[3:18] right all right well it is six o'clock so welcome everyone uh we are resuming our continued meeting oh there we go now I've got do we have Channel 8 going yes all right now I'm on mic welcome everyone we're resuming our continued 00 earlier and so we are now going to begin our regular Thursday December 7th uh meeting of the Boulder City Council and so if we could start with a roll call please youa yes sir thank you and I get the pleasure of calling R for the first time for our new council members and we will start with council member Adams present Benjamin present mayor Brockett present

[4:02] council member fulkers present Marquis present shoard here spear present mayor Pro Tim wallik for the last time here and council member Wier o I'm last now present mayor we have our Corel thanks so much Elicia just to be clear Mark is not leaving us but he is concluding his Service as mayor PRM no seem it's just Pro 10 you gave us a little bit of a heart attack there a little scary right so um if we could start please we do need a motion um to suspend our Council rules of procedures to allow us to have three public hearings tonight I do promise they will all be relatively short so moved second second we have a motion in three seconds um all those in favor uh please raise your hand

[5:01] okay our rules have been suspended and we can now go to our item number two which is open comment and Ryan will go over our public participation guidelines prior to the beginning of open comment so Ryan if you could take it away please thank you and Welcome to our new members of council my name is Ryan hon he him serving the people of Boulder as Community engagement manager and supporting uh facilitation of our open comment and public hearings this evening um we want to share the vision uh that the city has created with community members to co-create a vision for productive meaningful and inclusive Civic conversations this Vision supports physical and emotional safety for community members staff and Council as well as democracy for people of all ages identities lived experience and political perspectives there's more information about this Vision um the website on your

[6:01] screen and then the next slide I'll share that the following are examples of rules of decorum found in the boulder Revised Code and other guidelines that support this Vision these will be upheld during this meeting all remarks and testimony should be limited to matters related to City business no participant shall make threats or use other forms of intimidation against any person obscenity racial epat and other speech and behavior that disrupts or otherwise impedes the ability to conduct the meeting are prohibited participants are required to sign up using uh sign up to speak using the name they're commonly known by and individuals must display their whole name before being allowed to speak online currently only audio testimony is permitted online and then inperson participants are asked to refrain from expressing support or disagreement verbally or with Applause with the exception of show of support for declarations traditionally support is shown silently through American Sign Language Applause or jazz hands thank

[7:02] you thanks so much Ryan all right we have um 15 people signed up to speak in person and several online uh each of you will have two minutes to speak I'm going to call three names at a time and if you could start to come down towards the front as your turn is arriving our first three speakers are Charles Clark Patrick Murphy and Patrick oror so Charles Charles no Charles Patrick Murphy I see you here please come on up my name is Patrick Murphy I've lived in Boulder 54 years I'm here to thank you praise you and chastise you thank you for the huge time and effort it took you to get here and now to work here I Praise You In the previous council members for dealing with the cogs of

[8:01] Boulder during the pandemic and dealing with that now in a world gone nuts for example if all the dead in the Israel Hamas War were to line up single file that line would be over six miles long nightmare evidence that two wrongs don't make a right neither do three four or five Boulder has a tendency to use arrogance as a Feelgood motive motivation to deflect the pain of true self-critical evaluation the most recent example of that is a passage of the 2A tax that will take away $70 million from Essentials like police fire and Human Services that 20-year tax will outlive me and the deceitful claim that it'll have no negative effects is shameful Happy Talk art is great but needs to stand on its own not parasitize health and safety thanks to the to current council members for voting to not put 2A

[9:02] on the ballot your valued critical skills were demonstrated May the rest of you respect this as you now deal with the true cost of 2A finally in the past the boond dogle called the mun effort sucked up over a decade and millions of dollars fueled by arrogance and deceit there are those who still claim it motivated more rapid change it did not those changes were coming and the mun effort was a vanity exercise the mun leader city manager and City lawyer that promoted the mun are all gone don't let Boulder repeat those mistakes Boulder climate action has 18 full-time employees exactly what do we get for that is it mostly feel good or is it truly do good be critical self-critical Patrick your time work hard and stay

[10:02] well thank you now we have Patrick oror Leonard seagull and Michelle Rodriguez I have a a few slides okay maybe raise your mic up as well good evening city council I have a few slides I'm hoping oh there they are um congratulations I I want to thank you in advance uh for all the effort that you've done and I was hoping to be able to thank the previous board and the members who just left because they've been true Advocates of historic preservation here in Boulder and it's a hard assignment for us because it's not always the most popular thing to do uh I want to thank councilman Folkers for uh attending our uh 37th annual home for the holidays um event this weekend we had over 400 members join us and walk through these properties I was hoping to see a variety of city council members

[11:01] and I'm sure you're familiar with it the theme this year was adus and more specifically adaptive reuse of these Carriage Houses and adus and how they can help us solve one of the many problems you're going to be dealing with over the next couple years which is the housing situation and the affordable housing so it's an important part of preservation an important part of preservation is the rehabilitation and the Adaptive reuse of the historic properties in a variety of different ways um I just wanted to update you on the the process of the proposed Civic area historic district we're moving forward and we hope to bring it before this city council uh for a vote and sometime in the the month of March um originally when we put the application and you could move to the next slide if you would when we put the application and we've been working on this process and this project for almost two years now and so a lot of time and energy a lot of soul searching has gone

[12:03] into this process this is an this is a picture of the boundaries and um thank you for sending me the the list of the nine properties that are uh potentially on the Block for being sold by the city of Boulder and so we're a big believer of adaptive reuse which is two of of these buildings and so thank you very much thank you Patrick if Leonard seagull Michelle Rodriguez and Benjamin pelts hello council members um I'm Leonard seagull I'm the executive director of historic Boulder and I'm here to thank you for your open-minded support of for the preservation of Boulders historic properties and neighborhoods these landmarks are the secret sauce that gives Boulder its unique flavor you may know that six of the top 10 tourist destinations in Boulder are historic places I want to give you a heads up on a few of the historic Boulders current preservation

