanna kind of start thinking about it if if that's necessary. Maybe that's a question for me. I don't know no question for me. I think you're talking about the the, the work, the work group, right? And so what I like. when are you? Gonna when do we need to aim for a meeting with the community and for the first draft? I guess that's what I had mentioned. Was, I was thinking, the end of August early September. But I won't know until definitely after next week, and definitely after our conversations about The Selection Committee and some of the other meteor stuff we haven't gotten to so

[42:17] but it it'll definitely be no later than the end of August. So But I'll have. I'll definitely I'll have a better idea in the next couple of weeks. It's just hard to predict, because you don't know how the conversations are gonna go and how much time we're gonna really need to flush things out. But I but you know I'm going to do the best I can to the extent you know I can to, you know. Get us to get us to that to another community event, and then get us to Council by October in October. so I guess we have that amount of time approximate amount of time to reach out to the communities. They were not represented during our last meeting.

[43:04] Yeah, I think so. And to be quite frank with you, like, I've done these events so many times like it's the second time around. Obviously, we learned a lot like this time of doing this, and so I think it it just it naturally gets easier the more you do it. So I I imagine. the amount of work that was done for this one. I don't know if we'll need it at the same level. But we'll have. We'll have enough time to do the community outreach, for sure, because I'll I'll have an idea in the next 2 weeks, for sure I just want to. say that it's important for us before scheduling to look at the calendar and the activities happening in Boulder even though with the whole, our attendance. If the day we we picked it was the day where a lot of things were happening, and I think that impacted the attendance in our event. So this really kind of making sure that we're not scheduling something when you know other important things are happening that we're gonna lose audience.

[44:10] I jump in real quick. When when is can we confirm when the next community engagement committee meeting is the first Wednesday of the month. So first Wednesday, what date is it? So that will be August August second, then okay. And so for folks who Lizzie and A. B. Even if you're not an official member of a subcommittee we're all welcome and invited to all committee meetings. And so we're welcome to drop in So in this instance, any panel member that does want to get involved with supporting that event. that's that's the date of the next meeting. and noting, you know, that's August second. So that's that's that's a pretty tight turnaround for the event, too. Yeah.

[45:04] just one note that I noticed that the calendar that we have. It doesn't have all the events because some of them were sent to our personal emails instead of the city email. So if we could resend those calendar invites to our city email, that would be great because I I get lost. Did I have some meeting in my personal email calendar and some other in the serious email account. So if we can just send them all to one place that will be great. especially now that we have new people. So and, Dan, I just want to jump in just to manage expectations. I think, particularly with the community events like, I think there's always a fundamental effort to schedule things that are most convenient for community members for the time after work and all that kind of stuff it. But there's always going to be something happening. And so like when we talked about the date and the community engagement committee, it seemed like an open date. But obviously, after we selected that date, other things were scheduled right that are out of our control. So I mean, we'll do the best that we can. I think everybody, when we have that conversation in the committee? you know, we're mindful of the date and predict, I remember we talked about what day of the week is better. What time is better?

[46:21] But I don't want the panel to feel disappointed if you know the turnout isn't as what's expected, because you just never know what's gonna be scheduled like that political event thing was scheduled after we had selected our day. You know what I mean. So I just, I just don't want you guys to have that as something to as a point of disappointment for you, because, like, there's, it's just so much out of out of our control with that stuff. But you know, we did really make a sincere effort to pick a date and a convenient time for for for community to attend those. Those are both great great points of power. And so with the I of

[47:02] personally struggled because I really want it to be there. and that me land. And I had long in depth conversation and just had to go down and choose that right now. I don't even remember what the other thing was, but I think it probably was the bolder flag raising. I'm not sure, but at any rate. This is one gathering that is critical. It's critical. I mean it. It really stands and speaks to the core of what we're doing. And they are our customers, the the community that's our number one customer. So yeah. I I I don't know you right now for some things out of control, but so possible. I will not let that happen again. That's good. One. [49:00] good evening. I've been running all over the Hotel Meg, Hotel, Colorado, Bulgarado, looking for good Internet. So Teresa Mu Makula, who's here with me tonight is going to share her screen for the Powerpoint. Also here from Oi. Our group is its leader, Mike Tianako. we're serving as the interim Independent Police Monitor. Teresa and I are in Boulder we participated in. We attended the community Forum last night for the with the Ipm finalists, and we participated in different panels today. And I mean, I don't want to speak for Teresa. I think you're but we're both here doing different roll call briefings with the police department and doing ride alongs and met last night the panelists who were at the Community Forum and Hadasa and Daniel were part of the panel today. So think it's been a very productive trip.

