Hearing for Wednesday, February 20, first, 2,024 at 3 PM. Thank you. The first item, our agenda is instructions for virtual hearing and rules of decorum share my screen. The city is engaged with community members to co-create a vision for productive, meaningful, and inclusive civic conversations.
[1:05] This vision supports physical and emotional safety for our community members, staff and board. Thank you. Mission members as well as democracy. For people of all ages, identities lived experiences and political perspectives. More about this vision and the project projects, community engagement process can be found on our website. The following are examples of rules of Dvora drawn in the boulder, red ice coat, and other guidelines that support this vision. These will be upheld during this meeting. all remarks and testimony shall be limited to matters related to city business. No participant shall make threats or use any other forms of intimidation. Intimidation against any person. Obscenity, racial epithets, and other speech and behavior that disrupts or otherwise impedes the ability to conduct a meeting are prohibited. participants are required to send up to speak, using the name they're commonly known by, and individuals must display their whole name before being allowed to speak online. Currently, only audio test only is permitted online and the QA. Function that these meetings should be used for technical questions and stuff, and it should not be used for public comment.

[4:09] and after it go check. Good afternoon. just some quick updates. I'm continuing to process a lot of fraudulent ids that have come into me. I started on some liquor inspections. Those have been quite interesting. I working on investigation of some issues that we're having at some of the liquor establishments that are becoming quite a nuisance and couple of compliance checks scheduled in the next few weeks. We had one scheduled previously, but our operative had a family emergency, so we had to postpone that one and then, lastly, I am starting a to rekindle the relationship with the State investigators so that we can work in tandem and open up those lines of communication and hopefully do some work together.
[5:07] Great, thank you and offic. I apologize. I just saw your email right before this meeting. I will reply to that, though. Okay, thank you. Do we have any questions for Officer Rec from the Board? Have I had one real quick one. You said. started up. The compliance checks again. And how have those been going so far? I know you probably can't discuss anything, but I believe you said you know. So our we have a group of really excited officers on watch 3, some young officers. They started doing a lot of inspections bar checks late at night, and those have become very very interesting. You can tell that the establishments have not had any police interaction in quite some time so those inspections have started back up again, and they are doing the they're doing all of them on the Pearl Street Mall, up on the hill, all sorts of them. And then our compliance checks with our underage operatives. Those. Yeah, like, I said, we've got a couple of those scheduled here in the future, and we plan on
[6:20] hitting those hard. So I will hopefully. At the next meeting I will have some statistics for you. Yeah, I was a little worried about that fallout from Covid, and what that did to the system. So but yeah, it doesn't look like we have any other questions. So thank you, Officer Rect, and I'll reply to that email right now. Thank you. Next, you have agenda. So I want to apologize. I wasn't here last month. I was out of town during the meeting.
[7:06] But it wouldn't have been much to report, anyhow. I do have some great news for Boulder as far as Ahri is concerned, and we in January of every year we do our annual reports for the sea Budget, which funds half of the the dues and memberships for bolder members, which is absolutely wonderful and we trained more than 100 people extra this year be a as compared to 2022. So that's that's huge. Just because we're seeing that employers are able to get people back in there working for them. And the more people we can educate, obviously, the safer the community will be. So that's probably the biggest news. We'll have some other things coming out. probably in March that I'll be able to report on as far as compliance checks, and these sorts of things are concerned. The other major thing I did recently was
[8:04] This past Sunday night I retrained the complete staff of Hazel's. I've been working with the owner, Bruce. since day one of the infraction he called me. and we've been just working very closely to make sure that this doesn't happen again. And making sure we get all our ducks in in a row here now. As you know, he, his system is one of the best I've seen in years. So other than that, I'm not really liking what I'm hearing from officer rec. That concerns me. Hearing that there are places on the Hill and Pearl Street. I don't want to guess any of them are members! But it is on my list this month to reach out to Officer Rec. And as well reconvene our relationship with folder, alcohol, compliance officers, and Rer. So she will be hearing from me
[9:03] tomorrow. Now, because this is actually a very pressing matter for me, and if any AR members are on that list that she has, I'm she and I will come up with a plan. I believe so. Other than that things are going smooth. I've got a training actually, this coming Wednesday so a week from today, I guess. And we already have, like 25 people signed up, which is insane. probably have, like, one of the biggest groups I've ever had so looking forward to that as well. The only thing I would say was, I would caution on not discussing any pending investigations. As we potentially have not heard any of them yet, so we are unaware of them. Item 5 which is Pinko Corporation, Dba and chicken on the hill, 1 1 9, 13, street boulder, Colorado, 8 0 3 0 2 monthly status report to the beverage. Licensing authority. [11:01] And while he's getting settled here I will at the something. I already know. That chicken on the hill isn't good standing with sales and occupation tax. There was a small period of time during this month where they were not in good standing with sales tax, but they did correct that. Alright. Thank you, Caitlin. Mister Lu, can you explain a little bit about why you were not in good standing for that period of time. I did notice that the State had seized your property for about a week. Explain that a little bit. Yes, sir. What the States. We had our Cpa. Helping us, you know, buy our taxes by our State's city. But for some reason he told me I was. I should be the one that spiral State sales tax, and then
[12:00] for a period of time it accumulated up. and then the State took over. They seized Earth properties, and they were demanding payments, and it was 55,000 a little over that. And we we were scrambling around and try to try to come up with funds and get the space back. Get back in compliance, and we we are good in compliance now with the States, with the city, with the city. I dropped up a certified check cashier's check to them, but for some reason on their system it won't update until I believe, last Friday. That that was it. But II did and II spoke to Jose there and make sure we all good. And I we got it all sorted out. So. Eglin, have they been on time, or did? Can you tell if they've been on time with their previous payments? I don't do that information. Sales tax information is actually confidential. So the only thing that I can that I know the only information I privy to is from sales tax, and that is whether or not
[13:09] they are Bridge. I mean, it's really the only information that I can report to the better licensing authority. So great. Thank you. What I would say is, I do have some serious concerns that you know. We put this stipulation on your the renewal of your license that you would be in in good with the State and city sales, tax payments, and that just doesn't seem to be happening. and you are up for renewal next month. and these violations on the stipulations that we put forth are very concerning to me. Yes, sir, and I concern. But yeah, we we I spoke to Mr. Harvis with the States. He was assured that we are all caught up. I filed every single month that we had miss. I filed that we paid our penalties. We paid our fines and we we're in compliance. And II did our taxes to yesterday. So
[14:11] it's all. It's all good now, sir. and that was, you know, 100% on my end. And and I made a huge mistake, and I'm learning from it. I learned from it, and I'm growing with it. and I assure you we are in compliance. Yeah, cause it seems to be, you know, something. Each month has happened with payment not being on time. And that's concerning to me. I know you don't wanna be here. You know we don't wanna waste our time with having to check in you having to file your taxes, which you know we're not seeing other businesses here that have this issue. So what what my main emphasis is is, you know, Pam, early. Get them in early way before, so that if there's any issues you can sort them out. Yes, sir.

Seen as dement of nonprofit, director, member and location manager with the premise business planning interest for a renewal of a collective liquor license. This is a public hearing before the beverage, licensing authority of the City of Boulder to determine whether or not the application of club or city club doing business as Highland City Club for a renewal of a club type. Liquor license shall be granted or denied. This hearing is conducted pursuant to the laws of the State of Colorado and the rules of the beverage licensing authority of the city of Boulder.
