[0:03] We are recording great. Call to order the beverages licensing authority for Wednesday, April, nineteenth 2,023 at 3 Pm. Virtual hearing. Thank you, Chair Caliphano. We will begin with the instructions for the virtual hearing and rules of decorum. Thank you. Public participation at beverage licensing authority and cannabis licensing and advisory board meetings. The city has engaged with community members to co-create a vision for productive meaningful and inclusive civic conversations. This vision supports physical and emotional safety for community members, staff and board commission members as well as democracy. For people of all ages, identities lived experiences and political perspectives. More about this vision and the projects Community engagement process can be found at the link shown on your screen.

[1:14] The following are examples of rules of decorum found in the boulder, revised code, and other guidelines that support this vision. These will be upheld. During this meeting all remarks and testimony shall be limited to matters related to city business. No participants shall make threats or use other forms of intimidation against any person. obscenity, racial epithets, and other speech and behavior that disrupts or otherwise impedes. The ability to conduct this meeting are prohibited. Participants are required to sign up to speak, using the name that they are commonly known by, and individuals must display their whole name before being allowed to speak online Currently, audio testimony with video participation by licenses is permitted online.

We have a full quorum of 4 continuing on in our agenda today is the approval of the beverage licensing authority. Minutes from March fifteenth. 2023, any edits from any of the members. One staff apologizes for that error under agenda. Item number 7, the license. He did not pick up the poster in order to post the premises. so there would consider a a continuation to the May hearing

[4:08] and under agenda. Item number 9. The applicant did withdraw their application for consideration for their special event. Liquor permit agenda. Item number 2 matters from the Boulder Police Department. Officer Denning is not in attendance today. However, we will be hearing from licensing Manager Chang Garris. Thank you, Kristen Officer Dennis did ask me to share one update with the board today. So far the change to the new fermented vault beverage. Wine licenses has gone very well for him. He has not received any complaints or incidents related to the new license class, and just wanted to share that update with the board.

[5:06] Alright, Thank you moving on matters from the responsible association of retailers. Mr. Dewey. Yeah, hey? I'm having some camera issues. But good afternoon. Sorry I couldn't make it. Last month we were at Stream break. I don't have a lot to report today. Things are going really well for Boulder. We are getting a couple of new members it looks like in the in the coming month or 2 on the alcohol side on the Cannabis side. We are also really moving forward. So that's that's nice. The probably biggest announcement I have is just that we are going to be doing a fake Id training on me first with Officer damaging myself. We already have that confirmed between each other, just sorting out what penny we're going to be at last time we did it. It was really successful. We had about 60 people.

[6:02] and I'm shooting for at least that or more so we're gonna heavily promote that through the it. Landscape is really difficult these days. and other than that. Yeah, it just looks like it's going to be a really good screen for for R. And Boulder. Oh, also let me update you on what's going on tips. I should let you know the Tips organization did have a breakdown in the machines. So for the short time coming I will still probably be sending you all letters when people have not received their physical tip certificates. We're still not seeing some from February and January. and those are the hard copies. People are getting emails, finally saying that they they were certified or they did pass. So that means that machine is up and running, and they are catching up. In the meantime, should anybody need proof, I am literally myself, and my system are literally grading every single exam that's taking place.

[7:04] and before we send it off to tips. So we we scan them, we break them. And that way the Bla and community community can know. Everybody is is certified and and has passed. They just really haven't Haven't gotten that card from the Tips organization and on top of that as well. We're seeing really high numbers coming into the trainings. I'm literally maxing out, and I've already just had a bunch of emails today from people joining next week. and it looks like i'm going to be probably not stop for next week, too. So it's a really good sign. Things are picking up. People are hiring more people, and and training is resuming what it was previous to Covid. So that's it's great. And now i'm done so great. And Mr. Lesowski. Are you represented by Council today? No, we are not great. Okay, so we'll get you sworn in, and then I will go ahead and read the procedures into the record. This is a public hearing before the beverage licensing authority of the City of Boulder to determine whether or not the application of Hfs restaurants doing business as half as subs on the hill for renewal of a re hotel restaurant. Liquor license shall be granted or denied. This hearing is conducted pursuant to the laws of the State of Colorado, and the rules of the beverage licensing authority of the City of Boulder. The purpose of this hearing is to receive information and data and testimony by interested parties. In order to enable this authority to make the findings and to reach the conclusions required to be made by State law as to whether or not the license shall be renewed.

