[0:01] uh recording is started um CH did you want to call the meeting into order one more time oh sure uh call to order the beverage licensing Authority hearing for um November 20th 2024 at 3 p 3M excuse me thank you so much all right I'm going to reshare the rules of [Music] participation time okay the city is engaged with community members to co-create a vision for productive meaningful and inclusive Civic conversations this Vision supports physical and emotional safety for community members staff and board and commission members as well as democracy for people of all ages identities lived experiences and political perspectives more about this vision and the Project's Community engagement process can be found on on our website the following

[1:02] are examples of rules of deorum found in the boulder Revised Code and other guidelines that support this Vision these will be upheld during this meeting all remarks and testimonies shall be limited to matters related to City business no participant shall make threats or use any other forms of intimidation against any person obscenity racial epitet and other speech and behavior that disrupts or otherwise impedes the ability to conduct the meeting are prohibited participants are required to sign up to speak using the name they are commonly known by and individuals must display their whole name before being allowed to speak speak online currently only audio testimony is permitted online and the chat function which is called the Q&A and a webinar um should be used for technical questions to staff and should not be used for public comment okay now we can move on to member roll call if you will just speak your presence aloud um chair Matt califano chair Calo present thank you uh member absam member absam present member

[3:00] next we have hearing agenda issues from licensing clerk um I just have one hearing agenda issue for you and that is the agenda item eight which is for a renewal um hearing for Riverside um they did not meet their public posting requirement so that will need to be continued to the December um agenda and that is it for that um next we have the Matters from Boulder oh Roberto did you have something yeah um just for the board's consideration Clarity on this issue as of today do they because they didn't do the posting do they have a a liquor license so their license expired on July I believe it was July 30th and they did submit their application for renewal

[4:02] on September 23rd so they filed their renewal application within 90 days of the um liquor license expiration date and Christen C can correct me if I'm wrong or Berto you can correct me if I'm wrong but I believe that allows them to operate as long as they've submitted the renewal within that 90day period yes that is correct it's under regulation 47 303e that they can continue operating until final agency action any concerns about this business uh as it relates to the renewal that the that the authority should know um I will defer to Kristen on that one and

[5:01] if she has concerns I think we uh staff will have information to share at the next meeting when we actually hold the the hearing for this particular agenda item okay thanks thank you both um okay now we're on to agenda item two which is Matters from police department and I see the officer wck is here hi can you hear me okay good technolog is about got the death of me today too um hi I'm officer Le and let me let's go over a couple updates so far to date we've received just under 1500 fake IDs um in the month of October I ended up issuing out 14 or I'm sorry 19 uh fake ID tickets and those like said previously those were to

[6:01] students who have two three four violations of fake IDs that have been turned into the boorder police and so far in November I've issued eight um I have a volunteer who's helping me process those 1400 IDs we're almost through the majority of the cuu students and next will'll move on to the nonc students so that's definitely been keeping um me busy on one level um and then the other thing that was interesting when I've talked with some of the students um who've been issued the tickets um they have mentioned that they've had other IDs seized at liquor establishments but they according to my um spreadsheet I never received any fake IDs from them so if um Nathan's on here I just wanted him to reiterate during his meetings that if they do seize those IDs that they're required to turn them in for ruls um and then I've had some other aha moments and I was wondering what the um board thinks of maybe doing

[7:01] individually of course right alongs with um the officers just to kind of get an idea of what the um lior establishments look like on at different times and of the day and different days of the week and stuff so you don't have to answer that right away but it was an idea that I had just so that when we do talk about some of the issues and the concerns that come up you guys have a firsthand experience of what that looks like and um we could um definitely uh schedule one of those if you guys are interested and we are here 24 hours a day so we can accommodate their schedules if you guys are interested in that but I would love I would love for that to happen um the other thing I'm working on um and I'm not sure why it went away probably because of covid is our last drink data um I want to be able to present that to you guys of what what our last drink data looks like and it looks like right now from on

[8:00] system that we have we aren't collecting that so I'm working with our um dispatch supervisors as well as like our um people who help us with our appson which is our records keeping system to try to figure out how we can collect that data um the data that I am getting there's some concerns um from some establishments of uh over service so that will definitely be beneficial in the future to have that information um we can take a look at that and see um and also that would be information that I'd be able to push out to the r about these concerns that were starting to see and kind of show some data um so I just wanted to let you guys know that I'm working diligently on getting that for you um and then lastly I'm not sure if Nathan's on here or not but oh it looks like he is I would really love to connect with him and um hopefully maybe he can start those meetings back up again with the members of the ra are um

[9:00] just so that we can um talk with them and open up those lines of communication and let them know what we're seeing um you know what we're looking for how we document that information and stuff like that so um Nathan if you have my contact information if you could reach out that would be great I would love to be part of those meetings each month um and you know just kind of open up those lines so that we can push out um information and helpful stuff that we have um I do have a lot of Li establishments and a lot of them that are rock stars and they're doing amazing um so that that makes me excited because I'm I want 100% we'll see if we can get there I think that's it any questions R thank you officer re um member Calif would be in full support of doing ride alongs um do you know what the like what would we be looking at for a time commitment

[10:00] um any any amount of time you can pick you could do the whole shift if you really wanted um it's actually they're pretty fun and it goes pretty fast um you can do daytime you can do weekends um what whatever time works for you if you want to do an hour two hours four hours if you want to do it uh you know during a an event a CU Event to kind of get an idea of what the what liquor establishments look like and and I'm talking like all of them we can go do whatever um and the supervisor sergeant from the hill was on board with that so he would be more than happy to have you ride with him just so that there's no you know there's nothing that we would have to have anybody recuse themselves from you know in the future if there were any incidents that occurred I think that would be very beneficial for the board um how does the rest of the board feel I ful y yeah member card and