[18:05] The purpose of this hearing is to receive information, data, and testimony by interested parties in order to enable this authority to make the findings, and to reach the conclusions required to be made by State law as to whether or not the license shall be renewed. Interested parties are the applicant residents of the neighborhood, affected by the licenses previously determined by the authority, and the owners and managers of a business located within the neighborhood. This hearing shall be limited to the question of whether there is good cause not to renew the licence as set forth in the notice of hearing, dated February 20, first, 2,024. A reading or a record is being made of these proceedings. Those who desire to be heard, shall identify themselves by stating their name, spelling their last name, and stating their pertinent address. They shall also be sworn in by the Board Secretary, sir, any ex parte, communication or conflict of interest from any members on the board. Member California. No member, Absalom, though

We have had our liquor license for quite a while, and we have been in good compliance. But because of Covid, the controller of ours, we lost 18 years on the job, and he did everything for us with his moving on, my son Dustin, who's here, has taken over, and he's done an excellent job on many ways, and he has, tried to file the application paid to fees, but apparently there was a technical glitch on the application that got rejected. So you know.
[20:12] book list just I missed something sort of small. But I'm new at this. So it was not on. It wasn't the website or something, but I just misunderstood. So since then once we heard that there is a confusion. We have stopped serving liquor for quite a while, and we're now here stating that we're a private club membership is what our main focus is. Food is our second focus, and we love having the liquor license, but we use we sell very little alcohol, and we only sell it to our members for special occasions, and thereby request that the application be renewed or our license be renewed? Great. Thank you very much. Are there any questions from the Board members? I remember California just had one quick one.
[21:05] Well, more of a comment, I would say, since you're more or less new to this, just set those reminders, you know well, in advance of the due to the deadline, so that if there are any errors or issues or something that arises, you're not scrambling at the last minute. But yeah, that'd be my recommendation is to just set multiple reminders management tools for next time. Because I just yeah. And and I should have called good to double check things like this. But that's good learning for the future. Yeah. Feel free to contact the licensing office there. Plethor of information. Thank you. We have actually learned recently that there is a law firm that we plan to hire that for $300 renews it. So we're gonna delegate that to a firm that does this professionally. Again, we use so few of cell so little liquor, that we hadn't paid the attention we should have, and for 18 years, under our controller. It was like clockwork, but the transition has been difficult. So hopefully, we'll do a better job next time.

We were approved by you guys the last 2 years in a row. When I sign the lease. You know it's the the old Med space, and they divide. The landlord was dividing it into 2 restaurants. We were taking the smaller side, the west side, which is about 85 seats, with a small garden, leaving the original side to to keep for to the owners. We were told it would take 4 months for the landlord to do that legally, and it was his responsibility to get the proper C of O, so that we could then come to you guys and get a license that 4 months has taken 24 months.
[28:10] He finally got the proper Cfo I want to say 6 months ago, but the timing for our on our end was really bad, because when he finally got to C. Of OI had a new restaurant opening up in la, as well as 2 new restaurants opening up in New York. So I just didn't have the bandwidth to get boulder open things. Now things have tamed slow down a little bit. So we're putting our energy into getting boulder open. We're going through the do process now, getting everything up to Code with the Department of Health. We filed for the Department of Health Inspection, which should happen in the next 2 weeks. Once that happens. I will send that to Kristen teak. She already has the C of the the Co. The new C of O. So she just said, once you sent have the D of oh, inspection. Send that to me. Then she would arrange for an inspection of the space. We would get our liquor license.
[29:07] and then we would open. Does that make sense. It does. Thank you for that. Information. So are you. Do you have a date that you're planning on opening for? Sure or no, II my guess would be May June. early summer. but within the next year oh, for sure, for sure, within the next year. Great! Yeah, we just got to see about. Yeah, like, I don't need to tell you again, like the most frustrating process of my life getting a C of O there. But yeah, we'll open. We'll open this summer. Great! Are there any other questions from any board members? I just had one question I know. I can tell that you're based out of New York City, and I can see here. When you're explaining the progress towards full training. You're fully aware of the requirements of the city of boulder in terms of alcohol training when you get to this opening process. Yes, we actually have. We haven't hired a GM. There, but we've narrowed it down to 2 Gms that we want to hire, who are both have been
[30:11] Gms in the Denver area, and of well aware of that whole process of getting everybody chip certified and and all that. So I'm learning, because New York is very different. La! And we just opened up a restaurant in La and la and Boulder actually very similar. I do have one bar in Denver that opened 5 years ago. So I've been through that process before. Yeah, just so we understand that you understand the training along with the really comprehensive alcohol policy for your staff and understanding that the location you're opening up, and it's now very high traffic for college students and people that are young. And just having that awareness when you, when you go ahead and do the opening process something I'd ask if you and please reach out to Nathan Dewey. Who you might put earlier from the Ra. That'll be helpful. Yeah. that's all I have.

Well, according to the the packet we had here, it said that the State liquor license had not been issued. Yeah, no. We have to get the Department of Health certificate first got it. So that's gonna happen in the next 2 weeks. Okay, I'm just one. We get that. I'll submit that to Kristen. who said, she will then come and inspect the space. Then we would get the license. Okay, thank you for clarifying that. Correct me. If I'm wrong or Kristen, but th that goes through us first is we're gonna if we approve it right now, then it would go to the State. Hi! It's Kristen Teague, regulatory, licensing analysts to the city of Boulder. So the process is, we already had the State license back. We cannot issue we issue both the State and the city license at the same time, upon a successful completion of inspection of the license premises. In order to do that for a new build out. We need this complete certificate of occupancy as well as approval from Boulder County public health for retail food service.
[32:17] So that's when we issue both of them together. But we've had it since the year, not long after their initial hearing, where you guys approved them for their initial license 2 2 years ago. For a special event permit at the event called World's Shortest Saint Patrick's Day Parade at half block of Sixteenth Street, in Pearl Street, Boulder, Colorado, 80302 for a special event permit to occur on March seventeenth, 2,024 shall be granted or denied. This hearing is conducted pursuant to the laws of the State of Colorado, and the rules of the beverage licensing authority of the city of Boulder. The purpose of this hearing is to receive testimony, documents, and other evidence from the application or applicant inform affected persons to enable this authority to make findings and reach conclusions required by State law in accordance with CRS. 1284101 sequence, and any applicant or applicable regulations, and determine whether to issue or deny the permit. Application.
[38:20] Affected persons shall be those parties defined in the State special event, liquor code, and the non profit application referenced shall be the entity who submitted the special event, permit application to the city's licensing office. Any party or persons as above described may speak to the question by providing testimony, data, and other evidence relevant to the approval or denial of the permit application. The applicant is required to comply with the same laws as liquor licenses, such as the special event, liquor code, state liquor code, state regulations and local ordinances and rules. Those have resurrected it, and this this year. We'd like to do a small beer garden

[41:00] Yeah, yes. Well, certainly it was not our intent to do anything illegally. So last year we we had the same plan to try to do the beer garden Last year we had the the entire street from Pearl Spruce closed. So with Kristen we were trying to figure out, or I was trying to figure out a way to fence that entire block, and it was just gonna be we would have to attach fence to the hotel over there. It was just gonna be too much fencing, and so we did not do the beer garden as a separate event. We had a private party at the lodge after the beer garden, so there were 2 separate distinct things. If there was confusion. I think one of your officers call me and ask me some questions a few months after the event, and saying, you know, did you have the the event that you were calling about? And and the answer is absolutely not. We didn't have a beer garden. We had nothing outside the parade ended, and then, later on, we had a distinct separate private party, which the intent was to follow the exemption from from permitting for that event.