[12:10] Interested parties are the applicant residents of the neighborhood, affected by the license as previously determined by the authority and the owners and managers of business located within the neighborhood. This hearing shall be limited to the questions of whether there is good cause not to renew their license, as set forth in the notice of hearing dated April, nineteenth 2,023. A record is being made of these proceedings. Those who desire to be heard shall identify themselves by stating their name, spelling their last name, and stating the pertinent address. They shall also be sworn in by the Board's secretary. Is there any conflict of interest or ex parte communication from anyone on the board? Member California? No. remember absolutely no. And for card. Now remember, Roberts, now

Okay, this will be your time to kind of explain what happened and why there was a late filing for a renewal of the license. It was. It was really nothing more than a clerical error. We received the notification for renewal, and we discussed it amongst ourselves. Since I maintain the training records, I said, I will go ahead, and you know, you know, fill out all the paperwork and everything together. And I was looking at the calendar. I said, 3 weeks before. That's the 20 third December. That's when i'll go ahead and and start the process. It's normally when we're slower to at the restaurant. And so I put a reminder on my calendar. Unfortunately I accidentally put it for the twenty-th of January. and so when my reminder popped up, I I panicked got together what I could as fast as I could sign it in it was it was incomplete once that Michawn let me know that I

[14:09] I, you know, completed the rest of it within a couple of hours, and got it back back to her. But it was. I was just a clerical wire, I me putting in my reminders. Great, Thank you. [18:00] Good afternoon, and thank you for your time this afternoon for those of you on the board who were with us last month. You may recall we had a similar situation with the residents in by Marriott, and it's renewal. Interestingly, actually, this courtyard renewal was received by Boulder even before that one. But whatever reason we couldn't get them both on the same meeting for you. So you may recall, is part of our discussion last month that the Marriott renewals nationwide are handled by a law firm out of Pittsburgh, Pennsylvania, and they've done so since 2,011. That law firm handles about 2,500 annual renewals across the country for Marriott. In this instance the deadline for the renewal package was January sixteenth. and a mistake was made on the calendaring system. It was properly calendar for its expiration. However, it was not properly calendar for purposes of the

[19:02] January sixteenth deadline renewal here in Boulder. In fact, that was the day that the calendaring system popped up to remind the paralegal to complete and submit this renewal. She did so as quickly she could, took her about 2 weeks to get all of the training materials and everything pulled together, and it was received. Actually, it was postmarked February third, which is deemed received by Boulder. At that time it was, I believe, a complete application. and we find ourselves now before you. The calendaring system has since been changes have been made. It's been updated for purposes of our bolder licenses. It is now calendar, not only for the expiration date of the liquor licenses, but also boulders 45 day renewal deadline and in even earlier. 45 day. Let's get started on this renewal

[20:02] as part of the calendaring system. As a result, certainly hope this is not something that will happen again in the future. You may recall with the residents in there were some issues trying to submit it online. That was not the case here, this one, because it was late, was immediately put together, place in Fedex, and sent along to Boulder as soon as it was complete. It was at that point that the paralegal at the law firm began working to try to upload the residents in one that we had some issues with last month. So that is what happened. It was not a situation. Well, it was an honest mistake, and for purposes of calendaring some changes have been made to try to make sure this never happens again. Thank you. Great, thank you, Mr. Prophet. [21:04] not seen? Was she able to help her friend from residence in and did it work online. I was actually the same paralegal who handled the residence in, and when we discussed that last month she was not able to properly. She wasn't able to make the online filing in a timely manner, and it ended up being late because she had difficulty with that system, so that wasn't quite the situation here. But it was the same Paralegal who was assigned to Colorado renewals, and as the first time that she had been doing bolder renewals. I think she was hired in June of last year, and so, you know, hopefully, she better understand the online portion. and she's got a little bit of extra time when this comes due next year. Awesome. I was just wondering if it worked, if if that was ever completed. Thank you. That's great.