[11:02] support as well likewise yeah I'm totally in support of this I just also would say I've been around a lot of stings and operations um over the years so I'm I'm willing to definitely jump along and see how we're doing it now for sure compliance checks um you know excuse me compliance checks actually I was just talking about just not necessarily compliance checks just come ride on a an given night um if you wanted to go ride on a compliance check we would have to coordinate and organize that which I would have no problem with that either as long as there was nothing for verto didn't have any issues with that but I would for sure invite you to do that other than I'm not sure if you'd have to replace yourself from any violations that occur yeah that would be the only concern but if as long as it's only one of you at a time um then you recuse yourself just from that that one

[12:00] consideration um I think it's a it's worth it it's a great thing to do to get an understanding of what the uh the folks do within the police department to ensure the the safety concerns of the community yeah um I think that you know now that we're getting closer to the holidays um potentially doing these um starting at the beginning of the spring semester um might be good that gives us a little time to kind of coordinate figure out schedules things of that nature um but yeah I don't know if there's anything you need to prep or put together for this kind of a thing but we can definitely um talk about it uh you know starting uh next year at the beginning of the semester okay um officer wck I was under the impression that we could just maybe do we need to coordinate as a board or can

[13:00] we just coordinate individually with you I think coordinating individually with me would be perfect okay we can be sure that just one person goes at a time and there's you know no overlapping or anything like that and and even if two wanted to go at one time we have plenty of officers you could go ride with okay thank you great well thank you for that um are there any other questions for officer rck yeah I had a question um yes officer re so could you expand upon the last drink program I don't think I've heard of this before the last drink data yes um so I think if I'm not mistaken officer bird who was the alcohol officer prior to officer denig used to collect last drink data and um Kristen I'm not sure if you have more information on that I know for sure we collect um data for du but I

[14:00] would like to expand upon last strength data from medical calls um assaults sex assaults you know just all calls and just kind of what the last drink data was for what types of calls that we're seeing and receiving um and if there's you know and then that might help us um just kind of direct our attention to if there's specific place that we see may need some you know additional help or resources that we could direct our attention there um just trying to avoid any you know any so bling data typically I believe was for dwise however I would like to personally expand it for all of our all of our calls that are alcohol reling and is it really just that you're asking the person who's involved like when did you have your last drink or where did you have your last drink yeah right now for duys we typically ask them how much they had to drink and how long ago and it's my understanding they used

[15:00] to say where did you have your last Stak and some of them were very obvious as DUI happen right outside their driveways or even in their parking lot so that's pretty obvious when we have um that occur um but yeah for sure that's why I want to make sure that all of our officers are all in the same page and that we're all collecting I'd rather have more data than not enough and be able to present that to you all so that you have an idea kind of what's Happening Here In The City that sounds really helpful thank you this member Al here I know Cher calano can speak more to this because we've seen a lot of these data sheets before and it did include almost everything it wasn't just DUIs right Matthew honestly I'm having trouble remembering um I I can say for certain it was DUI um I I I think they may have included like assaults might have been one on there

[16:00] but um I don't remember how fully inclusive I don't feel confident in speaking on that but um I I think it was slightly more than just DUIs yeah I think officer Berg kind of had the Mandate if there was something alcohol related in any sort of case the question was from the officer to the person involved like you said member car where were you last um and that I thought that was very valuable information so um officer re do you think we can compile that for next month's hearing for I working on that right now um unfortunately there hasn't really been a way to track it other than by word of mouth so what I've asked our officers to do is when they do have a call involving alcohol that they send me an email um we've obviously over the last four years we've got new report writing systems um and so it has attracted um like how it we used to be able to track data and nobody's brought it up hasn't been you know like Hey how do we do this until um we were talking about it I talking about it with licensing and they asked for that

[17:00] information I thought that's absolutely something that we really do need to figure out so I am working with our dispatch um supervisors and working with um Daniel Reinhardt he does a lot of our data collection as well as we've sent emails out to all the supervisors saying you know we really want to start collecting this this information so I think on our side of things on the police side of things we're trying to figure out a good system to track it um that would be able to just you know search certain um terms in the cad system which is our computer A dispatch and it could pull up all the calls that are related to alcohol um and we can just take a look at those what I've been doing is looking at the watch logs and if there's an a call related to alcohol I've been looking at the reports or the body warn camera of the officers um sending emails and asking you know where where did this happen you know what what was the circumstances surrounding it and you're watching that camera footage so that's obviously not going to work as not going to be able to collect accurate

[18:00] data so we're working on our end um to try to figure out an accurate Reporting System sorry that's a long-winded answer that's fine thank you so much I don't know if it would be beneficial or helpful to you but I bet if you go back and look at some of our hearing packets when officer Berg was um in charge they those might include some of how he presented that information to us there was one more thing I had and I just lost my train of thought with I'll see if I can remember it but um are there any other questions from the board for officer Rec oh that's what it was officer Berg used to also if we saw a pattern with establishments into terms of last drink

[19:00] I think he would um contact management and the owner and have a conversation with them about that um I know that was an effective method for some of these establishments so maybe that could be potentially something if we see a pattern that's a good idea and actually um I my goal is to um start adjusting my schedule to where I'm actually out at night doing some of the inspections um so that I can have these conversations with the ones so far that I know about and kind of give my heads up of what we're seeing um because there's been a couple of names that have popped up already um so that is a goal of mine um to to do that it's just hard in my bedtime it's 8 o'clock to adjust that schedule but that is definitely a goal of mine and then also the goal is that when I'm doing these inspections to bring those other officers with me to kind of help you know and train them up a little bit on what it is that we look for is a lior officer so that can kind