[42:08] There there was a daily camera article that was furnished, and and the camera article was written a couple of days after the parade interviewed some folks, and I think the reporter just conflated the entirety of what had happened, because one of the one of the members of the lodge had said, yeah, we had. It was a great time we had a parade. The Governor spoke, gave the world shortest political speech ever. We had all. We'll found everything that happened, and then we had food to drink as a totally separate event in the lodge for ourselves. And so the daily camera said, There's a great food and drink but didn't have the understanding that there are actually 2 separate events. So it wasn't an advertisement for the event. It wasn't an invitation for folks to come. It was reporting on it afterwards, and the report just was
[43:04] I mean, it was accurate to say that there was a parade, and that there was food and beverages, but wouldn't have known that those were 2 separate events. Thank you for that. so the question I have for this. It sounds like this was hosted at a private residence or and the club up upstairs in the lodge. I'm sorry. Yes, yeah, we're we're in the building right now. This is so we're we're right across from sweet Greens. There's a large brick building on Pearl Street. It's 3 3 stories tall. The downstairs is a rental unit. The commercial space currently Dancing Green is a wood woodworking place. Surplus store. Yeah, the army there and then in the center there's stairs that go up, and the terrible organization uses the second and third floor. And there's a large meeting hall, and that's that's where the events, any events that would happen here occur on the second and third floor of the Commercial other. Build the building downtown.
[44:10] and that's all privately owned and everything correct it is. Yes. yeah. So so to be clear, the parade was open to the public. We have anybody that want to come to the parade. They could come. There's no mention of the private event during the parade, and none none of the advertisements that have been posted, for I think there was advertisements per se, but it didn't mention the Odd Fellows event. And then we had our own invitations as members to our own guests. If if folks wanted to come. They had to register online, and we had several people at the front door to check that. They were on the registration list. They had registered in time they were either a member or guest of a member. Yeah. And you guys also set over Kg, and you blurb. And they had said
[45:03] lots of green, but I think that blur was probably communicated to Katy and you before we. We determined that we couldn't get the permit, and it doesn't say anything about it doesn't say anything about the private event. It just talks about the parade. So I don't think, Cajun you was an issue. And then the intolerables, which is the band that played at the private event. So they had nothing to do with the parade. They're just the private event. They they did announce the event to their private mailing list. but they said, DM. Us. To get on the guest list. So it was. It was not an it was not an open invitation to anybody. Come, they would have to then come to us, get on the guest list, and only people. Nobody could just walk in off the street to the event. You had to be on the guest list to get in. Thank you for that, Kristen. We were able to, and I'm sorry we were able to confirm that nobody attended as a result of receiving

Yes, I do have comments and information as I was the staff member that took the initial special event, liquor application 2023 for processing, and subsequently have taken this. So I can provide any I can provide information as to what had occurred, what we had found. when the licensee applicant concludes their testimony, or at the pleasure of the ala great. Thank you? I'm just looking at Page, I believe. 82 of our packet with the city questions here. and I would just like to hear the applicant speak to some of these concerns on all these questions. And a lot of this is problematic. To me it seems like there's not much planning around some of this that we don't see. So are you seeing what I'm seeing? The city questions here.
[47:12] We are these the updated ones that we submitted most recently. this is what was submitted in our packet that were we were provided with staff has received updated questionnaire responses that are working towards being satisfactory for our licensing purposes. I'm happy to answer any of those questions. That the authority would like. So the authority is only available with this initial response to these questions. So my first question would be, the like you're providing alcohol and food vendors that you don't say that you have yet. You say, there's a tent. You don't have a tent permit. You say you're gonna train people personally how to manage the alcohol service with no formal training? I guess I could speak to all those questions if you'd like
[48:03] if I could, if I could. Just just the the revised questions. We've identified the 2 food trucks we're gonna have. It's big Daddy's barbecue and either the post or Fleischman's Fleischman is on the list. The post says they're on the list. So it's gonna be one of those 2 trucks. But we have identified the food trucks, and that's gonna we've submitted that to the city. the we have confirmed the vendors for the alcohol and and all people that provide service will be tips trained. We had, I think there were 8 of us that went through tips training last Sunday. With color tips so only Tip certified and trained. And I believe, Kristen, we have to give the list by the first of March. Of all the people serving in their tips certifications. So yeah, so we're gonna follow absolutely follow every one of the rules. That that are required. And I apologize if that version of the questionnaire you got doesn't show that. But the Revised one does. Oh, the 10, yeah, the tent that we only we only have it the the 20 by 30 10 is only 2 to in case it rains and it doesn't require permit, because only it will only have 2 sides. And so I confirm that with the city and the and the tents ready to go
[49:18] as long as Miss Tiga's has a satisfactory answer to all these. II she's very thorough, and she is someone who I would trust to make those calls. On answering these questions that are answered very inadequately here, that the other question. I just wanted to say while I have you to. Here is, I totally respect the fact that you're taking the tradition from Connor O'neill's that we all remember is a big thing. But can we all agree that St. Patrick's Day and you have a parade that people are gonna be consuming. I'll call in public that you cannot control. and not that that's hearsay from anywhere. But isn't that just suggested in a sense that you're gonna have people walking around in this place where you have no control over people consuming out call in public, which generally is what happens when you have these type of events.

