[1:06] hmm okay hello everybody I had to be promoted to uh thank you Taisha thank you for letting us know too um okay so uh uh to kick off the meeting we'll start as we do by reading our land acknowledgment uh we acknowledge the Arapahoe you and Cheyenne tribes the traditional custodians of the land on which the police oversight panel in Boulder Police Department operate and pay our respects to their Elders past and present I want to welcome uh any members of the public in any uh press or media who may be joining us today thank you for taking an interest in our work and being present um and of course I want to welcome panel members uh and I do want to acknowledge at the top of the meeting um that we have received a lot of communications and a lot of advisements in the last week that have made our work extraordinarily challenging for us and I appreciate your patience I
[2:02] appreciate you being here as we figure out how to move forward and proceed with um with the work of the panel I will express to you that Arielle and I are are doing our best but also um uh I'm sorry um greatly affected by what's going on right now um and um and what we've been left with and of course not being able to say more than that I just want to express my appreciation and my love for you all in being here to do this work and pushing through to make this happen um but not to let the elephant in the room lie that we have um we have a lot of work to do and we were owed better than what we have gotten um with that we will move forward um uh
[3:01] uh members of the public if you want more information about the Boulder Police oversight panel our web address is bouldercolorado.gov forward slash Services forward slash police hyphen oversight and our panel email is police oversight panel at bouldercolorado.gov I'm going to read through our agenda for the evening give me just a second it's loading there we go so reading through our agenda for today November 10th we'll start with the approval of the minutes for October 13th we will get a status report on the member application and selection process for the police oversight panel we're going to get a status report for the hiring of the new independent monitor we'll give an update on the transition to new co-chairs we will also have a discussion about
[4:00] posting monthly public meeting agenda and on the website in advance of meetings we have a motion from Arielle on that we'll get our committee reports from Community engagement and Communications committee from the governance committee including a discussion about how to move forward with approving The Guiding principles an update from the Legacy Review Committee and then we'll hand it over for an inter from a report from the interior monitor including a report on monthly case statistics and then we will select uh our cases for full review this month and then we will have public comment at the end thank you so in that case we'll start with approving the minutes panelists did you have the opportunity to review the minutes and do you have any uh um changes that need to be made before we approve them
[5:06] no changes for me there are no changes from anyone else show of hands about to approve the minutes for October 13 2022 hands for the screens majority thank you all minutes are approved I'm going to read out a status report on our uh selection so Sarah and Martha are not with us and actually Amy uh Kane are not with us this evening because they are in interviews right now with potential new panel members um so that's what they're doing and so uh the update the update I got from Martha uh is that they have developed a spreadsheet with various indicators based on the deliberation scores the top 30 or so folks were discussed and 24 or so will be
[6:01] interviewed starting this week uh in about 20 minute interviews notifications and invitations will be sent out to us and so that is the update on selection and a reminder we're still aiming to have our future panelists um identified and in front of city council by December so that they can begin in the new year with that um Arielle do you have the update from yeah great so I'll hand it over to Ariel then for our status report on hiring the new independent monitor great thank you um so this is from Amy uh who had hoped to join but the selection committee meetings are going longer than expected this evening so um in terms of where they are at they are planning on meeting with the city's recruiter on December 9th to get a list of candidates for this position this will be a meeting with Amy the city
[7:03] manager and um the city's chief of operations for HR if um all goes well from that and they get the right amount of candidates they will hold virtual interviews on December 14th and then plan for in-person interviews to take place on January 11th and 12th um if a candidate was from out of town we would um bring them into the city they'd be flown out um and the afternoon evening of the 11th would consist of a community event sort of a mix and mingle with different community members that are identified are invited followed by a pant Community panel including members of the police oversight panel on the 12th the in-person interviews um so that would be January 12th would take
[8:00] place um and that uh Amy has said that she would like two members of the panel to be present on the 12th and so would like to get um calendars kind of from people now in terms of who might be available for that um for the monitor position so and I should just note that Amy made sure to note that all of this is pending having enough candidates as well this is um a very specific position to fill and difficult and it um took some time before and they expected to take some time again so just note that all of these dates are kind of pending making sure they have enough candidates um what any panelists at this time like to volunteer for if in-person interviews happen on January 12th being present I think you muted