[20:02] of spread that out over the B again another Long window awesome well thank you so much officer re appreciate all that you do thank you so much um next we have agenda item three which is Matters from responsible Association of retailers and I see that Mr dwey is here yes uh can you hear me okay all right I have some new headphones so um all right so I got a few things sorry I couldn't make it last month I had a personal emergency last minute and couldn't contact you all um not nothing to report last month too much um this month we have a few things to discuss uh first of all officer rect of course I'm willing to work with you and every capacity possible um I just

[21:01] sent you an email uh from back in May when we were trying to connect um and then I did I did try to call for one meeting earlier this year but uh never heard back so I would love to have you at our first meeting in January uh to go over everything to talk to the members uh but definitely have that meeting with with you and I uh first and foremost and I think uh we can be really helpful with one another um we got com a compliance Checker out there right now and we can share information on that so you and I can discuss that later um super stoked about that um I'd also like to go on a compliance ride if I could that would be really beneficial I think to my to my work and to the community at large so if I'm allowed to uh invite myself I would love to do that um moving forward from there uh the the we have a couple new members joining us this month I've been working really hard uh with uh Scrooge um the new Scrooge uh restaurant coming

[22:00] up um and I know you guys will be talking with them later working really hard with Mr Kim making sure that he has all his ducks in a row and um so that's that's been great a couple other members on on the cusp uh I know we got Embassy Suites hotel is as one of the new members which is great because that's really going to help us launch more into working with hotels in the area they've agreed to kind of uh connect me with some people in the community so that's awesome um but probably the biggest issue that we really need to talk about today is uh the fact that the LED has put out that uh regulation saying that you need to be listed on their list for certified trainers and I know that the bla or I um from what I gather the bla is on board with with that notion and I'm great with that let's get on the list the only problem is um myself and my assistant uh applied back in June and we still

[23:02] have not heard anything uh we've sent in everything for tips uh since then she and I have both been served safe alcohol certified as I told you we would be and we started conducting those trainings and then we received an email from them saying uh we need to be on the list which I totally understand uh we have gotten one email back from the LED stating that they are really behind they had a huge influx of trainers um I recently talked to John Baler which most of you are familiar with if if I'm not training someone in Boulder probably he is and he's not on the list yet um so what I'm guess I'm asking the the bla today is just for your patience and for you to be able to um still recognize us as trainers um until we can get our names on that list um and and I hope that will be okay because trainings are generally full still we keep grabbing up new

[24:02] members and if I'm not able to train I can't imagine um that ra will grow and in fact we would probably lose members if we're unable to do those monthly trainings and in fact I'm doing more than monthly trainings lately I've been I've been doing multiple trainings in Boulder the past two three months and will in December and January as well so your approval until we can get on that list I mean give us five or six months for the to get um everything in order on their end our Serve Safe applications are going in at the beginning of next week because we have to record ourselves doing all the presentations there's just a lot of things they want from us um and we're we're doing it we're going by the book um going as fast as we can with all of this but again we're just not on that list and there's even like two people from out of state on that list which I find kind of funny um but it's just one of those things where I'm concerned I

[25:00] won't be able to provide the service for the community that we've been providing and I've been doing this for close to 10 years now I'm very confident that everybody in Boulder will be trained properly uh in the eyes of the bla and um so I just kind of want your thoughts ideas what can we do will you just accept my trainings I mean I can prove to you all that we have submitted him and I'll serve you send you the serve save submission afterwards um but like I said even John Baler who's you know even more well connected than I am in this world is not on that list which I found concerning but then we found out there's just this huge backup so um that's just the really big thing for me U moving forward other than that um yeah just having a lot of positive feedback from members and um and the trainings we're doing and everything that we're a part of right now and we have those ID compliance Checkers out there now which is awesome I'm finally got like three or four people and I'm hoping to do three

[26:00] or four checks before the end of the year and so I'm already getting some of those back and older so far has pasted everyone and I think that's it unless I think of something else so yeah my main concern is yeah obviously working with off officer Rec more closely and then making sure you guys can approve myself and Mandy should she need to fill in for me um to train the Boulder Community um because as I even understand it the police officer up here in Fort Collins um she has her own training but um they're allowing her to move forward until she gets on the list as well so just want your thoughts ideas permissions uh anything like that so that's all I have for right now well thank you Mr Dewey and having had personal experience with LED and how backed up they are um I think it's more than fair to Grant Grace in that time period that it's going to take them um I don't know how the rest of the board feels but yeah I think that you know we

[27:02] kind of have to at this point so yeah until until you get on that list it's fine I mean it's a new requirement so um we just have to have that that turn around period um and that grace period there um are there any questions for Mr Dewey from the board the only I mean I'm I'm Solly on board with uh giving Mr Dy the grace this needed um I'm just curious if there's anything that we can do to nudge the process along just to make sure there is compliance or or if that's necessary I think that's more of a state level thing and so um I think we just have to be patient and wait not sure there's much we could do I'm doing a lot of nudging on my side yeah this member ask some here and I guess I'll just confirm exactly what I um member kifo had said is that the LED has has a lot going on right so it does