So the parade is, gonna be down Pearl Street right in front of the event in front of our building, and the beer garden is gonna be next to on Sixteenth Street. Half the block. It's gonna be 2 h period. We will require you to get you know. Only people are over 21 with a wristband will be able to purchase out call. So it's a pretty limited number of time. All the marshals are gonna be working to create are gonna move in and work the the beer garden. So we're gonna have at least 30 people in a in a pretty small area, monitoring everything. And it's clear from the tips training we will not serve anyone who's who's visibly intoxicated. That would be illegal. So that's absolutely not gonna happen. And of course there'll be under 21. So we we feel that the and and we personally are doing a 2 h beer garden, because for that very reason it's a Sunday afternoon. We don't expect there to be a tremendous amount of, you know, drinking. There's no band, there's not, you know. It's gonna be. It's gonna really just be sort of a a short celebratory period. So we we absolutely do not foresee any kind of out of hand behavior, plus, we'll have an out duty police officer
[51:15] there during the entire period of time to assist us if we feel like there's anything that looks untoward. So so yeah, so you're right, Mark. It will be fenced as required by the liquor permit. There'll be 2 of the exits we man by marshals. So we're Tip certified, Tip certified. So we absolutely don't anticipate any kind of issues like that. I guess my last question just Kristen, if you answer us for me for number 3 on the city questions, does the application indicate up to 300 people? Is that what you guys are expecting up to 300 guests. Yeah, I mean, II think, I think, yeah, hopefully, that there's that many. I you know it may not be. It may not be that many, but that's I wanted to be reasonable as far as how many it could be. So we wanted to plan for whatever the Upside might be in terms of marshals
[52:04] fencing area and get certified folks. And we're also working with the boulder downtown partnership. We're not with them, but we've we're using them as a sounding board, and they're they're renting us their fence. So you can help us show us how to set that up. And we're gonna try that, you know, we're asking them a lot of questions after they've they've run ban on the breaks similar, you know other events to to look for any potential issues. I was just looking at that application, and just reminded of, you know. Colorado revise statuets that we're looking at here. And we can go into that. We have one of our members is the I'm not sure what his title is, but he works the security at the boulderotto and some of his tip. Certified people are gonna be volunteering. So only tip certified people are gonna check ids as required by law, and serve the outcomes required by law. Are you talking the current application or the issues surrounding last year's application. Let's talk about both. Let's start with, last year's okay. So last year in January, I started working with Mr. Bitterman, on behalf of the application for A beer garden event for the World Service, St. Patrick's Day Parade. We worked really hard from city perspectives. Both myself, Lane, landrith with the city special event review team. downtown boulder partnership, trying to work to get a legally complete application. The fencing seemed to be the most pressing issue and trying to get a diagram as such. The deadline was not made, and they decided to not. They stated they were not going to to do the event they were. We did have conversations regarding the fact that alcohol had already been procured most notably beer, and that they were mentioned that they did have a special keg of whiskey that they had ordered special for this event, I inform them, because there was no
[55:16] permit that could be issued that they would need to have a drive, and they could still go on with the party, but it would have to have no alcohol. I also did provide them with the yeah. the public event that would require a special event liquor permit. They were informed that they could not have any kind of advertise social media, any kind of indirect sale. such as donations, or anything like that. And then addresses that and it's publicly noticed through social media. We didn't. We sent out a notice to them.
[56:02] After rich Denning had talked to them subsequently, supplied a additional application for Kentucky Derby party. At that time we submitted same type of notice that they received for this hearing today, for the Kentucky Derby party. The poster was never picked up, and they withdrew that Kentucky Derby party application. So that brings us here today. I started working with Mr. Bitterman again as the city representative for the liquor and food licensing for this event we've had great success and working towards getting a legally complete application. It's just been a little bit back and forth. So I do believe that I have received so far. For the questionnaire and the updated application what we needed. There's still some things in some internal deadlines. that we need finals for. And Mr. Bitumen has been made aware of that in print and on a couple of different city platforms.
[57:05] Great, thank you so much for that summary. Yeah. Just in terms of would you say that last year's event was in compliance with any applicable laws based on your the city's research. I am not an attorney. I do not represent the city in legal matters. But what we did find was concerning enough for us to draft a hearing notice, just like the one we have here today. When they submitted the Kentucky Derby party right? But there was no no legal action taken against a group from us. I was just asking in terms of the way that yeah, and we're those you're just saying the city had fine sound enough to to go ahead and and take this a little further, which I agree with. So thank you for that. So are you saying this is the second time they've been before us for the same kind of what was the Kentucky, Derby. I guess I just wanna make sure I understand. Good family Member Roberts. They submitted a special event liquor permit for the Kentucky Derby party when we received that we, of course, started processing it for our normal policies and procedures. We then also provided them with the hearing notice and an information to pick up their hearing poster.
[58:16] because we're this of the alleged violations that we've believed occurred with the Saint Patrick's Day parade. They did not pick up their poster, and they withdrew their application for that Kentucky Derby party, so they did not appear before the beverage. Licensing authority, I do believe, and I can be corrected if I'm wrong. It was a jet on the agenda. but it was stated to be withdrawn. I understand. Okay, thank you. Can I respond. may I respond? Thanks. So just I just wanna thank Miss T. For all the help. So you know, getting us where we are right now. I just wanna apologize if if if there's an if it appears that we did not follow advice from that first application?
[59:08] I'm not sure who you spoke to about the out call having been procured already, but there's never a 10 whiskey, so I don't know what. No idea what that means upslope. I'm not sure if Jimmy had gotten the cans ordered or not. But yeah, but but we yeah, again, we there's no intention to do the same party and not follow any any kind of exemptions or rules the Kentucky Derby Party. So we're a volunteer organization. We're the Odd Fellows. There's a different group called the Rebeccas. It's kind of a subsidiary or a division an affiliate the the Rebeccas. We're gonna hold this Kentucky Derby party, so I personally had nothing to do with it. The first I heard about that event was when Christie was Christy's last thing was that
[60:01] Russell. Pretty Russell was the person who made that application. She called me, and she said that that there's she's got this notice of hearing. That's the first I had ever heard that there was an issue raised about our previous event. So we had. We had no no idea there was a problem. Christy is really withdrew that I you know it was not our choice, and and there was no party had at all so it. II know it looks like we tried to second by the apple or something, but that that's that's really not the case. Here, you know. Again, we're all volunteers. All the money that's earned by the Odd Fellows is given out scholarships, and to turn organization. So there's no no one's personally profiting off of these events. So yes, so that was the issue. With that it was after that notice. and Christy talking to me, and then her withdrawing was when the officer called me so it wasn't like the officer called me right after the event. It was Ben.
[61:00] And then he said, Are you gonna have this, this, this Kentucky Derby party, and I said, No, as far as I know, it's been cancelled, and and nothing happened. So just kind of to fill in the holes there. Thank you for clarifying. I was wondering if that event happened or not. You did that. Yeah. And so the Rebeccas is a separate organization. They use the lodge under the beneficial large bylaws and mandates, and how it's organized. But it's it's not us. And that was just a separate group that that uses these premises that look like they were exploring to have the idea of having a Kentucky Derby party, but they might need to get a liquor license for it. But as Ted said that that wasn't answered, you know anything that we were behind. Thank you for that. And so important it, too, is that we'll just add, you know, I'm a community leader. As community leader. We're we're doing our best, you know. As long as you know, we certainly want to learn from not having done things that might satisfy the group. How we can do it better. But we're highly trainable, and I think our intentions are good, and I actually think that these are responsible activities with responsible people for good ends.
[62:16] And so, you know, W, we're certainly here to try to give comfort that that we're paying attention. We're following the rules. I imagine if you're hiring off duty police officers, they would need to know that schedule. I'd like to know how you're preparing for this. Yeah. So we're required under our permit to get one off duty police officer. And I've gone through the online website. Proposal process, common dots, I think, is like that. Yeah. So I've done that. And we're doing great. Yeah. So we have about 100 members who are odd fellows and and a lot of of them and their families have have volunteered. So we're we're doing great. Yeah, we've got. We've got well over 30 people on my list, and I can provide that to Kristen in different. So we have marshals. As one line on tip, certified, separate. So marshals and Tip certified 2 separate people. We have a forward vest for everybody who's going to be a marshal, so we have enough vest already secured.