[9:00] yes sorry yeah sorry just once I have to potentially okay maybe let me let me double check yes and Hadassah as a maybe yes okay I would be a maybe but if if the dates are not locked in I wouldn't want to commit to anything until those dates are unlocked okay I will let um there you go thank you I'm available January but not the December date okay there you wouldn't be present it's only for okay so yeah um so virtual that's fine um okay okay great thank you um that is all that Amy had on that awesome um so uh update on the transition to new co-chairs just a reminder at our last meeting we discussed this and we'll do that vote in February per our bylaws and that'll also mean that our new panelists will get to select their co-chair uh
[10:02] co-chairs plural um so that'll be good but what I did want to say is just to remind you all um uh if you are thinking about running and to give it some serious thought if you would like to be the new co-chairs um just to think about it and if you uh I think part of it I'll I'll remind you that Arielle and I were encouraged and that was a big um a big um reason why we stepped up into these roles too and so encouraging each other if there's someone you think who would be a particularly good in a co-chair role I encourage you to reach out to them and let them know because that can be a really big motivator for um getting a great leader up into these roles so that's just a reminder there any questions about co-chairs um and of course you can always reach out to Ariel and I too about time commitment that sort of thing um as we go um all right oh I'm going to pass it back to you
[11:00] um for the meeting agenda perfect um okay so this is just a brief motion that I would like to pose um this has not been happening um with protocol as of now and I believe this would make it easier for members of the public and the press to decide if they want to attend one of our meetings so I would motion um that the part of the panel's monthly meeting information being made publicly available includes the public posting of our agenda along with any virtual meeting information which we've already been sharing 24 hours in advance I think I would like to make it a practice that the agenda also goes up 24 hours in advance so do I have a second second okay okay great so that passes thank you um so we will make that practice going forward for the
[12:01] December meeting back to you Daniel thanks uh so next up we'll get into our committee reports and I think I'll hand it over first to uh yeah Victor and Taisha for Community engagement and Communications thank you Daniel um and Victor feel free um coordinate coordinate uh but you know I will I will say a lot of what has transpired over the last week regarding the legal Communications publicly privately Etc has significantly impacted the community engagement and Communications committee as you know we recently passed the plan um which included significant pull-in push out strategies best practices that are leveraged in civilian oversight committees across the country including having Community meetings which we just
[13:00] were able to hold our very first and now being told that we're going to have to wait until after um you know we get some more clarification is is rather challenging especially considering some of the issues that were brought up in the annual report quite frankly that are continuing on and continuing to escalate so so I do want to express my concern around um just the the lack of legal guidance prior to all of these documents were available publicly available for months and now all of a sudden there is this need to um you know create some additional hurdles to ensure the level of transparency that we had all agreed on and that we heard back from community on as well um I will say lifting up the positive it was wonderful to host and thank you to the public library uh the Boulder Public Library for hosting our community event we were able to host I think about six people from the community two of whom were from the University of UC excuse me
[14:01] UC Boulder and their Student Government so again just knowing that we have a student seat and to have that opportunity to speak with them I mean that is a critical recruitment mechanism as well as we're thinking that's a one-year appointment the student seat and so again I want to just lift that up as something that was wonderful to see and I hope is reflected in the candidate pool but those ongoing touch points are really important and you know again we don't get a lot of attendance you know in in these meetings although I'm happy they are recorded um it would be wonderful if the police chief check-ins were also recorded while I'm here on a moment of transparency but back to the former um it really was lovely so Victor and I had some uh conversations in our last meeting about um you know we used a hybrid model um sorry can I cut you off for just one second I just wanted to make clear that our meetings with the police chief are publicly available and so they're not
[15:00] recorded what was that I don't believe they recorded we would have to go back and look you're right I apologize it's my understanding that they're not right because I actually raised this during our conversation with the chief as a pro as an area of concern because those are such Rich conversations um alas but moving on um the other thing that we were and again we were actually planning for our December meetings so um you know we were hoping today to come and talk up with you and get your feedback on you know some of the locations we were thinking and some of the partners we were wanting to work with and and now all of that is is being put on hold and so um you know again looking forward for the clarification but um any any um additional comments Victor on what I've shared thus far no you that was very uh clear and thorough thank you so much oh sorry oh I was just going to mention too with these meetings these recorded meetings I've been talking with Amy about how we can get them posted to the