The situation that a rose here is that Mr. Lali received the State renewal form, but was waiting for the city renewal paperwork to come through the mail. He's had this location for over 19 years, and it's consistently come through the mail, so that was his procedure, and didn't think, to look for emails from the clerk clerk to the board's office from Boulder, and so he. I didn't see any email. If it came out with the renewal documents. And so it occurred to him that time was running short, and so he went down to the city clerk's office with the state renewal form and file the renewals. But it was late by that time.

[28:04] Mr. Lali has stated that he will put something on a a May, a calendar in his office rather than trying to rely on email it's not his strong suit to keep track of his email. So he's going to make a calendar that he can physically look at with the required dates, and he's also suggested that his general manager have his email added to the city's email list. So the emails coming out can be addressed by someone besides him. Hmm.

[29:02] It looks like, perhaps chair call fun of froze. I I do believe that would be the case vice chair car, Would you be able to possibly step in, or the vice chair, would you but be able to step in? Sure. Yes. so from here apologies I just to take a look at the next procedure here so generally. Next, you would ask if if there's any other evidence they want to present, and then have the Board members ask any questions. Oh, that's right. Yeah. Doing business as our gallery and wine bar for a permanent modification of a beer and wine, type, liquor license application at 2027 and 2035 Broadway boulder, colorado 8 0 3 0 2 staff does have suggested boundaries. If the authority is interested certainly suggested. Boundaries are the same as Chipengo, which is North Maxwell. South Orapaho. West Sixth Street and East Seventeenth Street. Then we don't have the how many or she's with those boundaries. Now i'll make. I make a motion to go with the staff. Suggestion for the boundaries for this license.

Today we do have a liquor sales room for a brewery for a Colorado liquor sales room permanent. that is, Preston Enterprises, Llc. Doing business as rocks and hops brewing for an application for a permanent Colorado liquor sales room at 2516, 40 ninth street unit 5 older Colorado. 8 0 3 0, one We do have the applicant with us today, and we are getting her brought in right now. You don't have to do that. Usually. What we do here is. Have Holly, for example. Just talk about the sales room, and then, just for all of your reference, since this is the first time. Well, the i'm going to it. I'm sure you guys are, too, in the bla packet. If you flip to page 113, it says there's a little like square that says, Notice to local licensing authority, and it says the application for sales rooms will be granted unless one of these conditions exist. So it's got a couple of conditions. So

[38:01] at the end of Holly, just talking about what's going on, I mean, you need to move to allow it, or you can move to deny, based on one of those conditions that are listed. Thank you. That makes sense. Yeah, yeah. Okay. Well, i'll open up to then Holly, to talk a little bit about the work she's doing. Great. Thank you. So we are operating under Preston Enterprises, our Llc. To start the Bere rocks and hops brewing. It's a micro brewery, the site that we have chosen. That was it's actually previously been 2 other breweries, Jay Wells Brewery and Stein Brewing and Company and Stein was there previously prior to us, and we actually did an asset sale in February with their equipment. And then so it's our business. We did the asset sell, and then we took over the lease of the facility of the garage that it's in.