[68:09] you know, for that. So it's that doesn't give you any more authority than anything. But at least it shows a presence. Yup. We got a setup breakdown group we got Ted managers, food truck managers. I'll call vendor manager. So we're gonna have a separate group of people who are interacting with our alcohol vendors. So mountain sounds gonna donate, they're actually on right next to us, they're gonna donate a keg, and we're gonna buy kegs from them. And so we're gonna have a different group of guys who manage bringing in, you know, putting in the storage, we have a cage out back locked up, linked to all sales so that we can, I guess during the during event you guys come in and check and make sure we you know the I'll probably separate in. Is there? Good! That's set? I'm looking at spreadsheet right here as we look at. We got sound managers, great participant wranglers and neighborhood managers to help with the businesses. So.
[69:05] and just let you know me that The main check is right across the street on 16. They're excited about the event to bring people down. They're pretty empty. If you guys haven't seen that place, it's great. The food is really good to somebody goes there, but the our neighbors seem pretty excited and and interested in the event. We want to be around for 100 years more. And so we absolutely want to work with you on any events that we have. So we want to establish relationships so that you know this is never an issue ever again. And so if you're willing to give us this, this shot, added a promise, you will do everything right and do it the best we can.
[70:19] Some of the legal work I do. I talk about the clients, it's, you know, establishing a culture of compliance. And I think that we're we're level 7, trying to do that. We've been working with the staff on that and and open years on everything we can do to keep that going. And again, you know, we exist to serve the community. So what we make goes to local high school scholarships. you know, Blue Sky Bridge, other local organizations that you're familiar with, and we want to enhance our growth as a lodge with the largest lodge in Colorado to, you know. Continue to support the community, and this is one of the ways to do that. and you'll be on the brick city doing this, I think, like Christine, you said 35 years something like that. We wanna we wanna do this for 35 years. And it's not. You know, we we wanna have these sort of milestone events that are. Everybody looks forward to and and you know we can run them smoothly and easily

They're they're bet, much better. one of my concerns is just around last year that even though there was like a private event. You know it's it's unclear whether that was violation or not, but it seems to be kind of towing a line there. and II don't think in in this situation there should be any gray areas. It should be very clear. That whatever's happening is is, you know, in compliance.
[72:00] so I mean. I'm I'm inclined to approve with conditions. But I'm I want. I want to hear from everyone else. Yeah, I chime in on that. So I was thinking about the conditions component. But just some. So Mister Byrman's point when he's talking about the exceptions role in Section 44, I would like actually ask some city attorney, Chris, to about this, because what I'm seeing is, there is one part of Section 44 that says, if you're in your in compliance in a year before, like in a prior event, is going to preclude a local authority from approving it. Then I'm looking at this exemptions rule that was mentioned here, and I'm I'm seeing that because of the private club component and only invited attendees will be served. Alcohol. Colorado law protects this event. What happened in the prior year is what I'm looking at now. I just wanted to ask. Maybe our attorney about that. I just wanna verify I'm not an attorney and the licensing manager. So I'm gonna hand that off to Roberto.
[73:07] You can use the the evidence of the prior the prior year if you find that they were not in compliance, and you have reason to believe that they're not going to be in compliance going forward. You can certainly use that to make your findings if you're going to vote. So, for example, if the if the motion is to not approve but if you find that any. If there wasn't a a violation in the past, for example, it was a miscommunication that whatever it was then that wouldn't go towards a finding that they're going to in the future violate the the liquor laws. Does that make sense that does make sense to me? I was just trying to understand what had happened last year, and then just looking into the exceptions part of the statute here. I'm just kind of seeing that that would have protected what might have been out of compliance from last year's event is what I'm looking at. And that's just how I was kind of looking at understanding what the first way I would think about ruling and some member cars point. I was thinking about what I mean. What condition could you even put on this it would be to me it would be either approve or disapproves. I don't know how. What condition will we even do if you have an idea I'd love to hear that. But
[74:23] That's what I was kind of wrestling over. So if anyone's an idea for condition, I mean to that. But my inclination is based on this, on State law. That I would I would make a motion to approve it. We yeah. And you know, we have to look at the fact that there was no formal violation or charge that happened here, and at this point it is some. It is speculation and hearsay evidence. So I kind of II agree. I see your point and everything. And I agree with everything you're saying. But no, there was no charge. That's the ultimate. [75:03] I just wanted to agree with you that there was no there, we don't know what that was, and it's hearsay, and I think that we need to look at in the future. Are they going to have a violation? And I don't think so. I wasn't sure when we started this hearing. I was a little reluctant. I didn't care for just not getting straight to the point. but I do think that they really done a lot of research. I feel comfortable highlight with with them in charge of this event, so I'd make a motion to approve it. I don't have any conditions. I think I like that. [86:11] Okay. What type of organizations have you been a member? Well, I've just. I've been a resident that has participated in all sorts of hearings and stuff. So I'm not familiar with this format I've done city council and landmarks and zoning and and a variety of things over the years. And I've been a volunteer in the local schools. And I, you know, used to work in downtown boulder. I've been here a long time, but I'm not. I'm not a member of the Hill Neighbor Board. I've just been a member of the organization for the Hill Neighbors. Okay, and Miss Min, our form, as I'm just going to ask you a few questions, and then I'll turn over to the authority, and they may have some questions for you. Okay. thank you. Yes. alright. And, miss, men you're here to testify today in support of the Moxie hotels, liquor, license application. Is that correct?
[87:03] Yes, it is. And do you think that there's a need and desire for this license to be issued to the Applicant, and if so, tell us why. I think that we need the hotel to operate. Well be part of the community and add to restoring the hill as a community a varied ages and opportunities, and I think for a hotel to operate like this. They do need a liquor license. Hmm! And are you aware of any other hotels on the hill. Nope? And so this would be a unique concept to the area and talk a little bit more you mentioned to to kind of revitalize the hill area. Talk more about that. How do you see this helping? I think that it will bring the hill to be a destination for people you know, that are visiting Boulder, that they can stay up here. I think that we have hotels downtown, and I don't know that very many of those people get to the hill unless it's graduation it's you or something. And I think this makes a convenient space for students, families to stay and neighbors families to use it.
[88:26] And I hope that they can rebalance the operation to the hill. It's very different than it was in the beginning, and it's, I think, coming back. And I think this is key. Okay? And do you think that this hotel can help bring additional business to other businesses and local businesses in the Hill area? Absolutely. I think it'll bring a number of people that will discover the restaurants and the small amount of retail that's left. And I think that that's important for this, and they can also help them discover other areas like Chautauqua. Which is, you know, walkable from the hill.
[89:02] Okay? And do you think that this location would be a place that non student adults might want to go to, to have a meal, to have a drink, to to relax. Okay. Is it a place that you could see yourself doing those things? Yes, and the neighbor has already asked if few of us could go down there in their first week of operation, and and make our presence reappear perfect, perfect. And why is it so important, you that there is a location that non student adults are welcome to to common experience because it used to be here. And I think it needs to come back. And I think that we need to bring the community back together. More, and the adults need to realize the hill is still here, and it's walkable from here and there are a lot of good businesses down there, and there should be more in the vacant spaces. Get filled. Okay? And is it your request today that the boulder licensing authority approve moxy boulders, liquor, license, application. Yes, it is.