[16:01] website um they were they're not they're not posted the website yet um we did just get access to them they were um locked in Joey's um uh passed accounts of those meetings um so we're working on getting those posted to the website but no we have not they have not been posted the website and we may need to um we we may need to take a vote on doing that and um just double check with um the city attorneys that we can do that as well um but just just I just wanted to follow up on that that that's something that I'm working on with Amy um however we did uh marinate on looking at other City boards and commission policies Etc um as well as some of the um the bylaws and and and oversight models from other cities like the Bay Area um Transit around just some other transparency mechanisms that we would
[17:00] love for you to consider especially in light of the fact that one of the key mechanisms that we had identified with the community forums is not is not available at the moment um and that is one you know just have a meeting with the city manager letting them know um you know again through the annual reports we have a you know a lot of the things that we are identifying are outside of our current Authority and some of which is in theirs and so really would be helpful um to to have that meeting um also presenting to city council um again letting them know provide an update get some you know I know you all were there the co-chairs were there for the extension the expansion of the of the panel which was very much appreciated as well as the increased pay considering the amount of work at the same time not all the panelists were there and really again having a dialogue um and you know it needs to be public so really wanted to make that recommendation more formally um and also it was my understanding that
[18:00] boards and committees also have components in the city council board book and so I'm wondering if some of our if our reports can be included in their board book um so that they also know on an ongoing basis what's going on and they don't have to wait a year for an annual report so again as we look to continue to increase our transparency and accountability I think it'll be really critical to consider that so I wanted to actually work with Hadassah and the governance committee on setting some policy recommendations or guidance around um those different components and um lastly on the side of communications and again Victor I apologize for not having a chance to chat with you as I was diving into some of that model documentation that we actually use to form our bylaws I came across something that was quite interesting um and that was um evaluations of the police oversight panel and in many places they have a
[19:01] three-year uh every three years they do an evaluation of the effectiveness and efficiencies of the panel and again as we're at the two year mark it's actually a wonderful time to start thinking about what that could mean and what that could look like and starting to get those pieces together as it would require you know a hopeful hopeful that it would include rather you know city council and um you know obviously the police department there are many excellent certified firms who have you know been doing this for a decade in other cities that you know we can certainly leverage their expertise so again would love with to work with the co-chairs and Hadassah through the leg the governance committee um on exploring some some options and opportunities and and seeing what the pathways are for that so again we'd love to open the floor for any comments or feedback on that since that is something that um you know I I've you know kind of been going down a rabbit hole over this last week uh with the different ramifications of different things and so just wanted
[20:00] to lift those up and I know it sounds weird that it's coming from Communications and community outreach but public trust is everything and so communication um and and what the public has access to as well as our public officials uh who have to make the the decisions that that frame and and provide Authority um to this panel thank you honestly I don't think it's weird at all I think all of that sounds amazing and I I mean yeah I say go for it and I think that your committee is is the one to lead it um that's awesome especially the evaluation I think that's a really great idea I also was wondering if we had a subscription to uh Nicole I know that Hadassah and Martha went to the conference but I wasn't sure if they actually if we actually have a membership um some of the resources that I was able to secure was from their website which I thankful thank you for not having to pay off to some of to access some of those materials however um you know some of the workshops and
[21:00] trainings some of which around legal again I think we need to be very mindful about you know who is giving us trainings right um there needs to be a balance right it's important to know um the procedures and things that are happening internally but I think it's also important to have some levels of autonomy considering some of the work that we're doing that also goes for communications which as you know we've been talking and requesting just some considerations around that for quite some time thank you um that we the city of Boulder has a Naco membership um but how we get access to that I I don't know so we'll probably I'm guessing Amy hopefully maybe has some of that information for us so we'll we'll get to that but yeah the answer is yes kind of