[28:01] take a process but I think we as a board should agree to accept certain things when we come to look at mitigation around training with lenes I think that's what I'm kind of just want to get at from everyone here that we are going to give some Grace and understand that there are going to be some things that are different around training so just kind of putting that out there for us right now in the inter room until we do get that Clarity for all of us to understand that when we are looking at a p you know a training packet maybe we can ask some more questions about how that's being done with them and have some Grace around what's going on with training right now member Calif would agree with member Epsilon um all right well are there any other questions for Mr Dewey hi this is Kristen changaris licensing manager I just wanted to chime in to this conversation a little bit and uh remind the board that it is part of your bla rules of procedure that the training programs need to be a state approved program so if the board is

[29:02] interested in amending your rules of procedure to potentially allow programs that aren't state approved um that that's probably a separate conversation that needs to happen can I interject real quick so the way the way I read it and was talking with John valer um the other day was that what we're doing is state approved we just don't have the programs are State approved we just need to be on as trainers if they want to get that 90 that 90day responsible vendor trainer recognition so the way I understood it the way that it was explained to me and I could be totally wrong was just that as long as we're still doing the state approved programs dips serve save uh um uh the ABT one that's that's recent then we're okay but eventually we need to be or as soon as possible when they can get us on there we need to be on there so I

[30:01] I don't know if that's false information or not but that's the way it was kind of explained to me through another person from the LED as a board would we be okay to um still continue to proed with the previously state approved trainings and just wait for Mr Dewey to get on this official trainer list I I don't have an issue with that I just want to make sure that that's allowed yeah I agree I think if if the programs are State approved whether or not the trainer is on the specific list and if that's going to be like a bureaucratic red tape thing around the LED if as long as the programs are approved I don't think that and Kristen can obviously tell me I'm wrong about that but as long as our rules say that the programs are approved we can move forward with that my understanding that the tips program is a state approved program um I'm not

[31:03] familiar with the nuances that Mr dwey mentioned with the trainers needing to be certified and I'll let uh Roberto chime in if there's something he'd like to add as well yeah thanks so the way that the rule reads it's not the program itself it's the class so the individual class the training class has to be approved by the state so if the class is approved by the state regardless of the trainer the instructor then that's fine um but there has to be something showing that that class itself has been approved and I feel like and anybody correct me if I'm wrong but I feel like the class of tips and I think even um Serve Safe our state approved is that

[32:01] not correct Mr Dewey can you share if your class is state approved is I mean the yes my class is state approved the thing that they're worried about now I believe is the call the Colorado supplemental package so for example um when we send when we send send it in we can still this is again from the led the way we understand it um from being in communication with them um the way that it needs to work now is just that the reason why they want the recording as well is because they want to know that we're using the coloro uh supplemental material which they want in every class so as long as you were doing that tips class or serice saves class and you have included the Colorado supplemental um package which we have been for a year now um then you are

[33:01] you're good to go until um until they come back and say no you you cannot train you know what I mean like after they go through all our materials um and they tell us that we were not able to train or qualified or whatever they're whatever exactly they're doing when they're listening to us um that that's the gist of it that I get again it's not that detailed they're very hard to get a hold of and and um like literally let me see here one second I have an email pulled up um and and I'm happy to share all this documentation with all of you and I'll just probably forward it to the bla this week um pretty much what it's saying can find it here is that yeah just all the guys saying is that they're just behind um to continue as is and um

[34:00] yeah and to continue that that as is until they till we get word from them after they've listened to our to our training so you either have to video record a training or you have to audio record a training and then they watch you doing the whole tips class with the col Colorado supplement and then I guess they give you a yay or nay whether you can continue so to my understanding we are able to do this because then they are behind and they are in the process of qualifying us otherwise I don't know really how you know 10 Trainers in the whole state of Colorado there's going to be a lot of people not getting trained if that was the other way around I mean if the state's telling you to continue as is I think for me that's more that's good enough to continue as and like I said I'm happy to Ser the documentation we have and the and the correspondence no problem at all but yeah they're not telling us to stop

[35:00] tell you that much I've not been told to stop okay well I think that kind of settles it then all right are there any other questions for Mr Dewey not seeing any all right well thank you Mr Dewey and uh hang in there good luck with the state I'm trying to get it expedited as quickly as I can so there's there's there's where 's a will there's a way we'll get on there as ASAP all right thank you um next we have agenda item four which is general public comment for future beverage licensing Authority hearings and I do believe that Eva from liquor Pros has a quick [Music] comment and uh Eva you should be allowed to speak yeah can you hear me yes okay so I just wanted to reiterate and

[36:00] back up Mr Dewey I am having the same issue with the liquor enforcement Division I we had been listed on their website for years years and years and they recently had done had done the same thing with us we submitted all of our documentation uh back in May and they are still reviewing um so most other jurisdictions have still allowed us to continue as long as we follow the format of the liquor enforcement Division and what they train on um have allowed us to continue to do so but I am in the same boat as him it has been a process to get any sort of response so I feel for him and what he's going through um because we are dealing with the same situation including our Spanish speaking training as well so it it has been a process I just wanted to put that out there um that what he is dealing with he is not alone so um I just wanted to throw that out there um and kind of back them up on

[37:03] that thank you for that Miss gon you're welcome okay thank you um does anyone else have general public comment for future beverage licensing Authority hearing so anything that is not currently on the agenda if so go ahead and raise your hand anyone else would like to give public comment I'm not seeing any so we will move on um next you have agenda item five the lab bar invites sta waffle lab Boulder uh 11553 Street Boulder Colorado 80302 monthly status report to the bla um if you are here to speak on this matter go ahead and raise your hand and I see Mr RAR is here and while he's uh rejoining as a panelist I will just let