We really want the hill to be restored to be representative of Boulder just like Peralez, and a fairness that all the hotels in the downtown area have some parity with of alcohol service and customers. Customer base Miss may I guess? One last question for you. Do you think that democracy Boulder would also help having a year round business that that's available cause? I know I I'm a former student underground law school in Boulder. I know that the hill gets a little bit quieter during the summertime, but you see, this being a business that that would be operational and and helpful 12 months a year. Yes, and I think that I know people who come up here for Shakespeare and see you in the summer, and they stay downtown. They can stay on the hill now. I think adults can come to use to talk and a place to stay. We can't
[91:02] turn all the houses into Airbnb so they can walk just a top. I think a hotel that's approachable for average people would be really a good location to be on the hill. Yes, sir, once again for the record. My name is Eva Garretson, one of the owners of liquor licensing professionals. We do need some desire survey for liquor and marijuana licenses throughout the State of Colorado.
[92:09] And how long have you been an owner of liquor professionals since March 2,017 approximately. How many petitions would you estimate that you've been part of so prior to that, I worked for liquor pros under the former owner. And we've looked at this liquor pros has done over 4,000 surveys, and the State of Colorado, and have worked in over a hundred jurisdictions. You provided testimony in most of those jurisdictions as well, most of them. Yes. and then we please describe for the authority the services that liquor pros provided to the hotel in this case here. Yes, sir. So prior to the so liquor pros was hired by the applicant to provide the needs and desires survey for the new hotel and restaurant liquor license for Moxie Boulder, located at 1, 2, 4, 7 Pleasant Street, this particular survey was done on Tuesday, January twenty-third, and Wednesday, January twenty-fourth.
[93:09] we made attempted contact with 420 72 business owners and managers and residents in and around the area. What we tried to do with this one is grab several spots. Usually we hit the same spots. But at this point in time as you can see from the member the number of not qualified contacts, and the reason for declining to participate. Those numbers are fairly high. Don't know what the reason was at this point in time. In in echoing officer. Rec we did actually run into a couple of situations where our surveyor declined to grab any couple of signatures, because she did feel that the the Id from a couple of these underage were not valid. So at that point in time, we just denied getting a signature from them because she did. She wasn't sure, and they just looked really really young. She said so at that point in time she just kind of walked away from that of those we obtained a total of 130 signatures. 53 were from business owners and managers, 96
[94:17] signing in favor with 51 signatures, 4% opposed. At 2. We then obtained a total of 77 residential signatures, with 68 signing in favor, 88% and 9 opposed. At 12, we actually have 119 signatures signing in favor at 92% and 11 opposed that 8%. Once again, on your on the packets, they do ask to write in why they are in favor or opposed to this License. Page 2. Says, reasons for opposition signatures. 6. Declined to provide a reason 2 said enough, or too many one set stated no need. And there was there was 2 that said too many drunks in the area. There was one positive
[95:02] and I think this was important to ask for both feedback from both in favor and not in favor. There was one that actually signed to say that there was enough bars. We did explain to those folks that this is a hotel. That was coming in the area. We wanna be as transparent as possible, making sure that they understood. If they do have reasons, or concerns. Once again we do invite them to the public hearing to testify in front of the authority as to why they have concerns. For this license. There are, I believe I counted correctly 55 other hotel and restaurant liquor licenses of similar type inside this area. But even just the raw number of 92% still shows a positive need and desire for this particular license, and that the existing outlets have not yet met that need based on your experience. Oh, sorry! Based on your experience in 92 for a hotel restaurant license type in boulder is, is that a a high percentage in favor in your experience? That is high? Yes.
[96:06] okay, and talk a little bit more about the coverage map. I know you mentioned that there were not a lot of responses. But why was it so important to get business areas and residential areas that covered the entire boundaries that were provided. Specifically, because this is a hotel. Hotels are known to have events. They're known to have be available for graduations. Other types of events similar and around there, I think what we did is like, I was saying, we in the past, we've stayed and we've gotten higher numbers back in certain areas. And this one, we tried to actually jump around a lot just to see if there were any concerns with regards to the license and specifically focused on the hill. So we tried to grab samples in and around that area. It does look like a lot of the residential areas that were covered were in the hill area. Is that correct? And did you prepare report and free file with the City of Boulders required? Yes, sir, we did.

But the reason we did expand this footprint. For neighborhood? Was it mainly because of the demographic of what it previously was, and such as with the University being a part of that, it was such a small area. So yeah, I yeah, I agree with that. No, it was a great area. Folks were very responsible. Most of them were very responsive. And and it was, Yeah, I think just the sample opened it up a little bit more. So I appreciate that. Actually, it did. It did allow us to kinda look at other spots in there, especially the hill.
[98:04] We also discuss it while this is the Hill Hotel and on the hill. It is going to affect a larger scale than just the hill for the city. That is correct. What do you anticipate? The opening date to be? So right now? Slated opening date of eighteenth of April? And are, are things on target to open that quickly as far as I've heard recently. Yes.
[99:12] I went and visited the site, and I'm getting work done at my house, but I believe every construction worker is at your hotel and not anywhere else in the State. So it looks like you're moving quick. Prior to this position, as the general manager describe your experience in the hospitality industry for the authority. Yeah, thank you all. Just a brief introduction of my history experiences back in college, went to pretty university, studied hospitality. A post graduation found myself out in DC at a under room boutique property started off as a supervisor manager and training and then sort of progress naturally within hospitality became a true passion for myself, and led me to San Antonio, where I worked with the Marriott River Walk property and then start there as a supervisor and progress to an assistant manager.
[100:03] Within the front office team. And then joined the Gaylord Brands when the Gaylords became part of the Mara family up outside of Dallas. Again, sort of held the leadership capacity in the the room side for an office. As well as group housing events, reservations but found myself really back into the operation side. Really, my passion is leading teams, mentoring individuals and just providing an excellent level of service for guests. So transition to an operational leadership role in Dallas. spent a couple of years in that capacity. And then, being from Indiana. My wife and I thought it'd be great to head back to Indianapolis and be close to family and friends, and took position at the Jw. Marriott where I have positions within the front office and housekeeping from there continued growth led me out to Colorado started out here at the Renaissance and Broomfield where I held the assistant general manager. Position. Post that my general manager at the Renaissance took an opportunity in Boulder which led me to boulder so worked at the Hilton Canyon, the Mc Suites the Hilton Garden in
[101:18] again hotel manager, assistant drone manager, where I led the operational team from front office rooms, banquets, events, as well as restaurants bar at both the Nbc suite and Hilton burden in the passion for lifestyle and experiential focus led me to the position before this, where I was the assistant drone major at the Jakarta Hotel. Autographed collection property in Cherry Creek again. Really leading all off operational efforts. Including kids be on the rooftop narrative restaurant the banquet team as well as front office and rooms. Coming into this goal has always been to to be general manager and lens me to where I'm at now, and started with the moxi boulder on the second of January. So ben with the team for
[102:11] almost 2 months now. at these other hotels that you mentioned, where there are liquor licenses at those there were. Have you been a registered manager for any of the locations when I was at the Renaissance Broomfield, I was registered manager for that property, and as a registered manager. Were there any liquor violations under your watch? There were not. I will talk a little bit about the roles and responsibilities as the general manager. So let's kind of start now the pre opening. And then how you believe that that's going to evolve when the hotel does get open. Yeah, so right now, current capacity, is really, you know, looking at our leadership team and recruiting and identifying those individuals, hope to have those identified within the next week or 2. With start dates in the mid march timeframe and then from there focus on line level and recruiting efforts. Aligned with that.