[13:02] projects including what Patrick just talked about continuing to collaborate with the city planning department for the proposed historic district in the Central Park area the designation is sure to be a benefit for the entire city historic Boulder has made it easy to tour the area of the proposed District virtually on an app you can download on your phone or exess on your computer it's a site called pocket sites it's free and it's available right now and we've also put uh in the past year two other tours on that site one is the little rectangle the African-American neighborhood of Boulder in the gos Grove neighborhood and another is mid-century modern architecture in central Boulder another ongoing preservation activity is helping owners of landmark properties to get state of Colorado Grant funds for the restoration of their buildings such as the Oddfellows Hall and right

[14:02] here in Boulder uh Colorado preservation Inc is going to be holding its annual conference in late January there will be several guided tours including shiaka and enar there will be education sessions about the relevance of preservation in assisting with solutions for affordable housing sustainable design and acknowledging the contributions of minority groups historic Boulders mission is ongoing because every era in Boulder has inspiring lessons to pass on to the next Generation we look forward to cooperating with the government and other partners in our 52nd year saving the historic Spirit of Boulder thank you thank you Leonard now Michelle Rodriguez then Benjamin Peltz and Chrissy Smiley hi guys Michelle Rodriguez first off I wanted to say congratulations and welcome to all the new council members you'll know me pretty well after next next year cuz I'm going to make it my habit um also I wanted to say um it was

[15:02] a really awesome motivating award ceremony you guys had earlier this week on Tuesday and there were a lot of people who were honored for their values their integrity and their their contribution to the community I thought that was desperately needed um also I wanted to say getting back to business I wanted to make myself a Community Connector for the homeless crowd um we've got a memorial that's coming up this next about a week and a half it is I'd like to invite everybody to attend 30 to 4:30 at the Bandshell I think Bridge house will be um the primary sponsor of that but um I'd like for you guys all to come out it's it's been a tremendous uh loss in the last couple of years I couldn't speak last year just for the number of losses I'm going to get up there and speak this year but um we have a lot of work to be done there's a lot

[16:00] of exciting things that are getting ready to start being put into play I'm excited for that I have a big rapport with the homeless Community I was out here for 5 years on the streets I've been through every program they had to offer and that they've built including coordinated entry and all that um and I I'm a Survivor on that but um I welcome any opportunities to to be that U person between you guys in the community and um and I hope you guys know what you got into the new ones that just came in and I I too I I know we'll see the rest of the uh Council around the city and they did a good job all of all of you guys thank you guys have a good night thank you Michelle now Benjamin pelts Christy Smiley and Doug Hamilton do we have Benjamin in the room last call for Benjamin all right Christy smiley

[17:00] no Chrissy all right Doug come on up all right good evening my name is Doug Hamilton and I live in Boulder first let me congratulate mayor Brockett Council women Spears Adams Wier Maris and councilman Shard on your successful campaigns and I wish you all the best as you govern us and I hope that um you can make the reforms that will convert our community in into one that first and foremost cares for people if a message was clear and the outcome of November 8 it's that voters want Public Safety around pth public spaces and schools but they want but they also want Civic leaders that will prioritize solutions to solving the root causes of those public safety issues as you know I recently Co organized an opposition campaign to measure 302 and here's what I learned if if our city wants to reduce the number of homeless people on our

[18:00] streets they need to reestablish the low barrier um overnight Sheltering in place for winter uh by low bar I mean no coordinated entry and no sobriety requirements as long as the person is not threatening to others they get the day shelter up and running with a similar low barrier entry requirement work with regional leaders to extend the mental health and addiction treatment um from detox to sober supported transitional housing create outdoor spaces like Park safe parking get the care alternative responder program up and running raise the minimum wage um to match the counties and expand the Housing Voucher Program to All Families of BB bbsd school kids and establish eviction protections uh for tenants I will leave you with this quote from Michael Desmond a retreat into complexity is more often a reflection of our social standing than evidence of critical intelligence hungry people want bread complexity is the Refuge refug of the powerful don't overthink it say no

[19:01] to analysis paralysis set goals and deadlines experiment and be okay with families failing programs don't have to set be set in stone good luck Our Lives depend on it thank you Doug and understand Charles Clark has just arrived uh Charles if you want to your turn was a little earlier but if you'd like to come go ahead and come on up and speak to us you're welcome to good evening I'm Charles Clark a retired physician our family home has been in Boulder since 1970 three generations of our family live in Boulder I've heard for years from the boulder Chamber of Commerce and from many politicians how important it is to protect the well-being of businesses by keeping the minimum wage low the implication is that the well-being of businesses is more important than the well-being of

[20:00] workers over these many years I've observed the effects of this policy on the workers their families and myself for myself I am tired of subsidizing Boulder businesses when I see hungry children here in Boulder I'm unable to resist donating to the local food bank the children are hungry because many Boulder businesses don't pay a living wage workers amilies are forced to go to Emergency Family Assistance to keep from putting their children to bed in their cars the families are in such Dire Straits because many Boulder businesses refuse to pay a living wage I was outraged that my grandson's parents were collecting clothing and supplies for their child's grade school classmates because Boulder businesses don't pay a living wage to the parents I'm tired of paying extra taxes to

[21:01] support Wick so that newborn infants can have food and diapers that their parents cannot afford because many Boulder businesses don't pay a living wage I'm tired after all these years of subsidizing Boulder businesses by having to care for their workers because Boulder businesses championed by the Chamber of Commerce have deliberately underpaid their workers and relied on people like myself to keep their workers and the workers children fed and housed um Charles your time is up if you have further comments you're welcome to email those to us and and we'll read them carefully my problem is I'm disabled yes I barely got here I wasn't notified that I could speak until 6 o'clock and frankly

[22:00] I'm fairly angry about the system that you all have I have one more paragraph if I could finish that I would appreciate given your disabled situation you're welcome to finish your your last paragraph thank you through deliberate foot driving by the previous Council Boulder has missed the opportunity to raise the minimum wage in concert with the county no more studies no more coordinating with other cities please raise the minimum wage by 15% every year until the wage is at the maximum allowed by state law thank you thank you Charles okay our next three testifiers are Joseph stepanic Steven hell and Aaron nyer first and most importantly congratulations to all of you my name is Joe stepanic I live at 7201 Street a twice landmarked a family home I'm also