[38:01] the um Authority know that the lab bar invites isn't good standing with occupation tax and sales tax and Mr romaya I see that you're in here if you don't mind turning on your camera perfect yeah sorry about that it it kicked me out put me back in no worries um yeah so how are things going things are business is normal um I'm bradia I'm supposed to say my name before sorry about that um we confiscated 13 IDs this month we turned in six on 112 we turned in another seven today um confiscated based on what the ID looked like the fing our ID scanner asking questions um that type of stuff we did have one small issue last week we had a person get a little bit aggressive for not letting him in he didn't have an ID um he stated he was a

[39:00] marine and he was 25 years old used some racial slurs to our bouncers um and we we calmly de-escalated the situation and uh there was a patrolling officer that came through um and the the gentleman left before uh before we when we asked the police officer to come by and and give us a little bit of help um that gentleman just went on um so I'm confident that our our guys are you know they're staying calm they don't engage they're not escalating and they're asking from help from the police and that's something that we've really been stressing and working hard the last couple months is building the relationship with the police department um another example was a um this past Thursday we had a we didn't let another gentleman in and they decided to call a bomb thread in on on on the restaurant yeah and so two officers came in they were super nice and we we took them wherever they wanted to go to um just take a look around and look for the

[40:01] potential bomb um and so those are the different things that we're kind of deal with on the hill when we when we we're declining people we're taking IDs and um there's times that they call they'll call the police they'll call that's a perfect example of what happens yeah I mean it is a difficult neighborhood so um being able to do that um were they able to locate this this individual that made that call they were not we were not aware that this guy was going to go to that extreme um now we're like all right do we start taking pictures of people when they start getting aggressive but like it wasn't they were never able to locate the guy man that's pretty intense um it is yeah but again thank you for handling it it's well as you did um all right well are there any questions for Mr Raya uh only one which is um do do you have I

[41:01] guess security cameras and like footage of people if they are causing problems we do have uh security uh cameras and yeah they were basically like we're not going to find this guy in the security camera though yeah fair enough I don't I don't know how they would have correlated the person inside or the person we probably have to get some better cameras that face the the entrance um to get a better view it's just hard to get a camera facing that way um we almost have to go on like a treetop um which I don't know if that would be legal to do if he was turned away at the door um so I don't I don't even know if they would have been able to to find that person or locate that person that we denied great there any other questions from the board not seeing any all right right well keep up the good work thank

[61:00] opened a restaurant is that Scrooge Maki yes and you said it's been open for 10 years yes okay and now you are the owner of Scrooge Soul yes okay and what are your responsibilities as the owner of scro Soul I'm charged for management and training of my employees and communication with my lawyers regarding alcohol and Lial license and what is the overall concept of Scrooge Oran Japanese restaurant and when do you plan on opening your restaurant soon when I when I get licensed okay how many people have you currently employed um at Scrooge Soul seven okay and on a given night how many uh employees do you envision working on site four two in the bar two bartender and one and one Ki and you have you've hired one

[62:00] particular employee who's present here today to speak if there's any questions um as to his role um and what is his name Derek warik and how much experience does Derek War have in the restaurant industry he have 15y year experience with with a recair and management in Border okay and going back to Scrooge Soul um what are the days and hours of operation as expected for this 00 a.m. until 1:00 a.m. okay um and your application you have you'll stay open potentially to 2 am but 00 am. okay um and at your restaurant what type of alcohol do you expect to be able to sell four bar and where will you be storing the alcohol it ID identifi identified on diagram okay now in regards to the training um what do you plan on doing to make sure that your

[63:00] employees are well trained in alcohol service and sales um all my employees must get TIPS certification before they start to work and every decision the uh I'm new member of R so miss Nan D will teach them how to how to learning uh how to do arcor policy too and also all my employees they have to lead and study my aror policy and have to sign and I'm also I'm and personally I'm tips I have a TIPS certification too and I already talked with Mr D lot and about get I got teached by him directly perfect and then what will you do regularly um for your staff to touch base um in terms of your alcohol policies and what's going on at the restaurant will you have meetings weekly

[64:00] with your staff yeah every week we're going to have a meeting about our things and if you have some special experience or special happening we'll talk to the r and sharing our experience with the them together um what types of IDs will you accept on site I'm going to take a America driver license and passport and uh digital ID card for Colorado state only for Colorado State digital ID card will you take vertical IDs never no okay can you please describe the process by which somebody will be ided to come on premises of course I can take their ID and give it to porce well that's if okay well back up if you're concerned that that's a fake ID we'll do that but if you could describe what you do on site to ID a person so how is somebody somebody to determine whether or not they're of age to ah yeah soorry um I

[65:01] want to check the birth and date and age and face to face the picture and face is same and height and of course if the person from out of cor State and I'm going to use this ID card book to check everything and if not match then I decline uh to their record okay um and then do you have a site yes I have scer okay and then um you said you have a bouncer so if you could describe what the process is Through The Bouncer and then at the bar of course uh for beginning of the bouncer they going to check the uh ID card first with with as I described the picture and board State and height with the scanner and also like the out of state this ID book and after they come inside of after customer come inside and my or my Bender if they're first serving to this customer they going to check ID

[66:00] card one more times and what will the bouncer do if they determine that a person is 21 and able to come in do they do something in terms of is there a bracelet or a stamp or something that happens yep they put the or bouncer they put Stamper on the arm okay and um your bartenders how old would you are you planning on having your bartenders Fe for the sale I'm planning to hire minimum 23 year order okay with prior experience yes okay now what will any of your employees do if they suspect an ID is fake H if the for for first time so if there are the few excident I give them one more if sorry if your employee thinks that they're looking at a fake ID what will they do ah if looking for fake idea of course they take a bake IDE card and give it to the police okay now what if a customer