[103:04] we'll start posting those line level positions, probably first or second week in March. And then bring those team members more on board. A little bit closer to opening the beginning of April. and as a general manager, are you gonna be in charge of hiring firing employees. I will be, are you gonna be the one that's ensuring that liquor policies and procedures are not only implemented, but they're followed. And are you gonna be the one that's verifying and and confirming that all of the required training is gonna be completed, absolutely cool. So are you really in charge of all day to day operations. Yeah, all day operation will be my capacity. Obviously familiar with hostel, you're you're always available. And I've always been available. In my previous capacities. No different here. Will be a a small but mighty team, and will always have a leader. On site but should anyone need further assistance if I'm not on property, I'm always available.
[104:03] Let's talk a little bit about the concept. How would you describe the concept of Moxie generally? And more specifically, the Moxie boulder? Yeah, to sort of touch base on Miss Minton's comment on, you know, being a place that's approachable. I mean, that's the Moxi brand in a nutshell right at Portugal, creating Eric experienceual experiences for the for the guests, but also the community, and we find one of my passions and goals. Is to embrace that locale of the hill, and how we can embrace the community members and really be a part of that knowing that it is on the the campus and at that aspect, but also pay how much to do the residents and really create a space where they're welcome, feel welcome, and a place that they are entertained. You believe it's moxy Boulder, and specifically your goal as well to make sure that the hotel really is a member of the community. Absolutely. I've had
[105:00] the pleasure to be introduced to some of the Hill Association members some members from the scene. As well as visit boulder and boulder Chamber already, and look to expand on those relationships as we progress. And are you aware that Boulder has a responsible association of retailers? I am, yes, start off already, with a introduction in your inquiry to be a part of that organization as well as some other efforts. Then you heard Officer rec talk about a lot of the fraudulent Ids and doing bar checks and compliance checks. Explain to me why it's so important to have a good relationship with Boulder, Pd. And what steps are you taking at this point? Yeah, absolutely. I look forward to actually speaking and meeting Officer Rec. And Brandon has had the opportunity to speak to her a little bit. And I look to be a partner in that, and really work together on what they're seeing out there, and how we can. you know, alleviate some of those issues and problems. Some of the things that we have in place and will put in place will be rendered with the Bars organization, where they come out routinely and do a sort of secret shop
[106:12] as far as training onboarding as we build out the team, you know, being in new opening, have a great opportunity to ensure that everyone's trained properly from the get. Go so that'll be the the initial focus with standard operating procedures, tip certification training and then progress with, some more Marriott systems training but even before the hotel opens to include really diving into those policies and procedures. For the property. As far as identification everyone. If someone requesting multiple rooms. and for each individual to also can have a continuous training and pass on between shifts. So if there's any instance where individuals need to be addressed that the team is aware of that
[107:00] and then keeping the calendar sort of what you discussed previously, as far as certified. We don't wanna say those individuals certification. You heard Miss Mint mentioned before how important it is to have the hotel really a part of the community and help people experience Chautauqua and other parts of boulder potentially help other businesses and local businesses on the hill. Yeah, with the property. There'll be an opportunity for us to really partner with local vendors local boutiques as well as spread the word for the same spots on the hill. We'll looking to generate collateral that is provided to the guests upon arrival, and available throughout their stay. That really identifies those local gems. Where the guests can have that experience. To include. I should talk one the hiking trails. But really, again, allow that guest patron to have an experience outside of the hotel. But if they are in the hotel we wanna bring in some of that local into the property. So we look forward to
[108:11] those future partnerships, and pop ups. Let's talk a little bit about the menus. They're gonna off. They're gonna be offered. Let's start first with food and then alcohol. Describe the food menu that you're anticipating. So the the food menu will be to the Mayor brand standard for the Moxi brand. We'll offer breakfast, lunch, dinner from sandwiches, salads, flatbreads, bowls. to other elevated offerings. Tacos again. The Moxi brand is sort of a fun, unique experience, and we'll look at our food offering and address as we see fit for the clientele, and the full meals are going to be available at all times as required by the liquor laws. Is that correct? Correct? Okay. And then, as the kitchen is closing down. You're still gonna be offering sandwiches like snacks, at least 25%. The gross income from the sale food and drinks is gonna be coming for meals. Is that right? Describe the the alcohol menu for the authority, please.
[109:07] So that I'll call menu again being part of America and Moxi brand. There are some brand standards in place starts off with 6 signature cocktails that I will look to expand and grow on introducing some local spirits. As far as beer again. A number of standard offerings. I think it's around 7 or 8. Again, expand that based off of local offerings, and then wine very similar from 7 to 10. Buy the glass bottle offerings, and I think you've made it clear. But just wanna touch on it. It's not a beer and a shop kind of establishment. Is that correct? Okay, what do you anticipate? Price points being for for various drink options. We'll find that a cocktail anywhere from 15 to 18 beer per around the $8 mark, and then wine fluctuate again. Price similar to the cocktails 1518, $20, and have different specials, such as happy hours, things like that absolutely
[110:07] sometime next month, approximately. How many employees do you anticipate having total, including leadership per round? 50 total and approximately, how many members of management or leadership positions. Do you anticipate? Oh, rough! About 7 or 8. And again, I think you've made this clear. But when you are not there there will be another manager that is on duty at all times. Is that correct? Okay? And if you're not there, you're available to be there absolutely okay. And we're gonna discuss our liquor policies and procedures here momentarily, but talk a little bit about the onboard training their staff is going to go through and specifically regarding alcohol sales service. Yeah. So for for the concept, moxy, the front desk area bar area is very similar in the same area. So all Guest service team members as well as bar members. Will go through the tip certification again. We have the luxury of
[111:07] having those individuals go through that prior to opening as we bring on new team members. That'll be the first thing before they're able to to serve. From there. Again, diving into those policies and procedures. You know, probably roughly, about a 2, 3 day training for that, and then lead into more Marriott specific system training. And have you been trained yourself with a responsible vendor? Yes, I was recently updated certification through liquor price. Now we'll talk about our liquor policies and procedures, and and just to touch on a few things you've heard from Officer Rec. Regarding compliance checks. And and you do understand that, being in a college town, it's really important and imperative that we be a safe and responsible seller and server of alcohol, and part of that is having the right policies and procedures. Do you understand that? Let's talk a little bit about those policies and procedures you touched on a couple. But let's go through. What are the policies and procedures gonna include.
[112:03] I think again, as far as looking specific at identifications or ids, not accepting vertical ids or paper Ids being a collision, you know, or being on a university campus, passports will be verified. From there. There'll be a consistent training, like I sort of touched on with appreciate puddles going over reviewing anything that our team members may have questions in regards to really diving into the the fake. Id situation that sounds like is very apparent. In the market. And understanding those guidebooks that are in place to sort of verify those out of State license. And then working with officer Rec on. You know, process and procedures that we can implement to help alleviate that current concern. I believe. Officer Rec. If you do meet with her, will provide you information on fraudulent ids. What you need to be looking for as far as logging that information. Do you anticipate logging any sort of incidents and obviously communicating with the Pd is required? Yeah, absolutely.