[23:00] a member of the sister cities organization representing the Tea House in the relationship between Boulder and Duan Tajikistan that gave us this Tea House in 200 boxes uh several 25 25 years ago it was President Eisenhower who was informed that we shouldn't depend only on diplomats to keep peace in the world and to have human relations with our colleagues all around the globe Eisenhower signed a proclamation establishing sister cities so that citizens to Citizens could get to know each other the US OFA now has some 12,000 sister cities all across the continent and Boulder very proudly has I think nearly a dozen sister cities and so who would have guessed that a so Soviet Republic gifting a tea house to Boulder Colorado would start a retail store that is now one of the the most if not the busiest meeting place in

[24:02] downtown Boulder we also thank the Martinelli for Ving the tea house as a people toe meeting place and also for protecting the building it is now landmarked again because of the board and city council that new building relatively new building is now landmarked we thank you for that uh we're also proud of the fact that the city council itself has a plaza devoted to to the sister cities that that represents boulder around the world so there's a lot to be thankful for and my main purpose is simply to say thank you uh I'm here to support the Civic area also with the tea house is one of several landmarked buildings and we and the tea house uh board uh would be very pleased to join other Tea House other other landmarked buildings thank you very much sir thank you thank you Joe thank you now we have Steven hell Aaron Gabriel naira and Lucy Carlson

[25:01] krov I'm not seeing Steven in the room no so um Aaron you go next and then Lucy Carlson krackov fantastic hey everyone uh first off welcome to all you new folks um really happy about this board um and excited to see what you all do so thanks for thanks for doing it so I want to share a little statement I did not write this um we stand at a critical moment in Earth's history a time when Humanity must choose its future as the world becomes increasingly interdependent and fragile the future at once holds great Peril and great promise to move forward we must recognize that in the midst of a magnificent diversity of cultures and life forms we are one human family and one Earth Community with a common Destiny we must join together to bring forth a sustainable Global Society founded on respect for nature Universal human rights economic Justice and a culture of Peace towards this end it is imperative that we the peoples of Earth declare our responsibility to one another to the Greater Community of life and to Future Generations so that was

[26:00] the Preamble of the earth Charter which is an international Declaration of fundamental values and principles considered useful by its supporters for building a just sustainable and peaceful Global Society in the 21st century it has four pillars and 16 principles the four pillars are respect and care for the community of Life ecological Integrity social and economic Justice democracy nonviolence and peace so there's a lot of people who are applying this in education business and government to move towards those common goals and to align with others um Mont peler ver used it when they were creating their most their master plan I think about 10 years ago um and there's a number of other cities so I think that given um our um plan to renew our comprehensive plan in just a year or two I think it's really wise to consider how a framework like this might support those efforts and how we can begin to research that not just to ensure that our city is really aligned with those values but to be a model that can Inspire other neighbor cities like I think a lot of what Boulder is doing is already doing what this is speaking of but by aligning

[27:01] with that movement we're creating relationships with other cities around the world who are doing that and we're also saying this is a framework that others can use so our sister city or like rather our neighbor cities like um Broomfield longm and others can start to have a model so they can also do it because if we're going to address a lot of these problems today we have to like recognize the systemic nature and collaborate effectively on them so thank you so much thanks Saron uh now have Lucy Carlson krov and then um Travis Hugh Cully and Silas Atkins good evening Council my name is Lucy I was born in Boulder raised here still live here first congratulations to Taisha Ryan and Aaron for your incredible races and victories I'm excited to see what we will accomplish together I am also compelled to bring to your minds the coalitions that spend hours volunteering on your campaigns I hope you keep the priorities of Green

[28:00] Transportation affordable housing and compassionate responses to homelessness you ran with you now as you govern okay lastly I would like to address the compassionate responses to homelessness I mentioned earlier these include reestablishing a low barrier overnight Sheltering place during the winter no coordinated entry no and no sobriety requirements as long as the person is not a threat to others as well as establishing a day shelter with similarly low barrier entry requirements thank you for your consideration remember who elected you all right thank you Lucy now we have Travis hu Cully Silas Atkins and Phoenix Salo good evening Council I'm here just to introduce myself and um give you some heads up because there's some unfinished business that we'll have to attend to um congratulations around the table I just want to be brief I only two minutes um the second anniversary of the Marshal fire is just weeks away and you have not

[29:01] seen the end of its consequences in your term developers are going to act like they found space we just forgot about and they're going to want to roll out new polluted developments um this will do more than contradict the boulder comprehensive plan it will force us to override our Public Health needs and standards both the Jefferson Parkway Highway and the Rocky Flats Wildlife Refuge Visitor Center are moving forward while col Colorado leaders are appear to be losing their memory between 1952 and and 2005 the Rocky Flats weapons facility took up 6,200 Acres on an outp pass Church Ranch until 1992 Dow Chemical and Rockwell International polished and assembled over 70,000 plutonium triers atom bombs that would then be installed into larger bombs each about the size of two grenades the powder from this Metallurgy is

[30:00] spread across the boundary between B Boulder and Jefferson counties it's in the air in the soil and in the streams these heavy metals are deadly carcinogenic and they are F fuel for wildfires to the council person willing to take on the Rocky Flats advisory committee challenge in 2024 I am at your service um there are two landfills designated super fun sites in a cof area within the Wildlife Refuge they call it the central operating unit this area is protected by a 3-foot fence there is a history of materials being taken offsite of The Refuge that dilute the plutonium on the one hand but Trek it into residential areas on the other this council's job is to remember can I continue well your time is up but if you could email us the rest of your comments so we'll read them carefully I will congratulations to all you thank you Travis uh now Silas Atkins and then Phoenix

[31:08] Salo hi everyone I've seen quite a few of you recently uh quite a few times and I'm here to say congratulations and also to urge everyone to uh get out there and do what we need to do to make sure that Boulder is a welcoming inclusive place um I ran on pieces of community and I'm going to continue to be here building community and I look forward to working with all of you reaching out to you talking to you and finding what we can do and ensuring that we're looking at solutions that are uh taking care of needs and are not being voted on in a vacuum that we are looking at each Solution that's being proposed each thing that's each ordinance is being voted on and how it impacts other things in the community and how we can make sure that those things are successful by branching out to all the other pieces of the community it's going to be very important um I look forward to finding ways ways to uh to build community uh uh