[50:11] and even though the Oir groups, tenure may be coming to an end. I think the information that we've leaned will be powerful and help with the transition when a new monitor starts. Theresa, did you want to add anything to that. She might be busy sharing the screen. No, unfortunately, my camera will not also work with screen share. So that's decided. It is one or the other apologies for not being on camera at the moment. yeah, absolutely agree with low. very productive visit. I am very appreciative of your cities

[51:01] hospitality, I mean having us here. I'm really looking forward as well to providing the new monitor with a very robust and to the extent that the mon that we monitor would like us to transition what we have learned, and do a a knowledge transfer with the intention of having the new monitor come in, really be able to hit the ground running. It is critical that the transition happens smoothly. and that the new monitor is able to jump right into to the role at this point. So we have greatly enjoyed our time here. and it's really a pleasure to meet many of you in person be face to face of the opportunity to do so. Of course we did not anticipate that our tenure would be this lengthy, and so in any other circumstances we would have

[52:06] really like to have been on the ground at an earlier date. So now we've made that happen, and we appreciate that opportunity. So thank you for your hospitality and for the work that you've continued to do throughout this time. all right, so Can you move to the first substantive slide which is focused on the panels of oversight work. So yeah, this last month the panel did not meet to conduct a case review. There were a couple that were rescheduled to August. There are no cases that the panel review that are still pending department disposition, but there are still 10 cases awaiting panel review, 5 or scheduled. and 3 of those have to be a little bit repopulated, and 5 are pending, and we'll have to be scheduled.

[53:03] I want to get into some of the case closures that occurred since our last meeting, and I've I've expanded this section a little bit in reviewing the ordinance as part of our work, it occurred to me that the ordinance requires the Monitor to report on all close cases, not just the cases. The panel reviewed so, and I think this is especially important now that the panels. not reviewing new cases so that the panel and the brought public is aware of the oversight work that still goes on on the part of the Monitor. But this first case a case from 2022 the 0 3 9 is the case that the panel reviewed and conducted a case review on, and this involves a case where involves the mother of a man who was murdered in 2,020 The police department arrested the suspect the very next day, and that criminal case is still pending

[54:12] the deceased mother file a complaint on December eighth, 2,022, stating that officer, one didn't conduct an adequate investigation regarding the defendant, the now. the suspect, now defendants motive and didn't provide her with complete and updated information. she expressed this satisfaction with Officer one's former supervisor, who's officer 2 who, she said, did not appropriately respond to her complaints. And in 2021, in May she submitted via the department's website, a contact. The chief email regarding Officer one complained about Officer. One's lack of communication requested that the Department reassigned the case to a different detective and asked me with the chief. And

[55:03] yeah, the mother did not receive a written response from the department. There were a number of allegations. and with respect to Officer one, he's no longer a department employee. He was accused of not conducting an adequate investigation violating the the Department's customer service value by not providing to the mother. A complete and updated information, or meeting with her, is requested officer to the Supervisor was. The allegation was that he did not appropriately respond to the woman's complaints about Officer one. And with respect to Officer 3, the allegation was that the officer 3 did not respond to or fail to ensure that the Department respond to an individual's contact. The chief email regarding the homicide investigation. And I will say that at the insistence of the monitor. This was a bifurcated investigation. The department conducted the investigation regarding the allegations against Officer one and 2 and an outside investigator. Third party investigator

[56:18] conducted the investigation of Officer 3, and the city manager was responsible for the outcome. With respect to Officer 3. With respect to Officer one. The panel recommended that the allegations be exonerated not sustained. The same. Finding that the department made, and the panel recommended, that the allegation against offers to to not be sustained, and that was the outcome that the department reached the panel recommended that the allegation against offer short 3 be found is not sustained, and the city manager reached the same conclusion. However, the panel did make a number of recommendations which both the the department and the city manager agreed with.

[57:07] The panel recommended that in cases involving family members of homicide victims or other serious crimes, the detective unit should establish a Communications plan, provide a point of contact to the family and advise the family. should that point of contact change in this case. While the prosecution was ongoing, the da's office assumed the responsibility for contacting the mother, but that was not communicated to the mother. it. The panel also felt that the unit should document in its case management system. It's communications with family members of homicide victims and victim of other serious crimes. And, as I said, the department and the city manager agreed with that. And can you move to the next slide? Theresa

[58:04] the second? I don't. I don't know. for Internet might not be working. The second panel recommendation was that the department designate one or more individuals to respond to and or coordinate responses to contact the chief emails and establish a database to track to whom contact the chief emails or route it and document within that database. What if any response the Department has provided? And the city manager agreed with that, and the department is promised to implement changes the next. The second case that I want to talk about next slide, please. is Am i. 2,023, 0 1, 5. And again, this is the case that the panel didn't vote it not to re. Oh, actually. the panel did not review, but The Monitor reviewed and deemed it complete.