[67:02] gets upset that their ID has been confiscated what will happen then uh we plan to call Board of police okay um now you described the training for your employees what are the consequences for an employee who violates any of your liquor policies or violates the law when it comes to the sale of of alcohol if this happening is the P accident then uh they going to get retraining by R by Mr Nan D until he say this person is okay or and if this is a seriously violence accident I'll terminate that so if it was an intentional violation What then intentional mean order know if they deliberately if they did it on purpose

[68:00] what do you do mean the F excident not an accident so if one of your employees deliberately allowed somebody who was too young to come inside what would you do I'll ask him get out immediately person the right the customer would be removed and what would the customer customer will remove and the and my uh and my employer get retraining but if it was on purpose would they be terminated yes okay they do terminate okay um if you are you are now a member of R is that correct yes I'm member of R and I'm going to join their meeting all the time because I really need to get their experience and I need more teach by Mr D um have you installed security cameras on the premises I have 10 security camera eight inside of the bar and two outside okay and have you hired a security guard as well I already hired a

[77:00] your name and last name for the record yes sir um for the record once again Eva garritson um with one of the owners of liquor pros and uh Eva in this particular incident you were hired by the applicant to conduct a petition is that correct that is correct and uh since they've heard it a million times can you uh minimize your discussion as to exactly what you did yes sir um so um the short version um liquor Pros was uh contracted by the applicant to conduct the needs and desire survey for the the new hotel and restaurant liquor license for Shy's tacos located at 2690 Baseline Road these folks have already been taco truck now moving on to bigger and better things but they've been uh there for a bit um adding on the restaurant liquor license um liquor Pros conducted the needs and desire survey on October 25th and Saturday October 26th I love my surveyors my surveyors do a wonderful

[78:01] job I did have to educate Miss Bobo on this particular one she contacted me on that Saturday complaining that there was no one home I had to introduce her to see you football um she did she did go out on Saturday November um or October 26 in the same date that Colorado was playing Cincinnati she forged on she she was uh very um adamant about that but she did understand here going forward look at the football calendar because I mean that's really important so she made 467 attempted contacts which is really high uh for us in that particular area of those uh 467 attempted contacts she obtained a total of 125 signatures 58 were from business owners and managers all 58 signing in favor at 100% she did also try to notify all the other um licenses of similar types as well inside the area she then um um and all 58

[79:02] signed in favor at 100% um she then obtained a total of 67 residential sign signatures with 66 signing in favor at 99% one opposed at 1% she does do a random sample all the way around the business um if she finds anybody with any concern she kind of camps out a little bit longer in this case um 66 signed in favor at 99% one opposed so if we combine this total we actually have 124 signatures signing in favor at 99% one opposed at 1% this company is very well known in this area everybody was excited for it um the 99% clearly shows a need and desire for this particular license and that the existing Outlets have not yet met that need I would tender Miss Garretts to The Authority for any uh questions that they might have are there any questions from the board for Miss Garrison not seeing any uh Mr Carr thank you and I'd ask

[81:01] it's open I'm there every day and we'll continue to be there and Mr Malik if you could just give us a brief uh understanding of what type of a business you want to operate there or that you are operating there yeah it's a a family you know Mexican restaurant street food um specialty um yeah just the neighborhood Mexican restaurant and um previous to this you did have a food truck is that correct correct how long have you been in the business then uh believe this will be we're four years now coming up on our fifth year and how long you've been open at the current location uh we opened at the end of April uh I know you've done some research that particular location are you aware of whether or not prior to you going in there other operators in fact had a liquor license there yes I believe Bojo's and Bo oreganos both had a liquor license and uh with regards to uh the application that's before the board um have you had any prior experience uh in

[82:00] the alcohol industry uh yeah we actually opened our first food truck at the at a brewery up there my wife was a beer tender there from the entire time they were open for four or five years so she's uh very familiar you've submitted um a document to the authority with regards to the policies and procedures that you intend to operate under with regards to alcohol Service uh are those based upon her experience and also your your understanding of the Colorado ler code yeah they're based off her experiences and uh we have a team member that's familiar with the r um the responsible Association of retailers and that's how that was created let's just get some highlights uh with regards to obviously you're in a college Community um and as a result there's many underage people there uh what's your plan with regards to the acceptance of any kind of a vertical ID no acceptance uh and are you going to accept it in the event that somebody says well I just turned 21 and

[83:02] I just haven't got my license yet no and with regards to um the um identifying of a false ID uh and then taking action with regards to that what's the plan as to what would be done with any false IDs that you catch um yeah everyone that will be serving alcohol's tip certified we have a booklet showing all of the IDS for across the country and if one is uh seeming to be fake it they will not be served and it'll be turned into the police and and then how about uh the other question that arises obviously in any setting where alcohol is being served is the possibility of somebody you know being in a position or a state where maybe they ought not to be served uh what's what's the game plan there sir um could you say the question different yeah if you've got somebody who you think has uh already em bibed enough uh

[84:01] what What's what action is the uh uh are you going to take at your restaurant yeah they will not be served uh we will uh are more than willing to call them a cab or an Uber Uber to get them home you know try to just took the tips class yesterday keep them on site uh get some food in them but they will not be served any more alcohol and and you've indicated that the other members of your staff are also uh tip certified is that correct um everyone isn't yes but we have the codes to get everyone certified before the uh Laker license arrives so your plan would be to make sure everybody was certified prior to uh them beginning a a process where they would serve alcohol correct thank you um and U what's the planned hours of operation uh 00 a.m. till 9: uh Sunday 00 p.m. on Friday Saturday and uh in the event you know having some of the