[32:00] out there and so whether that's talking to people meting meeting with people sending emails whatever it may be um I I want to know I want everyone to know that uh no matter what is happening out there that we're all here together and that we're here to support each other and that we're part of a greater ecosystem that needs to be ured we just heard about Wildfire issues and things like that there's so many things that we can be talking about but let's make sure that as we look at that there substantive solutions they look at the whole picture and not just find one thing in a vacuum that's going to potentially fail because it's not being supported by other Solutions thank you thanks syas Phoenix saloo is our last inperson speaker hi everyone Phoenix U um welcome new council members and congratulations everybody um I am business owner now now of both of my businesses Rising Phoenix

[33:00] Reiki and whole systems integration because um back in school again because I'm interested in the intersection and integration of spirituality environmentalism and institutional structures and so there's a few um topics that I've spoken on and I love to come back around to one of which is I love how many voices have showed up today and I want to really bring in uh announcement around bringing in more voices into Council especially indigenous voices um listening today to some of the topics that were brought up one thing that I wanted to bring up was also the mitigation around balmont but and the reparations that are happening with indigenous cultures in this area that being an especially sacred site for all of these cultures that would come even Warren cultures in the areas when they stepped foot on that land they were

[34:00] at peace everyone there was at peace and the amount of nuclear waste I believe it is um as well as runoff and all sorts of dumping in different areas that have happened in that place I think is especially pertinent to bring up because of the fact that it does go into that fertile Valley where a lot of our Farms are um and so really bringing in voices into this space I think is going to be so important especially for me as a mother and integrating I'll bring in more of my own topics that I've spoken on before but integrating all of these topics in different ways so wanted to bring that up again and again congratulations thank you Phoenix um I understand our first two virtual speakers are not present they were Lyn seagull and Michael kber so we'll go to our last uh virtual speaker which which is Aiden

[35:02] Reed good evening Council are you able to hear me yes okay good good evening congratulations uh on your election uh my name is Aiden Reid I'm one of the co-chairs for the Boulder County uh chapter of democratic ass of America uh 302 passed despite our best efforts and Council now has a mandate I hope you will use it we desperately need as you've heard from others a low barrier to 24-hour shelter but we especially need long-term substance abuse treatment um and a long-term facility that can accommodate that we cannot look away from the conditions that drive and exacerbate our homelessness crisis and if we fail to deliver these outcomes then a reactionary Council will with predictable results let us not get to that point and while this is the most visible and perhaps pressing issue facing Boulder invisible homelessness persists in ways that we may not see many many workers cannot afford to live in Boulder they live in their cars they

[36:02] couch Surf and while they may not be technically homeless they are profoundly housing insecure and many of them who are not workers are children and I hope you'll deliver on this as well lastly I know this there's going to be an open public comment part for this but I won't be able to tune in for it so I just wanted to say I wholeheartly endorse Nicole spear for mayor protm thank you tonight um I will uh first turn to City staff for any responses and then city council so n or Aon do you have any responses to what you heard thank you so much mayor and as always we appreciate um the folks who come and share their voice with us I'll say there are a couple things that were mentioned about um uh our efforts on homelessness and I just want to mention that uh city council will see that before them twice in the early part of next year in in January and in February we're going to be talking about different topics related to homelessness um I'll say too

[37:01] that uh I uh I won't be spoiler alert as I uh to staff I won't share exactly um the details of it but next week you should be hearing both um an announcement on The CARE program um the non-law enforcement response program with our Mental Health Providers and uh our fire department and you should also be hearing an announcement regarding our day Services Center um so stay tuned for that early next week some good launches there and then finally there were some conversations about minimum wage and I'll say that our team continues um to work with our neighboring Partners uh Longmont uh is one of those Partners in conjunction with um our sister cities we have been our sister cities regionally not our sister cities in the world um have been working on uh RFP to really study the economic effects of impacts on minimum wage as you all had asked us when we first came here uh to talk about

[38:01] minimum wage we uh expect that work to be ongoing and to be worked through the first uh quarter of next year is that right okay there was a little bit of a question mark on that I was because I saw council member fer it's looking at me like a did I get that right it is an early 2024 thank you mayor and we look forward with great anticipation to the announcements about the day shelter and The CARE program Aon did you have anything I do not thank you uh council members any followup or questions seeing none well oh over there I thought you were saying no no sorry this was just a question for our city manager um if folks would like to also hear about some of the updates around day Center that um where would you recommend they go go uh they're not able to tune in to the council meeting uh we will actually be um issuing a press

[39:01] release next week and so it will be very public thanks for that Nicole okay thanks again to everyone who spoke and we'll now go to our consent agenda Elicia if you could take us through that please yes sir thank you our consent agenda is item three on tonight's agenda and it consists of items 3 a through 3F do anyone have any questions or comments about the consent agenda I did have one thing which is I'll note um part of this is approved the 2024 City uh council meeting calendar uh which uh does not include our fifth typical fifth Thursday off in February so want to say I'm fine with approving it now but I'm hoping we can still get a week off uh because that's helpful for I think the council Cadence but we'll we'll keep working on that uh yeah got Taisha and then Mark I raised several questions um in connection with my hotline yesterday and I think those

[40:00] questions have been adequately answered uh by staff and so I'm good okay thanks for that thank you uh I was curious if um all major religions had been considered in the formation of this plan I noticed that there were some notes on the side but they all they were only representative of two religions so I was just curious if a a sweep of all the major religions especially those that are represented here um in the city were also kind of reviewed in the creation of the calendar um I I don't know if I'll uh look to our city clerk to see about the creation of our calendar but I believe we have taken that from previous um calendar years and um have compiled that uh Alicia I don't know if you have additional information on that the practice over the previous years have been um to look at the actual Jewish

[41:01] holidays because there are religious work restrictions for that particular holiday um and that was the one those were the ones that I noted for that particular reason the meeting dates are pretty much the second for the regular meeting is the 1 and the third Thursday of the month so those have to be actually put in stone unless you change those dates as a council so again the only thing that were considered were the Jewish ones that restrict working for those particular days so that's why those dates are noted on the side okay thank you very much thanks for that question TAA uh if we have no other comments anyone interested in a motion perhaps Mark I will move the consent agenda I'll second we have a motion and a second uh this is a roll call vote uh roll call vote Elicia please that is correct sir thank you we'll start the