[22:05] and it's and obviously you know sooner rather than later because I would also love their um feedback on some of the issues they also can provide consultation and I think that'll be a very critical um as we as we move towards the complexity of what we're trying to do here thank you do you taish do you want to just reach out to Amy or is that something you'd want us no I'm happy to do that I don't think I know Amy but Amy Kane uh Joey's supervisor so she she's the one who's been emailing us yes I've gotten her emails but I've never met her oh I see what you're saying sorry sorry I know you're like Amy I'm like yeah that Amy thank you there are any other feedback or comments for communications I'll hand it over to Hadassah
[23:01] thank you Daniel um Okay so uh for governance um the big thing so we have our guiding principles they've been established I think the the question at this point that we would like to pose for the panel is um whether this is something we would like to do in a retreat Workshop or an in-person Workshop um or if we want to just go ahead and vote in and considering meetings and all the other things um you know most likely what we thought would be a good opportunity is this would be a good time to have you know when we have the first meeting with the new panelists um so we can kind of decide as a group you know kind of as a regrouping in terms of like where we want to go and what we want to do with this panel um just kind of reestablishing that um for us or if we want to
[24:02] go ahead and do it so um I leave it to the panel I guess the question is do people feel comfortable voting now voting guiding principles into place now I think we should wait personally that would I I think it'd be great if we can do it when um Martha and Sarah are here also and then after a few clarifying questions um in the next week or so that we will have the city staff that would be um my gut Trek thanks Aria I would have to agree with that there's just too many unknowns around some of the things that are in there for us to be able to and again it's not one that we're on our heels waiting but you know out of fear but rather um I wouldn't want to do anything that would compromise the Integrity of what we're trying to do in the long run you know what I mean so it's really well put
[25:01] I agree yeah um I think and I think maybe a part of it too is I trust that all of us know understand and contribute to those guiding principles and so I I think they are strong to our heart they're just waiting to make it officially into the bylaws okay thank you we will schedule some time in the upcoming retreat thanks everyone um and then our so our next monthly meeting will be November 16th we do have um some new items that have been proposed for governance for review again the annual review um we're still working on a um training piece however um it was so in the ordinance it says that the training is conducted and a plan put
[26:01] together by the monitor [Laughter] um you know we're we're we're obviously you know ready to and we've been working on getting some resources for training we have the ones that have already been put together by Joey um but again the question is do we how much how much work do we want to put into this when the new monitor comes in they would you know Implement a training program ideally according to the ordinance sorry go ahead yes Taisha I'm Nick um almost going back to recommendations and why I think it's critical to meet with the city manager and others is um again and I am grateful for the training that we received however now that I know that you know it depends on the expertise of the monitor right if
[27:01] they've done the fact I mean enjoy was excellent I mean it really stepped in with ways and stretched himself you know put himself in a press will try to make this you know this you know words into something right and I'm grateful for that and at the same time knowing that he did not have a deep expertise in having an oversight panel I feel like that training kind of reflected that and now that I'm in it I'm kind of like I wish that the Nicole people had been more engaged that we had been more just had the right I mean again I've been an educator for over 30 years and having that expertise of not only experience but skills and knowledge is really essential so you know as we're thinking about recommendations I really have concerns and and I think it also compromises our independence at the same time we want a strong relationship with the monitor but I I just want to make sure that I I would love us to consider um you know again Neco offers technical
[28:00] assistance I I just felt like we got what the police department gets and that's important but I think we also needed what do we need to know as um over you know a civilian oversight of law enforcement and I I don't feel I got that so I just wanted to lift that up um and I'm not sure if there's a way that we could even do kind of just a survey on what do people think about the different sessions and you know because I I don't want to throw away the baby with bath water right there was that use of Forza one is a stunnel I mean you know everybody should have to go to that one but um I just wanted to lift that up and I appreciate um the opportunity to have a conversation around it and not just go by what the regulations are this is the first time the city council has ever you know even created something like this so I also want to give Grace um you know to them as they're trying to compile this but also with an eye towards continuous Improvement thank you yeah absolutely okay yeah we can definitely um you know put something together that we
[29:01] think is key for being a panelist right for for things that um would have helped us when when we were first starting this journey and that we think would be very helpful for other people starting the journey um and so I think we definitely have the the room for that we will we will look to Nicole and other similar resources for that I'm also wondering if there could be excuse me some kind of training component where we get to meet with some of the other um panel oversight panels in the in the area because I think there's some interesting shared learning there as well as we're trying to think about um you know what are the things that we need to know and learn and what can we learn from each other as well maybe that can happen at the nickel annual conference but not everybody can go to that so that's why I was thinking something that's more Regional yeah yeah and we so when we were there we actually met with a couple of the people from Denver but