[93:01] for this month um you have your special event permit list in there and then your liquor license renewal in your packet as well um the only other matter that we had fir licensing clerk is we did get some dates for board Recruitment and those dates are board recruitment begins on Monday December 16th and it will end on Friday January 31 so it's a bit longer of a recruitment than normal it's seven weeks it looks like so um that's exciting and I believe we have two seats up technically remember absalom's seat he's being very gracious in filling that until it's filled and then um member califano your seat is up as well in 2025 so we of course would love to see you reapply and then that's um the recruitment

[95:03] discussion um yeah what are our thoughts on that and my initial thought is I would like to present the idea potentially to city council and I'm happy to do that presentation um and get their feedback on it I don't know if the presentation is necessary but um it would be potentially kind of asking for some financial support potentially for that um just because they do cost money and I don't want to put a huge financial burden on these new establishments but I I'm in favor of potentially making it a requirement I don't know how the rest of the board feels and just the record um just so we're all clear that we're talking about here is it's that we want to require liquor lies to have a SC scanner correct new establishments yes new establishments after after we set a potential

[96:00] date and would that apply also to renewals well that's part of the discussion I think I would like to know what involvement and what subsidy the city can provide before I can make an adequate decision especially for renewals or I mean I don't know if anyone did some research on any of this but I mean I think the cheapest one on the market is over $600 um and that's obviously not the one we might not want um so just I think to the point of the financial costs to the establishments I think that's a good point but I don't I don't think we can have a a really educated discussion until we know what we could potentially get because I don't even know if I would ever incur that onto a license see as a cost I that I'm up in the air about that so I'm that's tough well I uh to your point member abson um requiring something else that's an additional fee

[97:00] We There are fee requirements already in place for establishments um so I don't so I can argue both way so no I don't want to put any more additional fees on them secondly it is maybe we start considering like the cost of running a business and having a liquor license there is a fee to that responsibility and this could be part of that so just putting out that point of view as well well oh go ahead no I was say I'd also like to make the point that um this is a that's relatively minor investment $600 or $1,000 considering that if they had a violation they lose an entire at a minimum day maybe three four five days of um liquor sales so you know I I think from a business standard it it it actually makes sense to invest a little bit of money into a Skinner to be proactive I agree I wasn't suggesting the city should cover them I just didn't know if they wanted if there could be an

[98:02] involvement for uh new business I think before we discussed like financials around what lies go through we should probably get some examples from actual lenses um you know we can say $600 is nothing um but we also need to look at you know how that would really affect someone that's a that's someone's pay for a week or something like that so I I'm not like again I'm playing devil's advocate here I don't know exactly what that would how that would impact a business and of course there are costs aligned with having a liquor license um but again I think it would be nice to have some sort of totality of like information around finances things like that and of course what city council thingss I would also like to have some data around businesses who use them currently and like what percentage are they catching I thought today's report from um the lab was really interesting obviously having that has been extremely beneficial to them and so I think if we

[99:02] could get some more data that could also maybe help us make a decision and or get something in place not to throw a wrench in it but um how effective are these scanners these days we know that a lot of these fakes are scanning so maybe we need to get some potential data on that too officer be able to provide some of that I think if we um are going to be uh going to council we probably want to go to them with a proposal rather than like an Ask of like how much could you give us it would probably be more along the lines of like this is what we'd like and we would like the city to you know consider additional funding for this program um you know that's that's probably how we want to approach this but I I also agree that we should have some some data points so so for for this board what

[100:01] what would next steps look like it's Gathering data points is that is that on us to do is that someone we can how do we go about that I'd like to involve the you know officer W and get her perspective on ID scanners and how they work and if if she believes it's an effective preent prevention method um to uh like abon's point maybe we speak with a couple of uh lenes and interview a couple that we would be willing to and just see you know officer re you mentioned there's some Superstars out there right maybe we speak to those folks and see what they're doing today I also think it would be beneficial to reach out to our marijuana dispensary since they are required to have those I think that we'd be able to gather a lot of data from them um on you know how many they catch versus how many you know

[101:00] they're not going to know the ones that they aren't catching right that those are just going to make it through there are some amazing there are some really good ones out there um but there's also even the ones that the state uses were allowing um they were scanning real The Fakes were scanning real um I guess my point to the whole scanner thing was at least they trying um we have a lot of establishments that they aren't even trying they're not looking at the book They're not using a scanner they're not they're not doing anything and so even just to have a scanner there could be a deterrent for a long line of underagers um but I would definitely I can uh talk with our marijuana officer officer jinia I can see um when they have their meeting if there's a way that we can gather some data from them if you think that might be helpful um like as to the cost of them and the effectiveness of them um you know how much how much it cost to maintain them each month and update them and and that sort of thing so I I can do um some research on that end things um

[102:02] you know as well as I think maybe Nathan could talk to the establishments um and see if anybody are using them and if they have any that are are successful and some that are you know garbage I think there I think there are plenty of both out there but um definitely I think the marijuana dispensaries are going to be able to help us out with that can I chime in am I allowed yeah that's fine okay um hey I've been doing the scanner thing for years so um this is my point of view and we can also discuss this further but um first and foremost I think scanners are effective I think that's a good point officer Rec just made as far as it kind of scares people if it's a long line scares people from going in if they have a fake some not all scanners are created equally that $600 scanner I'm guessing is not that great um probably misses a lot of them I have a couple companies that I've talked with worked with um that are more