[47:04] [Music] greetings I am will McGrew a resident of the city of Boulder I give my thanks to the council for giving me the opportunity to address them on behalf of my good friend and council member Nicole spear I'm before you today to advocate for the appointment of a highly qualified and dedicated individual to the position of Mayor pro tempore someone who possesses the unique combination of organizational prowess exceptional meeting facilitation skills and an unwavering commitment to keeping our city on the right track and advocating for our most vulnerable members that individual is none other than Nicole spear in our P pursuit of progress and prosperity the role of Mayor pro tempore is not one to be taken lightly it requires a leader who can navigate the complexities of local governments Foster collabor operation among diverse voices and ensure that our city functions smoothly even in the face of challenges

[50:00] appoint Nicole spear as our next mayor pro tempore together under our leadership we can build a stronger more cohesive Community for the benefit of all you thank you William uh now in person we have Claudia theme and then Christen Eller and I understand there was a mistake made and Aiden Reid should also be signed up so he'll be our final speaker good evening members of council my name is Claudia Hansen theme I live in the holiday neighborhood of Boulder I want to say congratulations to those of you taking part in your first meeting tonight and welcome back to everyone else who's here for another round I'm here tonight as I was a year ago at this time to recommend my good friend and sometimes friendly antagonist Nicole spear for mayor protm of Boulder while we have recently elevated the position of of Mayor at least in the public eye the position of Mayor proem remains largely symbolic in terms of its official Powers but I believe the choice

[51:01] of leadership here sends a strong signal about our commitment to action and which voices matter when we set priorities and evaluate our work as a community I want to talk first about action here in Boulder we have a long history of burning through ideas people and time when our legislative and executive processes don't align Council leadership can address this and N Nicole's skills here are well matched to the problem in her professional life she's a highly effective manager whose superpower is building and supporting inclusive teams that get things done together the job of a council leader is somewhat different but in a system where we rely on City staff to develop and deliver programs council member Spear's understanding of organizational culture and institutional capacity are invaluable assets and she can help move good ideas across the finish line second I want to talk about who sees themselves included in this city when

[52:00] Nicole approached me to help with her first campaign in 20121 she told me she didn't plan to stay in a seat long if elected she saw her most important work as making space for people who have long been excluded from Power she wanted to make the work work of representation and governance accessible safe and sustainable for others and that I believe is an approach worth elevating as a candidate and in office council member spear has done incredible work to bring new voices into decision-mak processes and I really shouldn't call them new voices because they have been and always will be here in Boulder and she sees that Nicole has built and continues to build relationships with local youth leaders bipo and latinx communities renters workers labor organizers queer folks and more these are all groups that need to be full Partners as we take on the generational challenges of housing climate and racial and economic Justice the appointment of Mayor protm

[53:01] is an opportunity to give the big project that this Council will no doubt pursue the very best chances for success and it's also an opportunity to recognize the broad spectrum of voices which is much bigger than the progressive and Centrist slates that we talk about during election time that exist in this big beautiful community council member spear is an intelligent and inclusive leader who meets the moment and I hope you will select her as the next mayor Pro 10 thank you thanks Clum we'll go to our uh virtual speakers again Kristen Eller and Aiden Reid and then we'll check on Al H 100 batty hello B city council can you hear me yes perfect my name is Kristen Eller I am here to speak on behalf or for Nicole spear as Boulder mayor proem I have been inspired by Nicole spear for a long time now she has been a dedicated

[54:00] Community Advocate leader and organizer and new hpar has made sure that she includes different perspectives she's an effective leader in understanding what the capacity and capabilities of the group that she is leading and how to direct towards an action that will change people's lives I have full confidence that Nicole would be able to be a great mayor proem in that she is very efficient and effective when it comes to setting agendas and running meetings and understanding how to get the job done while at the same time ensuring that she is an advocate for those who do not always have a voice within Boulder and trying to bring in different members of the community I've been inspired by her leaders leadership on Council and in the different community organiz gations that she's a part of and I know that she'll be able to bring these experiences and

[55:01] her skill set to the job of Boulders May proem and I'm excited to hear how you all vote on that thank you hi Council thank you for your time and thanks for letting me speak again um again my name is Iden Reed I'm one of the co-chairs for border uh DSA I can think of no one more qualified to serve as mayor protm than Nicole spear Nicole's qualities as a leader and as a public servant are unmatched in her role as a city council member Nicole has been unwavering in her commitment to community enhancing Progressive causes to name a few raising the minimum wage raising occupancy limits and opposing the archaic counterproductive process of clearing homeless encampments further Nicole has demonstrated a genuine willingness to work with as many people and coalitions as possible she is a rare leader who steps up alongside people rather than in front of them and seeks to elevate and Center

[56:01] them rather than herself I am confident she will serve with honor and integrity and I hope you will elect her as Boulder's next mayor protm thank you thanks siden and now we'll try Al Alejandra batty again all right let's Trad one more time how about now that works yay so exciting I love when I can get Tech to work hi this is Alejandra batty uh newly elected president for the Boulder area labor Council uh I want to speak on behalf of uh nominating for Nicole spear for a proem and I want to talk a little bit more about her her ability to organize because I think that's actually the most important function of this particular role uh while she has definitely been a strong

[57:01] advocate for us in working with us on minimum wage and um uh other areas that we are wor want to focus on for our Union work um really it's being extremely organized in having an attention to detail that I think is extremely important for this type of role uh and I think it's um I think my work with spear um shows again and again how very good she is at sticking with that organization and some ways I think that when you're involved in unions it it kind of becomes one of those skills that you learn on how to work with lots of different people how to listen to different voices how to bring in different ideas um but also how to just plain old stay organized and stay on task and have that attention to detail and I think that's very important so I just would like to advocate for her for this role thank you for your time thank you

[58:01] Alejandra okay um I will now close the public hearing thanks to everyone who came out and spoke and I will now open the nominations for mayor P Tim Tera do you w to let me just quick say something okay maybe not quick kiding first I want to thank the community for supporting me during this election I got 21 thousand plus votes which might be one of the most votes ever in Boulder possibly um okay I'm not trying to boast maybe just a little bit just let me enjoy that for just a little bit until I'm not the most popular person ever um which will happen soon um I didn't win though because I make the greatest speeches as you all know if you know me to me it means an awful lot of people believe that I represent them that's what that meant to me during my previous two-year term on councel and especially during the campaign season I