[113:10] And what's the policy regarding multiple drinks if I'm there with with my partner, and she goes to the restroom. Can I order 2 2 drinks, or do you need to see both ids so for us possibly that we'd need to see 2 ids if they're gonna be ordering multiple drinks. And if there is an id that does look fraudulent or sketchy for lack of a better term. Is there managers that are available to handle those difficult conversations with guests? Yes, talk a little bit about the cameras and security that is gonna be available. Yeah, so security cameras throughout the property available. And then we will look to provide additional security measures. Additionally right now, looking potentially. Thursday, Friday, Saturday. But expanding those based on needs. you're gonna have proper signage throughout, letting guests know where alcohol is allowed to go. Not allowed to go. Yes, yes.
[114:07] yeah. So the arrivals right there by the guest service team. So we'll have team members visible to bring up those concerns, and a person guess as needed. Either have them store the the beverages in the vehicle if they brought a vehicle, or have those items held on hold until they depart. I think you've talked a little bit about the bars program. That's the secret shopper where they come in and test your staff. Is that something you do plan on implementing? Yes, reach out to them and sort of once you sign up, they start going. So since our opening date isn't until mid April. I'll sign up beginning of April and have that monthly service started. Well, if we have a staff member that fails, a compliance check serves a minor, visibly intoxicated person, what are job consequences? Termination. And isn't Staff going to be aware that we are a 0 tolerance employer? They will.
[115:08] We'll talk with you about game days, because, see, we are now a football school. So let's talk a little bit about those game day experiences. Do you anticipate changing operations for those Saturdays, or is it operation as normal. It'll be operation as normal. You know, as we progress and find our fit within the community. And during those elevated event dates we may progress, but the standard would be operation as normal. And if we do have larger crowds that come to watch the game on televisions, are you gonna have additional security as required. We will. Okay. I wanna go through our layout. And who's gonna have access to that key or lock. It will be leader only access. We are looking to license the entire area. Is that correct or the entire basement area. Alright, I want to go through. Now. L. One, we're gonna go in a little bit more detail. This is the lobby in first floor. Is that correct? It is now, as you walk through the front door, please tell the authority what they can expect to see so the front door off of Pleasant. When you walk in the door. If you look to the left. Where the number 2 is. That's A lounge area, the gathering place for hotel guests. But also a place that we see utilizing for sort of a a study or co working space. If you look to the right at the front end of the structure. Bar structure will be the check in area, and then sort of wrap around from there is the physical bar.
[117:21] With some soft seating in front, and then sort of wraps around to additional seating and then just north of the bar. Again, another area where that number 4 is. We'll have some lounge casual seating over to Number 5. Is sort of where we have our indoor outdoor patio. which is a visible through from the bar to outside. With glass door panels that are sort of accordion-like, so it can create an indoor outdoor space. And then, if you look at the number 7 expanding off of the patio will be an enclosed fire pit with a gate around there in railing and then expanding north a little bit. On the north end of the patio. There is another small fire pit.
[118:16] Let's talk about setting engagement able to visibly see the outdoor area from inside. Is that correct? And so there can be constant monitoring if people are on the outdoor patios, and the outdoor patios are going to be enclosed through various railings. Is that right? And there'll be proper signage there, notifying guests. The alcohol cannot come or leave. Okay. And that whole area where we're looking at 3, 2, 5 for that entire area really is open. Is that right constant monitoring that's available from staff. And let's go a little bit further north. Here we're we're seeing numbers 1110, 12, 9. Talk about what those rooms are. So yeah, as you continue down quarter on the First level, right in front of 11.
[119:01] Is the fitness center 11 represents a small meeting room boardroom. then 10 is represent of our meeting room. He currently named smaller. The 2 12 is outdoor terrace that incorporates the event. Space and then 9 is a another meeting room that is dedicated to events into license. The entire First Level is that correct? And even though you don't anticipate, I assume people drinking alcohol in the gym, it's more, for if someone goes to check on their partner or fellow guests that there's no liquor violations by them carrying in their drinks. Is that right? Let's talk about these private areas. The 1,012, 9 that can be rented out if those are rented out staff in those specific areas. To make sure there's constant monitoring about all. Yes, okay. let's go through to the next page. Then
[120:01] we are going to be on liquor license. So this is the Second level. Is that correct? And these are just guest rooms. Is that right? And so we are asking license all the guest rooms right? And tell me a little bit about these rooms. How do you anticipate there being alcohol consumed in these these rooms. Only thing that would be available is if they purchase something at the the bar brought up to the room. There's no alcohol present in the room as far as the Mini bar. So that would be the only reason. Are you anticipating there being room service with alcohol drink at the bar, or they want to finish their drink from the bar up at their room. Do you anticipate selling buckets of beer for people to bring back to the room we do not concern. Maybe, that you're on the hill. Is this gonna become a student hangout in the rooms. What do we do to help monitor those situations?
[121:00] He's only set at 21 to reserve a room. And are we gonna have staff members there cognizant of these rooms and walking the floors to make sure that everyone is staying safe. Okay, let's go to the next floor, which is liquor license number 3. And again, this is the same where it is different guest rooms. Is that right cool? And then the one addition is an exterior roof deck. Is that right? Can you please describe that area for the authority? Yeah. So On the third floor, exiting the corridor on the north there is a small terrace area with a small splash pool, and then some limited seams. and if that area is rented out for for an event with guests. Will you have staff that's dedicated to that area? And how is it accessible? So there's a key only accessible door. At the entrance into the terrace, and you are aware the boulder does have different hour restrictions based on the interior of the patio. The exterior roof deck. Is that right? Correct? And we'll program
[122:12] correct. The applicant does have possession control of the license premises or potentially license premise through at least for at least one year. Right? Yes. And did you post the premises, sir? I did, and I was on property around 120'clock earlier today, and it was still present purpose that you think is important for them to know either about yourself being the GM. Or specifically the the Boxi border. Just to touch on really that sense of community that we look forward to. Really embracing that being a part of that. And as Miss Minh sort of mentioned the growth of the hill and really tracking guests

I've already been talking to Mr. Swisher about trying to get my room for those college football Saturdays. So I do think it's gonna be a great great part of the hill in boulder in and of itself. So we've signed 2 leases in place the first one which is closer to the entrance on the hard corner of Pleasant and Broadway is called Mr. Oso. It's a Mexican restaurant it recently won a bin Gorman from the Michelin group, which is Michelin Star, basically has a a secondary award for restaurants that deliver great value, much lower pricing but really awesome food. There's 2 in Denver, one in rhino, one in Wash Park. Really awesome. The local operators culinary, creative. I think they're the largest local operator in the Metro Denver area.
[125:15] And then the second retail place is aviano coffee that is, to be 2 spaces in Cherry Creek to opening up in the airport. But break coffee from Intelligenceia. Hopefully, you wanna make that another local hangout space as well. We have 2 1,700 square foot spaces left over that are closer to university. We're looking at pizza and wine concept for looking at juice concept, likely gonna be all Fmb, as we look to activate that courtyard throughout the community make it just an an overall centralized gathering place. May is better for me, and I don't have exact case. If you're something in May that works better for the other authority members. That's fine with me. I'll be in process of getting back into the States right early April. But I I'll be may just makes more sense for me. But whatever you guys are in your full time thing there. So I just want to see what the authority members like, and I'll I'll go. I'll follow suit on.