[30:01] um we would you know we discussed having some type of group together and so we would love to have um definitely some type of maybe Community engagement meeting where we can get together a couple of the different um you know local oversight CU Denver Fort Collins um Longmont whoever we can get in and would like to join us um but yeah I think that would be a great a great great thing for us to do same and that's something um uh I uh through the communications committee following up on our Retreat work of the kind of organizations we can plug in as a CU staff member I did the initial hey hello we exist with uh cu's oversight um uh I think it's a committee I forget I keep forgetting what they what they call but their oversight body and they're they're very eager to me to collaborate to work more and um so that yeah I think that's all and I think that's that's the thing is like so
[31:00] that's like I think that's a nice blend of like training and community outreach like I feel like that falls very neatly into where the ordinance gives us explicit authority to do community engagement um I I think Community engagement with other panels fits that bill um if not training yeah raising up to uh flow in the chat uh well Flo do you just want to just want to say it yes hi I'm not sure um everyone knows this but I've been a member of the Nicole Board of Directors for five years I've co-chaired its training education and standards committee for the same amount of time that's the committee that puts on um most the the webinars that the public can access and I serve as the organization secretary and I will say I mean I think
[32:00] the oir group can discuss with you but depending on how quickly the search for a permanent monitor takes it may be that we should have a discussion about what if any training the interim monitor can provide certainly the oir group and Mike ginaco have as they have even more experience and I individually have in uh civilian oversight so there are things that we can do as you when are the new panelists uh coming on sorry uh yeah our plan is to have them in place by the new year and so if I'm remembering correctly city council would vote to approve them the second week of December and so then their first meeting would be our um what the um are we on second Thursdays uh so would be the the
[33:00] in January um and so one of the things um one of the things in particular that Arielle and I are balancing is um what trainings we want to make sure we and the new panelists have gotten before the new panelists are um brought into their City email accounts the general meetings what kind of trainings need to happen uh before they are officially operating in any function of the the panel it's not the government I'm curious what role the governance committee is playing on that because I know Chico you had you know wanted it you we had initially had talked about having an onboarding committee and a governance committee and we decided to combine so I was just curious um again you know it's great having co-chairs the co-chairs are not meant to do everything right we've got committees we've got you know we you know and so really wanting to um you know distribute leadership and and those opportunities and Chico I know
[34:00] you've spent a career in school and are an educator as well so just wanted to to lift up and make sure that we're you know not having information too many you know two people's heads but really spread across thank you I I decided to just stick to the Legacy committee my bandwidth if I can't just at the moment I'm tied to with too many things but I understand I'm open going forward too I'm a lifelong educator I'm happy to to weigh in on that as far as Pace scope sequence I mean this is what I do for a living and specifically that was just just to clarify what I say it wasn't not not to say the co-chairs were leading training but to make sure the sequence with City staff reaching out or um Public Access reaching out to the new panelists was all put into place to make sure that the governance committee didn't get scooped by anything um to make sure the sequence this or sequence is the wrong order of operations is what I'm looking for Ariel
[35:00] and I want to make sure that the we are on top of the order of operations so that all the moving Parts fall together right for panelists in the way that they didn't for us awesome thank you Hadassah did you have any more from government governance um um I believe that was it for us thank you much yes thank you and uh next up we would do Legacy but Martha did not have uh an update for us uh just um raising up her work on the selection committee which has been a huge lift for her and Sarah um which for which I I know we're all grateful because we are eager to be a panel of 11 and not a panel of eight anymore um so next up then uh unless uh Daniel yeah yeah Chico uh just a quick update we we had our meeting last month and uh
[36:02] we're still diving through the the data that we got on juvenile interactions and there are certain questions that we have and we have wanted to raise with the providers of the data before we can move forward so we'll we'll still work in progress gotcha awesome thank you Chico for that yeah yeah and we'll we will have um I'm working on like some reports um from the data um but more than anything it was just a the the way that like we know that the way that census um racial data is collected in this country is is interesting right and so um if there's a category for racial and there's another category for ethnicity and so sussing out those two things because