[59:02] heard from homeowners and renters those in our affordable housing community students and seniors from those that feel marginalized slow growth and progrowth people Arts people bikers hikers and drivers and almost all if not all of our different neighborhoods that they feel heard and represented by me for over two years I worked hard really really hard I went across the AIS went to every stakeholder meeting I could possibly go to listened to people whom I didn't necessarily agree with I lived and breathed collaboration listening and going across the aisle for these two years and let me tell you many times it is really not easy to do that especially in our current political climate sometimes I had to will myself to pick up the phone and make an across the aisle phone call I had to will

[60:02] myself to go to an across the aisle community meeting because they're just not easy but because going across the aisle is a core value of mine maybe sometimes to my D detriment some have said I did it anyway but I believe we cannot get anywhere in good governance if we don't include everyone in the conversation in regards to the mayor protm this vote is not a community popularity contest right now I'm super popular as I said at least today who knows about next week but it is not that and the vote is not be decided by how many supporters one brings to this meeting to speak on their behalf it's not that it is purely a job that is procedural and decided by a council majority vote and I do not have the votes needed I'm ever the pragmatist so after deep reflection I'm going to withdraw my nomination but I do have a few more a few more things to say before

[61:00] um I end and thanks for your patient Council um there have been a few recent historic precedents where we broke tradition last year and I would like for us to consider bringing them back first prior to last year only one person stood for protemp on the night of the vote why is that to prevent that office from being politicized I believe this vote is not supposed to be a showing of strength of political size or of political power but a sign of working together another historic principle was to make sure all voices were heard at the council agenda committee or what we call the CAC for background for those that don't know one of the jobs of the mayor protm is to attend every CAC meeting these meetings happen every Monday morning before the Thursday council meeting the mission of the CAC is to represent present the views of the entire city council when setting the agenda one of the ways to

[62:01] assure all voices are heard on CAC is to require cross Isle appointments for mayor protemp when possible so I hope that this good faith appointment process will continue to be carried forward next year ensuring A diversity of voices at CAC will make sure we best represent our constituents in closing I know some people might feel let down that I withdrawing my nomination ultimately I believe it's best to start off this new Council on a collegial course I congratulate our new mayor protm spear ahead of time I look forward to this new Council working together and doing some great things for the city of Boulder thank you to the community again for your overwhelming support and thank you mayor for giving me this time to explain to to the community why I I am withdrawing my name for consideration to Mayor prot thanks for that Tara appreciate

[66:01] ordinance 8611 designating the property at 604 Mapleton Avenue city of Boulder Colorado also known as the Eastman Reed Collins house as an individual Landmark under chapter 911 9-11 historic preservation BRC 1981 and setting forth related details this is referenced under his 202312 thanks Elicia nor would you like to kick us off yep and for that actually mayor we're going to go directly to our director of planning and development services Brad Mueller thank you Nua good evening council members and welcome and congratulations new council members uh we wanted to just spend a few extra minutes framing uh historic preservation cases we're honored to bring the first public hearing item to this new Council this evening um historic preservation is a program located within our comprehensive planning division which is part of the planning and development

[67:01] services department so uh we we have a lot of integrated programs I know we've got some separate time to talk about the uh makeup and function of the department uh with the new council members but just wanted to give you that context I'd also introduce you to Christopher Johnson who is our um senior planning manager comprehensive planning manager he's available and wanted to just give you again a real quick rundown on what historic preservation uh role in the city is and its context within the uh organization uh before we go to Marcy who will lead the rest of it great thanks and Christopher as you talk us through this perhaps you could also walk us through the process that we'll be following tonight for this public hearing great uh thank you mayor as Brad mentioned Christopher Johnson I'm the comprehensive planning manager it is uh it is terrific to see all the new faces on Council I'm really looking forward to working with you here in the coming years uh historic preservation as Brad

[68:01] mentioned is part of our comprehensive planning um Division and uh really within you know sits within the the larger context of um of comprehensive planning uh it it plays a a land use related role in terms of um uh you know obviously preserving and protecting our cultural resources and architectural resources and environmental resources within the city uh and and really it's um you know it's an opportunity for us to consider and understand how those components and those historic resources contribute to the to the community as a whole but also allow for change over time and really guide the change over time so that those those types of resources can be protected um but also evolved as as the community evolves uh and Marcy will definitely get into a little bit more detail about um the case that's before you this evening uh which hopefully is relatively um

[69:00] straightforward as an individual Landmark designation um but this will be a quasi judicial hearing so you will have your opportunity to take a vote as to whether you approve um The Proposal so with that I will pass it on to to Marcy to really take it away wonderful good evening Council Marcy gerwing uh Planning and Development service is and I believe the slides will come up on the screen I do we'll try it again wonderful okay great all right so starting with the Quasi judicial procedure um first council members will reveal any ex parte contacts and then I will provide a staff presentation followed by a chance for the owners to speak after that the public hearing is open for public comment and um after

[70:02] each one of those things Council may ask questions after the final person in public uh comment has spoken the owner will have a chance to respond to anything that was said and then the public hearing is closed and Council discusses a motion requires an affirmative vote of at least five council members to pass a motion so with that I would pass it back to Mayor Brockett for parte contacts does anyone have any ex parte contacts to disclose not seeing any all right thank you the criteria for your review uh this evening is found in section 9111 and 9112 of the boulder Revised Code and that's whether this proposed designation will preserve protect and enhance historically significant buildings and sites or architectural styles of the past and whether the designation will develop and Main maintain appropriate settings to enhance property values stabilize neighborhoods promote tourist trade and interest and fosters knowledge

[71:01] Foster knowledge of the city's living Heritage your options tonight are to either approve the designation by ordinance modify and approve that could be either the boundary or the name um or deny the designation and uh the process is outlined in section 9115 and this application began back in June when the owners nominated their property as an individual Landmark the landmarks board held a public hearing on September 6th and voted unanimously to recommend designation of the property uh first reading was on November 16th and here we are December 7th for the public hearing so this property is located in the Mapleton Hill historic district one of 10 historic districts in the city and um what's a bit unique about this is that the uh property is already located in historic district so there isn't any change in the regulations that would apply if designated tonight however