[39:00] and it is. We filed as a whole manufacturer, as we will be manufacturing the beer, and then we also have a a very small tap room, associated in a small patio as well, and then, during the application process. They wanted to go through zoning again, and just to make sure that that that was all correct and and go through this process. Okay, Thank you so much for sharing that any members of the Board have any questions for Holly. Hey, Ms. Preston? I was just wondering if you don't have any association with the deviate distillery that's near there, do you? We don't. Yeah. I was just making sure, because those buildings are very close, and I I remember, so that the location you were in was Jay Wells. Originally it was Jay Wells, and then it became Stein brewing. But so there weren't any modifications made to that facility. You just you bought the place, and

[40:04] pretty much no permanent modifications. so the the entire liquor license is staying the same as it was. There's no modifications to license premise at all right. Correct. I don't have any other questions. I I had a question. Oh, no, no! After you're done with the questions. I have just a comment about your motion. Okay. yeah. I had had a question about yeah, maybe I missed this. But was there any like Tips training certifications that were submitted. I didn't see that in the packet. as far as I mean, we are all cicerone serving certified. And so we have done that, but no other specific certifications that i'm aware of. We've been home brewers.

[41:01] and and I can answer as to that. Remember, Kar, if you would prefer. So the city of Boulder does not grant their liquor license. That is, a State issued license. The only involvement we had is as to either the objection or not to their permanent sales room. So the State governs their liquor license, which is why there's certain things that you you aren't, seeing as part of a a permanent sales room application. We don't get these very often. but once in a while. Okay, Thank you. So all yeah, i'll. I'll follow up in clarification on on responsible seller and server training would come from them directly to the State. Okay. thank you. No other questions for me. and it looks like Tierrakovano has rejoined us. So just the part that I was gonna mention with motions just based off of what Chris and just so graciously explained, is, instead of denying or approving, you're going to object or not object to this sales room

One of those things that will be a a lot different for you is how previously, when we open the meeting staff and members of the thought of Excuse me of the authority are coming in first. and that is not recorded, and then we let. When it is time, then we let our applicants, licenses, and members of the public in at 30'clock, and then we start the recording with a Zoom Webinar, which will be transitioning to the minute we open the meeting. Everybody is let in, and everybody is live. So you will not have any of that pre meeting capability. So everybody's in there. Everybody's live. It's all

[45:00] everything is is in real time. So just to keep that up to date for yourselves. And as a reminder, so I know that'll be a little bit of a transition for you. It is a city of boulder

[46:00] objective that all staff, all boards, commissions, and volunteers do take this training. so that you know there's a couple of them coming up. You can schedule yourself through that genie link. There are a couple of them that are scheduled that are specifically for certain boards and commissions already, only there are some that are open to you in general, and then there are some where you could join another board or commission that already has one scheduled up, and you'll see that when you click on that you need to schedule yourself. The next one's coming up are in May. So the timing on. That is why it's important that we got that this to you. There are some weekday, and then there also are some Saturdays. If you've got any questions, we can try and answer them now, or you can send us an email, and we will try and and answer that for you as it gets closer. [47:04] How long is the training. I believe it's a 2 h training. And yeah, they have it on the on the sign up for 2 and a half hours. It's really easy to sign up to. Oh, great! You already did thank you. And are these all live trainings, or is it like a pre-recorded thing we can. You know there's it's a live training, but they do send you a link for a 1 h. Video: that you'll watch beforehand. It's either 45 min or an hour. But there's an attachment that explains all of the training and and everything in that with that email that I sent. And if you're at the Okay, what's the expectation? This is, please. So they're in May. Okay? And they're coming up quickly. So.

[48:03] But if you can't make them, just let us know they are going to try and possibly do some towards the late the end of the year. But what we don't want to have happen is the one. Everybody waits till the end of the year, and then they're all full. I think I signed up for one in June. Is there one in June as well. That's nice. They might be adding. So that's great. The virtual offerings are all in night, and then they have some in person offerings in June. Did you say that there was one specifically for our board, or that they were per board? So they do have some that are board specific, and you'll see that when you log in there'll be some that are just close to that to a specific board. There'll be some that are open to everybody, and then there'll be some that say, you know, for this board, but open to others. So it just kind of You'll just kind of have to go through the list and see what works with your schedule.