[59:06] This involved a dispute between a tenant in an apartment complex and the contractors that we're doing in renovations in the apartment above her. And it this the woman, the downstairs tenant, felt that the contractors were violating the and the honor of that apartment were violating the Homeowners Association rules, and however by, she expressed that by allegedly confronting physically the contractors and entering that apartment several calls were made to the police, and on a third day that involved such a type of activity. Officers one through 3 responded to a call about the woman blocking the contractors from going down the stairs and yelling at them.

[60:03] officer! One spoke with the woman, while officers 2 and 3 spoke with the contractor and officer. One told the woman that renovation was not a crime. The Department doesn't enforce The Homeowner Association rules, and she needed to leave the contractor alone. An hour later the contractor called the officer to come back, and said that the woman through stuff inside his van and made comments about his wife, and he now wanted to press charges. The 3 officers returned an officer. One issued the woman a summons for harassment. The woman complained that the officers were young and inexperienced, and that officer one issued the summons based on poor judgment and lies due to ageism and sexism. Well, the officers, youth, alleged youth, and in experience with not is not an allegation of misconduct. The allegations of misconduct involve

[61:01] accusations against officer one of biased policing based on age and gender the chain of command recommended that those allegations be exonerated, and the Monitor agreed with that. I, the monitor. I also recommended that the chief have the department council, the officer, about taking more care and selecting appropriate charge, and consulting with supervisors or legal counsel. If he was unsure of the appropriate charge and at least be able to articulate it. Detail the evidence that supports the specific charge. and this is particularly important on a going forward basis when it comes to proving cases in court, as the officer issues, summons, is and makes custodial rest. The department exonerated their final disposition was exonerated for both allegations, and they they were going to conduct a supervisory review with the officer

[62:00] next slide. And finally, this is case, am I misconduct case 2,023 0 0 2. This involved a. This occurred on New Year's Eve, and a bar restaurant called the police to evict a drunken patron who refused to leave. Police arrived, officers one in 2, and the woman still refused to leave and Eventually they grabbed hold of her and forcibly walked her out of the bar. Once outside, she screened that the officers had abused her and refused to provide identification, preventing them from completing a notice of trespass. The Bar restaurant wanted her to be prohibited from coming back because she refused to provide Id. The officers arrested and handcuffed her officer. One padded her down and Officer 3 removed her cell phone from her left side pants pocket, and she accused Officer 3 of molesting her Although the woman subsequently complained to officer for a sergeant that officers one and 2 had used success, of course.

[63:10] as part of officers for officer for's investigation into the use of force officer for interviewed the officers. so there are a variety of allegations. I. With respect to officers, one and 2 there were used to force allegations with respect to Officer 3. There were allegations about the search, and it constituting unlawful sexual contact. Contact. And with respect to officer. For this is an allegation that when the Monitor classifies the case, the Monitor is free to add allegations, and the Monitor notice that but the the Department conducts an administrative view of every use of force. But if there's a complaint about the use of force, the investigating supervisor is not supposed to conduct interviews of the officers that's supposed to be done through the Psu process. So there was an allegation about that.

[64:08] The chain of basically, the Monitor Monitor agreed with the chain of command recommendations, and the Department dispositions mirror the chain of commands, recommendations, the use of forest allegations were exonerated. the allegations regarding officers. 3. Search were not sustained, and the officer who'd been assigned to conduct the Administrator view of the use of force, that allegation that he improperly in it conducted interviews of the officers that was sustained. And He's receiving verbal counseling. Finally, just some other statistics.

[65:02] During June the Monitor classified 3 cases, 2 of them as misconduct cases one is a community inquiry, the Monitor observed for interviews deemed 5 cases in but 5 department investigations as complete and thorough and overall. During the month the department close for cases. At the end of June the open docket of of the Monitor and the panel stood at 18, and that completes my report. And so for panelists, I want to pause for just a moment and give you the opportunity for any. Follow up comment on these case reviews. And so, as a reminder in accordance with the ordinance, the current ordinance. This is our opportunity to to comment on these cases, and this is our opportunity. to make those official statements so flow, has determined what

[66:00] flow in the O, our group have determined what details of these cases can be released in this to the public, and those are the only details that that we can make available to the public. In accordance with the confidentiality agreement. However, our comments now can include. And and this I'm quoting. The ordinance here can include comments on the handling of the complaint, the fairness and thoroughness of the investigation, and the reasonableness of the adjudication. And so that said, I just want to open the floor panelists any. Any. Follow up comments related to the case. Reviews got it? And any comments or questions for the Monitor or or or group.