[72:00] individual designation uh recognizes it as an individual landmark and the owners would also have a plaque to put on the on their building and if designated this would be the city's um 214th individual Landmark here's a photo of the house which is a beautiful tutor Revival house uh brick with stucco in half timbering above and one of the unique um features of this is the portic casare uh which is on the right side of the um building it's original to the house and um is very much of its time in uh when it was built in 1913 um kind of the transition between carriages and the early automobile in Boulder it also has an attached garage which is a very early um attached garage here in Boulder it's historically significant for its 1913 date of construction and for its association with uh Frank and anesth Eastman who were early owners uh who lived here with

[73:00] their two children as well as for the association with uh multiple families prominent in the Boulder Community um including the current owners who have owned the property since 1975 in terms of its significance for the development of the community it's located within the Mapleton Hill historic district which was designated in 1982 and it has been recognized um by many authorities uh it was identified as a contributing building uh when the district was designated as well as in a survey in 1986 which found it to be uh potentially eligible for listing on the national register of historic places and it was also featured in Jane Barker's uh historic homes of Boulder County in 1979 in terms of its architectural significance it's an excellent example of the tutor Revival style and it was designed by Arthur e Saunders who designed uh many buildings in Mapleton Hill and on Pearl Street as well as how Mortuary the masonry detailing such as

[74:02] the brick lentils and stone detailing at the corner show exceptional skill in artistic Merit and it's uh one of the few uh brick portica shares uh here in Boulder as well as that early attached garage and then it uses uh local stone and brick and then in terms of its environmental significance it's uh prom L located on the corner within a uh established and designated uh historic district the uh proposed name is the Eastman Reed Collins house which recognizes both the Eastman the early prominent uh owners as well as Reed and Collins the current owners um both for their contributions to the community as well as their very careful stewardship of this house um since 1975 and the proposed boundary is uh proposed to follow the property lines which is um best practices and uh and is what we

[75:00] recommend so with that uh staff recommends as well as the landmarks board recommends that uh Council uh approve the designation of the property at 604 Mapleton Avenue to be known as the East Reed Collins house and with that I'm happy to answer any questions you may have thanks so much for that Marcy any staff questions from Council not seeing any questions I would at this point invite um if Judah 3 and Richard Collins if you would like to come make a statement to us you're very welcome to as the owners of the property I'm sorry I'm rather deaf and the coil doesn't work in here but so I couldn't hear everything you said but I would like I would like to comment that

[76:00] the um staff the historic preservation staff did an incredible job on of research at our house and um they came up with architectural qualities that I had never even noticed we have now owned the house for 48 years and there are things that new things about the house that I just found out and and also the U historic ownership they found out a few interesting things that I hadn't known as well even though I gone to the records before and one thing they missed in the U architectural design indeed it was designed for automobiles it has a hidden gas tag which which they they couldn't even see it's back um and you can't see in this picture but by the back door uh the kitchen door by the garage underneath there there's this this spigot kind of thing and that's where

[77:00] the hidden gas tank is and the other thing was in terms of ownership this is a scandal and I don't know all the details but I think I heard it both from philis Smith who's written a history of Mableton Hill and from June Holmes who used to live you know on on the next quarter was that the second owner of the house who owned the biggest mine in Boulder County it would belly up and they fled in the middle of the night to avoid their creditors so anyway I'm not sure about that but anyway the other thing about the house which of course the inside has nothing to do with historic preservation but there have been for example last night we had 40 people at our house for a a um uh a a dinner or potl dinner there had been I don't know how many um political events at our house League of Women Voters had its its um celebrations there um just political people I think

[78:01] Tim worth announced his campaign at that house and uh it continues to do that and I hope that we'll be able to continue to have such celebrations there any questions any questions for Judy what just thank you so much that was fascinating additional color there JY really appreciate that all right um so I think that then brings us to our public hearing we have uh one person signed up to speak so uh Lyn seagull you get three minutes well clearly this house uh needs to be landmarked but I do want to point out a certain amount of hypocrisy here we haven't land Mark Gaza and Gaza is 25 miles and we're demo demolishing it and we're demolishing the

[79:02] people in Gaza it's horrific what we're doing there and I think that the connection with landmarking this house in Boulder is like the same as as I spoke to a landmarks board last night about the house at Cross from Wonder drink place on Pearl it's one block um 946 Spruce they're going to sink 510 million into that place um the Reeds house is is beautiful of course it's remarkable of course it should be maintained but the the hypocrisy that I see here is the that we are likely to be bombed coming up here now another 9911 right in Boulder or somewhere in the United States to me it's just as bad and um and in the interest of survival I would like to see

[80:02] us stop this right now in in its tracks this is horrific what's happening and all of this landmarking is for nothing if we're just going to get our own place here in Boulder completely demolish the whole place just like Gaza because there are two .3 million people that are very very angry with us right now and I want to survive I really do and I want to see many more beautiful houses preserved like like 946 is going to be fabulous you're going to see it in a few you know probably a couple years because it takes a while to do it but unless you know unless we get bombed first and then everything's going to be gone and that's my point and I'm not trying to be fatalistic about it here I'm trying to be realistic because this kind of atrocity cannot go

[81:02] on anywhere in our world without coming back at us and in pure self-preservation I implore the council to send up a re a resolution about ending the occupation in Palestine and stopping the flow of money from the United States in complicity with this atrocity which we will be liable for and in the interest of not creating another 911 or just a random bombing of a random your time is up you know I mean in the UN okay well that closes our public hearing so now bring it to City city council does anyone have any followup questions or comments or maybe even a motion I can make a motion if you want please year Mo I make a motion to adopt

[84:01] Financial Officer Cara Skinner but before I should say that we have a new budget officer in place and I ask that you welcome uh Charlotte husky in her new role as we have stolen Mark R wolf and brought him into CMO we now have Charlotte uh taking that stad so be nice don't be nice thank you [Laughter] n and I was going to just also introduce and welcome Charlotte uh to the budget office we're thrilled she's been a tremendous contributor the last two plus years that she's been with the city of Boulder and prior to joining the city of Boulder she was with the city of Austin for I think nearly 12 years um so she has tremendous local government experience um and so just thrilled to have her here and um she's excited to do her first presentation to you all so we I think are ready to hand it over to Charlotte ready all right good evening Council I'm Charlotte husky good to be