[37:02] they're separate and then also then connecting them to a larger data set um that you know unfortunately isn't super clear um just leave some challenges and so um we just have a little bit more questions in terms of um what more we can get um to help us kind of get a better picture of of the data um because the numbers also just didn't add up so um yeah anyway that's that's all that's where we are thank you in that case I will hand it over to Flo for our interim monitor report okay I'm gonna share my screen and just one other thing on the training I think that since we are looks like we're going to be here through January in a minimum but I'd like to get a handle this is not something I discuss with Joey but I can
[38:00] reach out to him get a grip on exactly what trainings have you know that he coordinated and that you think are necessary for brand new board members and what's necessary before they sit on in panels but I don't currently possess any training modules either the um documentary the Powerpoints or any recordings that were made so we can um at least give you the list of the trainings that we went through and especially the ones that were coordinated with um either the police department or outside City staff and then in terms of I think you will have to reach out to Joey for for the ones that he did himself conducted himself and I don't know if those have been left with anyone at the city um but I would assume that a lot of the ones that were coordinated with outside parties will be readily accessible um but we can get a list to you flow in the next few days just so you have that that would be really helpful if you'd be
[39:01] um for helping us with that again my name is Florence Finkel I'm uh serving on behalf of the oir group as the interim independent police monitor and also present is Michael janako who's the leader of the oir group um uh just uh to cover the information in since the last meeting on the panel's full case file review data uh since the last meeting cumulatively the panel has conducted five full case reviews two in October and three so far in November three of those are pending Police Department disposition currently there are no panel reviews scheduled although the panel has
[40:02] previously voted to review two pending cases but those cases the investigation has not yet been completed this is the report on there are two cases that uh the panel conducted a full case review and the police department did close with dispositions since the last case meeting this first case which is a serious misconduct case and I want to add a caveat in that the interim monitor did not uh this case was reviewed by the panel uh and the investigation concluded before the interim monitor started um but it's from reviewing some of the documents related to the case this case was self-initiated by the police
[41:01] department it started when they are exploring they're going to implement a new case management system and they found during this review that there were systemic issues in the detective section of the department and in particular uh one person assigned to this section had a little uh struck them as a large number of open cases and they subsequently discovered that uh good Porsche some a portion of those cases had not actually been investigated at all and uh the department conducted an investigation and the panel reviewed the investigation there were five officers who were made the subjects including the line detective two supervisors and two managers the panel for each officer recommended that the uh
[42:04] allegations be sustained and recommended for all five that the department terminate the officers one officer had already resigned and the panel as well as the monitor the the Joey lopari made numerous policy recommendations to improve the performance of the detective section recently the chief made her uh final determinations and uh agreed with the panel that all the allegations against the officers should be sustained however she did she imposed the penalties that you see listed for one officer the officer was transferred out and received a three-day suspension and a performance Improvement plan a second officer received a one-year letter of reprimand training and education for the officer
[43:01] who had resigned uh the termination was it's held in abeyance in case the officer ever reapplies to the department for a fourth officer uh the department issued a one-day suspension and for the fifth officer a five-day suspension uh the department has drafted revisions too but is not yet issued a new general order that would cover some of the or try to rectify some of the processes in the detective session uh section which and the New Order that hasn't been issued but we've been Pro provided a draft details the responsibilities of uh the different ranks within the detective section the detectives the sergeants and the commanders um limits sets limits on what an active caseload should be and this limit is 20 and requires open case updates and reviews at least every 30 days
[44:01] foreign I just wanted to jump in actually really quick flow and just to acknowledge um that this kind of report to the public is new to our community um and to highlight the importance of you know our journalists and our reporters in our community to help us to share this information to ask the right questions to open the right public records and to help tell the story of policing in our community and oversight in our community and I think that is especially for this case especially for this case and Taisha I see your hand s stay in line um
[45:00] I remember the first so I want to I'm I am um I'm reminded of a conversation we had with the chief during one of our public meetings uh it was after the first one of the first times that um the panel and the department disagreed on the um this the discipline Matrix so although we agreed on sustaining and often and the majority of the time we do right that's one of the things that we had talked about that we are often in step with each other the area of concern that I raise in that meeting was the lack of guidance of what happens when we do not and I'm starting to see a pattern um around when we do not agree and the need to consider going back to uh when I was looking at some of the civilian oversight models that we had used to