[103:02] foolproof but officer rect is correct that even with the best scanners some of them are starting to get through I would highly suggest that um and I can help officer re with this that you all talk with officer Carrie ripsom she's the alcohol compliance officer for the city of Fort Collins she's been personally using and beta testing uh one of these scanners that you can actually put on your phone and has been working with that company and I think she could give you some really valuable data I do believe she's told me I just talked to her a little bit ago I do believe she's told me that like um like maybe one maybe got by but I don't even want to say one got by the the system she uses and so on a from a law enforcement kind of Regulation enforcement side of things I think scanners are good I've been working with dispensaries for years um I I I can't think of too many of the dispensaries who are mandated to use the the scanners who come back with a lot of

[104:01] fake IDs obviously officer Rec can check with her marijuana compliance officer to see how it goes down there but I they have a very very very low rate up here of getting fake ID I mean not getting in fake IDs but of having any fake IDs past a scanner and I'll double check on that and let you guys know as well um so from a regulation side of things it's it's good now I'm going to go into member mode from the member part of things yeah it's an additional cost right um however I really feel uh as a point was brought up yeah what if you close down business for a day or gee what if your insurance pay you know you have to make an insurance payment or something because what you did caused problems I think business owners really can see the value in paying for a $1,000 membership in one of these scanners for a year versus losing all that money because you guys shut them you know decided to I don't want to say shut them down but you know decided to spend suspend them from business for a day or two which cost

[105:01] them thousands and thousands of dollars um so I think honestly this is something I've wanted for a long time as as the Director of re to maybe I don't know maybe forcing them to but if if we can't force them to highly suggesting them to do it and it's something I've worked up here in Fort colins to get done as well um and I also know that several business owners um said that they would rather pay that, membership to the scanner versus face you you guys in a penalty situation or getting shut down for a day situation and I I want to say like most people I've approached on the scanner idea um have have liked it you're going to get some push back of course but I've been been researching this kind of stuff for years so if you guys want to reach out for me I feel pretty well versed on a lot of it and then officer ripsom has been doing it for at least a year or two now and she's very well-versed so in my opinion as long as it wouldn't cost the you know the business owners too much

[106:00] more I I I would say I think you guys are on the right track for that kind of thing just because it's not foolproof you use the book you use your brain you use the scanner and you will catch way more fake IDs in in every you know in every spot I truly believe that and that and it also helps for people who are lazy and not using the book uh but we don't want also to teach them to rely on scanners only so that's my two cents I mean it's something I've I've been trying to get going with lots of businesses I I actually tell every older R member like hey you should get a scanner you know most of them don't but I do suggest they do that so um I think that's something officer reck and I can also talk about at our at our meeting we're setting up here now officer Nathan oh go ahead sorry I was say two questions for you Nathan um first of all I saw Scrooge Soul had a scanner did they get that through you or did they did you make a recommendation and I just I I said you know he came to me super worried and um I'm like hey man

[107:04] you want to really look you know look your best you need to get these scanners I suggested like two companies which I have no part of sure I don't get any benefit from it I just want a safe community and I know those scanners are I don't want to say foolproof because I don't know but they're really good um especially this one I want to say in telich is pretty good and then again like I said um yeah he he did that on his own admission with my suggestion yeah yeah and then just my second followup question was I I believe that there were some grants in Boulder County to cover re membership maybe in the P or I'm not sure if they still exist but um where did those grants come from did they come from the city of Boulder did they come from the state the county yeah so it's this it's the substance uh education awareness Grant it's the sea Grant um and they give us enough I mean they give us money yes sir but it it wouldn't be enough to provide that for our members I wish that would be awesome

[108:02] you know i' get more members that way but as of now I don't have the grant funding for that but that is something um we could do on my side of things possibly or definitely this we can get a grant rider in the city or the county possibly to try to to to to supplement that for us um and if that's something you guys are interested in I'm happy to go down that Avenue and and find out who we could contact thank you yeah because we were afforded a bonus last year the I grant because we did such a good job but it's not enough to cover the scanners I think that would be good information to have uh Mr JY if you could possibly come to the December does that give you enough time the December hearing yeah it should give me enough time I mean I should at least have some more information what what do you want specifically the costs and all that no just the availability of the grants um if you're willing to look oh sure and and like good models that would be great

[109:00] too I'll definitely get the model from officer ripsom in Fort Collins and for you guys and let you know what that is and the cost because she is tight with those people like the you know she was beta testing it for him from what I understood and then um you know in the city of Fort Collins on on people and then I can definitely look into the grant writing situation yes sir no problem thank you and officer you were holding something up I don't know if that was of um am actually beta testing that same one that oper ripson is and that's also what the state LED uses as well um I have found that it is um letting a few of the fakes that get turned into me and I submit those to the um owner I guess of the company and then they're trying to get those updated so we're working together to try to make sure that they get them um these fake IDs are good I mean I'm not going to lie they're definitely good so I think any deterrent that we have is going to be better than nothing um and hopefully we can come back this but I don't know that

[110:01] it'll happen great and then um officer re if it's not too much to ask and please let me know if it is um is it possible to connect with your counterpart on the um oh my God what are we calling it now the marijuana board um clab yes uh is it possible to uh connect with them just on data usage and how this scanners are working for these um establishments absolutely I work directly with her so that's no problem at all and I will have that for you guys if I can get that information prior to December's meeting I will get it um put together and then get that submitted to be sent out to you I think that's kind of a good starting point for next steps um how does the rest of the board feel did I miss anything all right well is there any other discussion on the scanners then at this