[85:00] here tonight I'm the budget officer budget officer with the city of Boulder um tonight we are bringing forward ordinance 8614 for recommended uh supplemental Appropriations to the 2023 budget this is the second reading of this item that we're bringing forward tonight so I just want to to provide an overview of budget adjustments as a reminder we bring periodic adjustments to the original budget um on an annual basis uh two are regularly scheduled throughout the fiscal year we typically bring forward in May our adjustment to base one for an anticipated expenses for emerging needs and typically in November which is the item that we're bringing forward tonight is uh a Reconciliation of supplemental appropriation related to Grants donations and unbudgeted revenues um as a reminder to uh atbs or adjustments to base support appropriation changes such as um unbudgeted new initiatives that are

[86:02] supported by Council or city management unanticipated expenses for emerging community and organizational needs and Grant appropriation that's not included in the adopted budget so um bringing we're bringing forward tonight atb2 for uh the 23 original budget and broken down on this table are the budget adjustments by type we have three um budget adjustments including the additional unbudgeted Revenue fund balance and Grant Revenue um as seen in this table there are three types of supplemental adjustments un additional unbudgeted Revenue includes um just need to breath for a second um additional unbudgeted Revenue includes uh examples of this includes uh donations and reimbursements or revenues that are coming from um coming in above

[87:00] budgeted amounts fund balance supplemental Appropriations include um the appropriation of funds of available balance uh that available balance of unobligated funds um in available in fund balance after reserves and then supplemental appropriation from Grant revenues are just that related to grants that are awarded to the city midye and therefore not uh associated with the the original budget so again the total amount that we're bringing forward tonight is a total of 10.3 million within the next two slides I'll I'll share some highlights of recommendations that are included in the packet um first there's 369,000 of Grants and additional Revenue news for the Parks and Recreation Department to support youth programming Child Care Financial relief tree canopy protection among other Parks and

[88:00] Recreation programs um The Parks and Recreation Department received over 12 grants donations and reimbursement that were received by 10 outside agencies to support a range of Parks and Recreation programming the climate initiatives uh Department received a total or is uh increasing a total of 1.4 million in supplemental appropriation to support the healthy 's Bright Futures Grant as well as a partnership with the Boulder County Office of sustainability climate action and resilience uh department or Oscar um staff anticipates to use this grant award to assess the impact of pesticides on young children and uh the Oscar contract includes business and and residential sustainability Services um such as Partnerships with a pace um partners for clean environment business sustainability services and Energy Smart residential Serv uh residential sustainability Services the housing and Human Services Department is is uh bringing forward a supplemental

[89:00] appropriation of 4.5 million this is supporting uh a grant that is received for the affordable housing modular Factory as well as a section 108 loan um the project uh supports the Assembly of affordable modular homes while also providing Workforce training for students of Boulder um Valley scho school district of the Boulder Valley School District um there's a total of 1.2 million that the transportation and mobility department is receiving from CU Boulder for the Colorado intersection project many of you are familiar with this project it's the first fully protected intersection in the city um and this uh additional uh reimbursement received for for um from CU Boulder is going to support the placemaking and Transit enhancement features associated with the project we have a total of 1.3 million that are going that's going to

[90:02] support our uh anticipated increases uh through year end for uh medical dental and Property and Casualty Insurance we anticipate increases in year year-end estimates for uh employee and medical and dental claims and we also anticipate um property insurance renewals primarily related to the Wildfire events that have occurred uh in the boulder region over the past couple of years and finally we have a total of 173 uh, to uh support insurance reimbursement for the Brenan Brenton uh building flood that occurred in late uh 2022 and so with that I'll answer any questions uh happy to take any questions thanks Charlotte for that exceptionally clear presentation was very nicely done on your first

[91:00] outing uh any questions yes Tina yeah I just had a quick question about the property insurance renewal and how big of an increase you're seeing there and whether you think it will be a long-term steady increase over uh future years take that or me I'll take a first step and Charlotte might remember uh larger numbers but we do our renewals in um April of each year and it's a little hard to get off of that schedule but so when we renewed in April it was it was um more than we anticipated in the amount that we uh have asked for appropriation reflects that increases those increases we did see significantly um larger jumps the prior year so it has it has slowed down a little bit but the insurance industry is very challenging right now so I think we do just have to brace ourselves that we may be likely seeing pretty significant increases year-over-year and

[92:00] unless something changes but we are seeing that in the market any other questions in that case I will go to the public hearing we have one person signed up to speak um and so Lynn you'll have 3 minutes and I'll just remind you this is a public hearing about the adjustment to base for our annual budget if you could uh your remarks on that topic please it would be appreciated indeed you have the floor oh the budget has everything to do with Gaza eron and if you don't get the connection that's not my fault everything to do with it like $4 billion dollar a year we're giving to Israel like where's that money for this budget here right in Boulder where my insurance my property home homeowners insurance just doubled you know I I get it about insurance you

[93:00] know our our prosecutor Michael dowty refused to prosecute Excel Energy for a detached wire that had a do not repair order on it a year before the martial fire they repaired it on the 2nd of January after the fire 3 days destroyed the evidence no no no Criminal suit now the civil suits are having a lot of trouble you know the insurance companies aren't giving out much you know these things affect our economy our overall economy just because it's in Superior doesn't matter you know it drives up the insurance everywhere right here in this budget see the connection errand mayor all of you Council people you know that's why this mayor thing is kind of ridiculous we don't need to spend the money on facilitators and Mayors but the point is all the costs here that Mark Wallock which we seldomly

[94:02] agree on but I I really liked what he brought up on Wednesday about water and other expenses that we're going to have and you know it's always about growth and the more we grow the more we're going to be able to pay for all this stuff but what you really need to think about is the fact that growth does not pay for itself we need impact fees we need to not worry about a budget that's accelerating all the time and we need to not debating over these things that we really need you know and the $1 million of the library district that we're swimming in cash now when we gave up you know and Mark made a good point point about the 20 million um what was it that there's a not 20 million 20 years instead of 30

[95:01] years um that it's it's more expensive in the long term to draw the loan out um those are issues and the the problem is we shouldn't have those kind of issues because we should have a healthy budget and not have things accelerating all including things like congestion and costs for traffic mitigation and people not getting killed on their bikes like me done thanks Lynn that closes our public hearing or I will close our public hearing and come back to council uh do we have any followup questions or comments on this topic Mark you know at at the risk that Lyn will no longer like me um I I need to point out that the city of Boulder acting through its city council does not maintain uh a foreign policy um that's