[46:01] form our bylaws and I'm so happy we have a governance committee so I'm looking forward Hadassah to to working with you and the team on on this if it's an area of interest but you know I would really love to explore you know again recommendations as we're considering our annual report for 2022 around um some kind of appeal again I'm noticing um that is not out of hand to have some mechanism you know I worked in public education for a long time a parent has a complaint first they go to the teacher okay they're not satisfied they go to the principal they're not satisfied there they go to the superintendent they're not satisfied there they go to the school board they're not satisfied there they go to the State Board they're not right there are layers right of accountability especially when we're seeing a pattern that is disturbing and so I'm hopeful that we can also consider some policy recommendations and again this is where the relationship with the city manager and the city council becomes absolutely critical
[47:02] um because oftentimes when again when I'm looking at some of these appeal processes um those are the folks that are included right um you know and so I I'm I'm just hopeful um as we're we're seeing this acute pattern um that we can identify some policy solutions that allow us as a panel um to in to to our job to do what we what the voters and and and what our community has asked of us thank you um okay the second case um I don't have to add the same caveat I did review this case um this case involved a complaint uh uh from a member of the community was in a mental health facility and alleged that staff had assaulted her administered
[48:01] medication against her will and falsely imprisoned her and the police department responded and prepared an incident report that was closed uh incident no crime the individual complained that uh the officers didn't conduct inadequate investigation and the panel found that the allegations were not sustained against two subject officers but did recommend that the department improve its investigative workflow and established systems memorializing detective super advisory review of incident reports the policy says and the officers involved stated that detective supervisor is supposed to review these incident reports uh to make sure they're either properly closed or investigated by Patrol or assigned to a detective the department agreed with the panel's finding of non-sustained and
[49:00] agreed to implement the panel's recommendation and also felt that the new case management system that it intends to implement in 2023 will help resolve this problem and just a note on monthly case statistics in October uh two misconduct complaints were filed and one Community inquiry and so far this month one complaint has been filed that's going to be a serious misconduct case and as of November 8th there were 15 open cases including those that panel has already reviewed but are pending Police Department disposition that completes my report thank you Flo thank you panelists um I'm going to say we can go ahead and take our five minute break now panelists to return for case selection and public

[64:01] governmental agencies as well and I'm just wondering um you know when we talk about over policing of marginalized groups I'm seeing an under policing um on the other side so again it's not something that's in our Authority or in our thing but it is a pattern I'm starting to see and I we could just add it to the list of other things that you know recommendations that we make that are out of our Authority but are in the interest of public trust uh and safety thank you and just to Echo what Taisha is saying when we have a analytical evidence or stories that we hear of some of these so-called bad apples Reinventing themselves in other places I mean it just doesn't Bond well for the community thank you for that co-sign Chico and Flo I want to acknowledge what you put in the chat box that the chief must by law and I want to remind everybody in here that laws are made by people
[65:01] right laws change and evolve as our Consciousness understanding our commitment to one another changes and so although we may not have the authority to do that as a police oversight panel I would be remiss if I would let it was once a law that I was three-fifths a person is this the game we're gonna play and so I just want to lift up that when when I'm rather and this is you know I also have this issue with Joey flow so this is not anything to do to you but I'm not afraid of what a law says right a law that sometimes I don't even know when that law was made I don't know who the people are that made that law did they own slaves I don't know right were they a part of segregation I don't know and so again as our community strengthens and as we try and come together and really have a safe and in a safe Community um I just want us to not punch you know two two um show up and when we see something say
[66:00] something so thank you for allowing me the space panelists to say something in that moment that pattern that I'm seeing I'm hoping those who do have the authority to revisit that so that we're not accepting a resignation and allowing somebody to walk away with a pension when they themselves um have have broken the law and if you know I think of all the drug charges Etc their lives are destroyed over something that is now legal and so again thank you so much for the time float could um could I request that you reach out to the department and um have them send us the reference what law they're referencing okay anything else before we move on to public comment okay thank you all for making that an
